【摘要】：對(duì)小說《苔絲》中的法律事件和法律行為進(jìn)行分析會(huì)發(fā)現(xiàn),苔絲的悲慘命運(yùn)的每一個(gè)轉(zhuǎn)折都和英國(guó)當(dāng)時(shí)的法律制度密切相關(guān)。英國(guó)當(dāng)時(shí)的侵權(quán)法實(shí)行的是過錯(cuò)責(zé)任原則,導(dǎo)致苔絲家的馬被郵車撞死而郵局和郵差不負(fù)賠償責(zé)任,致使苔絲一家陷入經(jīng)濟(jì)困境;苔絲被亞雷克強(qiáng)奸使苔絲失去了維多利亞時(shí)代婦女幸�；橐龅幕緱l件;苔絲懷孕生子是當(dāng)時(shí)禁止墮胎的法律規(guī)定使苔絲失身的事情被公之于眾,加重了苔絲被強(qiáng)奸的悲劇后果;由于對(duì)當(dāng)時(shí)離婚法律制度的誤解導(dǎo)致苔絲同意與克萊爾結(jié)婚并在新婚之夜被拋棄;當(dāng)時(shí)英國(guó)的土地法律制度導(dǎo)致苔絲的父親死后全家人流離失所;苔絲殺死亞雷克后,不公正的刑事法律結(jié)束了苔絲的生命�？梢哉f,正是英國(guó)維多利亞時(shí)期的法律把像苔絲這樣的破產(chǎn)農(nóng)民帶入了悲劇的深淵。
