【摘要】：麻醉藥品和精神藥品是否安全,直接關(guān)系到廣大人民群眾的生命健康乃至社會(huì)的公共安全。隨著我國醫(yī)藥衛(wèi)生事業(yè)的發(fā)展,麻醉藥品和精神藥品監(jiān)管已經(jīng)成為行政法學(xué)界學(xué)者們共同關(guān)注的問題。文章意在對我國麻醉藥品和精神藥品行政監(jiān)管主體的法律問題進(jìn)行實(shí)踐探索和研究,逐步完善我國麻醉藥品和精神藥品監(jiān)管主體模式。 文章分為引言、正文和總結(jié)三部分。引言部分通過介紹發(fā)生在湖南湘潭的麻醉藥品和精神藥品流失事件,提出我國麻醉藥品和精神藥品監(jiān)管主體方面存在的法律問題。正文部分從四個(gè)方面對我國麻醉藥品和精神藥品監(jiān)管主體的法律問題展開論述。首先,文章第一部分對麻醉藥品和精神藥品監(jiān)管的基本理論和法制基礎(chǔ)分析。對麻醉藥品、精神藥品、藥品監(jiān)管、監(jiān)管主體的基本概念進(jìn)行了闡述。然后從法律角度和藥事管理學(xué)角度分析了麻醉藥品和精神藥品監(jiān)管的必要性。在此基礎(chǔ)上,總結(jié)分析了我國麻醉藥品和精神藥品監(jiān)管的法律法規(guī)基礎(chǔ)。第二部分首先,闡述了美國麻醉藥品和精神藥品監(jiān)管主體模式；其次,介紹了我國麻醉藥品和精神藥品監(jiān)管主體的沿革及我國麻醉藥品和精神藥品監(jiān)管主體的模式。對比分析了美國和我國在麻醉藥品和精神藥品監(jiān)管主體模式上的異同。第三部分從CFDA的設(shè)置和法律定位、藥品監(jiān)管部門的人員構(gòu)成、麻醉藥品和精神藥品監(jiān)管主體模式以及醫(yī)藥行業(yè)協(xié)會(huì)的發(fā)展?fàn)顩r等角度分析�？偨Y(jié)了我國麻醉藥品和精神藥品監(jiān)管主體設(shè)置方面存在的問題。第四部分為我國麻醉藥品和精神藥品監(jiān)管主體模式的完善。首先分析我國麻醉藥品和精神藥品監(jiān)管主體設(shè)置存在問題的原因；其次,從法律角度提出完善措施。主要包括：健全我國麻醉藥品和精神藥品監(jiān)管的法律法規(guī)體系、實(shí)現(xiàn)藥品技術(shù)監(jiān)管與行政監(jiān)管相統(tǒng)一,確保監(jiān)管主體獨(dú)立性、加快中介組織立法,促進(jìn)醫(yī)藥行業(yè)協(xié)會(huì)發(fā)展等方面提出了完善措施。文章最后得出結(jié)論,提出我國麻醉藥品和精神藥品監(jiān)管主體模式應(yīng)當(dāng)逐步擺脫“一體,多部門”的混合監(jiān)管模式,形成獨(dú)立、統(tǒng)一、高效和公正的“獨(dú)立監(jiān)管”的主體模式。
[Abstract]:The safety of narcotic drugs and psychotropic drugs is directly related to the life and health of the broad masses of the people as well as the public safety of society. The regulation of narcotic drugs and psychotropic drugs has become a common concern of scholars in the field of administrative law. The purpose of this article is to explore and study the legal issues of the subject of administrative supervision of narcotic drugs and psychotropic drugs in China. Gradually improve the main mode of supervision of narcotic drugs and psychotropic drugs in China. The article is divided into three parts: introduction, text and summary. The introduction introduces the loss of narcotic drugs and psychotropic drugs in Xiangtan, Hunan province. The main body of the paper discusses the legal problems of the subject of narcotics and psychotropic drugs supervision in China from four aspects. First of all. The first part of the article analyzes the basic theory and legal basis of the supervision of narcotic drugs and psychotropic drugs, as well as the supervision of narcotic drugs, psychotropic drugs and drugs.
