【摘要】：隨著國家“四個全面”戰(zhàn)略布局的深入開展,依法治國也受到越來越多的重視。在這樣的大背景下,推進法律語言的規(guī)范化顯得尤為重要。而法律術語作為法律語言的核心,其規(guī)范化工作的重要性和緊迫性不言而喻。異形法律術語的規(guī)范化是法律術語規(guī)范工作的重要內容,本文將針對異形法律術語存在的一些問題進行規(guī)范化研究,并在“術語價”理論方法的基礎之上,創(chuàng)造性地提出了一種解決異形法律術語規(guī)范化問題的新思路、新方法,希望能夠將異形法律術語規(guī)范化工作落到實處,同時為推進依法治國盡一份綿薄之力。論文共分為七個部分,各部分具體內容如下:首先是緒論部分。主要包括研究對象、研究背景、研究綜述、研究目的和意義、研究選材、研究思路和研究方法。第一章是“術語價”理論的介紹。提出了異形法律術語的四個術語價群,分別是認知價群、語義價群、語用價群和功能價群。其中,認知價群又包括普通認知價、專家認知價、語形價、易識價、模因結構價五個術語價;語義價群又包括理據(jù)價、語義透明價和反義系統(tǒng)價三個術語價;語用價群又包括頻率價、分布價、地域價、語體價和時代價五個術語價;功能價群又包括反映價、突顯價和釋義元語言價三個術語價。第二章是異形法律術語的共性研究。我們從共性的角度出發(fā),基于“術語價”的理論對異形法律術語進行了表層和深層特征分析與規(guī)范。首先是表層形式特征的分析,通過對1000組異形法律術語的分析,我們將其分成了成分逆序、同音近音現(xiàn)象、縮略、分段相同、個別字相同、用字完全不同和綜合方式七種情況;然后是深層特征分析,結合異形法律術語的一些特殊情況,我們先后基于“�？普Z義三角”“模因論”和“語義三環(huán)”探討了異形法律術語的命名、模因結構和語義透明度等方面的差異情況;最后在“術語價”理論的基礎上結合具體的實例對一般的異形法律術語進行了規(guī)范化的操作演示。第三章是異形法律術語的個類研究。針對異形法律術語中翻譯異形差異的情況對其進行了分析與規(guī)范。首先從正誤譯差、共存譯差和地域譯差等三個方面對異形法律術語的譯差進行了分析,然后又結合“術語價”分別從正誤譯差、共存譯差和地域譯差等三個方面對其進行了譯名統(tǒng)一與規(guī)范化的操作。第四章也是異形法律術語的個類研究。首先對異形法律術語中存在的新舊差進行了分析,并在“術語價”理論的基礎上結合具體實例對其進行了規(guī)范化操作演示;然后又對正俗差的情況進行了分析,同樣結合“術語價”理論對其進行了規(guī)范化操作。最后根據(jù)得出的結果檢驗某些異形法律術語的新稱和正稱是否一定比對應的舊稱和俗稱更適合作為主形。第五章是對異形法律術語規(guī)范化相關工作提出的一些建議。首先是異形法律術語規(guī)范化的流程,我們認為,異形法律術語規(guī)范化工作應該遵循以下幾個流程:1.術語搜集;2.分類整理、描寫分析;3.確立主形、進行規(guī)范;4.征詢各界意見、形成規(guī)范文件;5.構建術語數(shù)據(jù)庫;6.動態(tài)維護與更新術語庫。其次是異形法律術語規(guī)范化的原則,我們認為異形法律術語規(guī)范化至少應遵循以下幾個原則:俗成性原則、理據(jù)性原則、系統(tǒng)性原則和簡明性原則。最后我們對異形法律術語分類規(guī)范問題以及異形法律術語的規(guī)范化研究對法律新術語定名的指導問題談了一些看法。最后是結語部分。首先是對本文的研究進行了總結,然后指出了本文研究存在的一些不足之處,最后談了本文研究未來的可拓展空間。
[Abstract]:With the development of the "four comprehensive" strategic layout of the country, more and more attention has been paid to the rule of law. Under such a background, it is particularly important to promote the standardization of legal language. Normalization is an important part of legal terminology standardization work. This paper will study some problems existing in abnormal legal terminology standardization, and creatively put forward a new way to solve the problem of abnormal legal terminology standardization based on the theory and method of "terminology price", hoping to regulate abnormal legal terminology. The thesis is divided into seven parts, each part of the specific content is as follows: First, the introduction part. It mainly includes the research object, research background, research summary, research purpose and significance, research materials, research ideas and research methods. The first chapter is the theory of term price. Four term price groups of abnormal legal terms are put forward, which are cognitive price group, semantic price group, pragmatic price group and functional price group. Three term valences; pragmatic valence group includes five term valences: frequency valence, distributive valence, regional valence, stylistic valence and temporal valence; functional valence group includes three term valences: reflective valence, salient valence and metalinguistic valence. The first is the analysis of the surface and deep features of legal terminology. Through the analysis of 1000 groups of abnormal legal terminology, we divide them into seven types: inverse order of components, homonym, abbreviation, segmental similarity, single character similarity, completely different use of words and comprehensive methods. According to the special circumstances of the abnormal legal terms, we have discussed the differences in the naming, memetic structure and semantic transparency of the abnormal legal terms based on the "specialized semantic triangle", "memetics" and "semantic triangle". Finally, we have discussed the general differences based on the "term price" theory and specific examples. Chapter three is the category study of the abnormal legal terminology. It analyzes and standardizes the abnormal differences in the translation of the abnormal legal terminology. Firstly, it analyzes the translation errors of the abnormal legal terminology from three aspects: correctness and error, coexistence of translation errors and regional translation errors. Combining with the term price, this paper unifies and standardizes the translated names from three aspects: correctness and error, coexistence and regional difference. Chapter 4 is also a specific study of the abnormal legal terms. The example demonstrates its standardized operation, and then analyzes the situation of correctness and vulgarity, and carries out the standardized operation with the theory of "term price". Finally, according to the results obtained, it tests whether the new and proper terms of some abnormal legal terms are more suitable for the main form than the corresponding old ones. First of all, we think that the standardization of legal terminology of special-shaped law should follow the following procedures: 1. terminology collection; 2. classification, description and analysis; 3. establish the main form, standardization; 4. solicit opinions from all walks of life, form a normative text. 5. Constructing terminology database; 6. Maintaining and updating terminology database dynamically. Secondly, the principle of standardization of abnormal legal terminology. We believe that the standardization of abnormal legal terminology should follow at least the following principles: the principle of vulgarity, the principle of motivation, the principle of systematicness and the principle of conciseness. The last part is the conclusion. Firstly, it summarizes the research of this paper, then points out some shortcomings of this study, and finally discusses the future of this study.
