【摘要】：在西方，闡釋學(xué)原理運(yùn)用于翻譯研究始于20世紀(jì)70年代。闡釋學(xué)原理對(duì)于翻譯理論以及翻譯實(shí)踐有其指導(dǎo)作用。在法律翻譯的理論研究和實(shí)踐中，同樣可以運(yùn)用闡釋學(xué)的相關(guān)原理來(lái)理解法律翻譯的過(guò)程。法律翻譯過(guò)程是法律轉(zhuǎn)換和語(yǔ)言轉(zhuǎn)換同時(shí)進(jìn)行的的雙重工作，它不僅涉及到作者、讀者、語(yǔ)言因素、交際目的，還可能涉及到兩種法律體系、法律文化、法律觀念。要達(dá)到兩種法律體系的交際目的，對(duì)譯員需要具備的素質(zhì)要求甚高，而法律語(yǔ)言歷來(lái)以生澀難懂著稱，法律翻譯過(guò)程中的重要一環(huán)乃是對(duì)于法律原文本的正確理解，而正確理解有賴于對(duì)原文本的正確解讀，由于闡釋學(xué)研究有助于對(duì)文本意義的理解和闡釋，所以與翻譯有著天然的本質(zhì)聯(lián)系，也與法律翻譯有著千絲萬(wàn)縷的關(guān)系。本論文將從闡釋學(xué)角度分析在法律文本翻譯中闡釋學(xué)的相關(guān)原理對(duì)理解翻譯過(guò)程的重要意義。由于闡釋學(xué)的分支分派較多，不能全述，，因此本論文主要從兩個(gè)方面進(jìn)行論述，一方面從法哲學(xué)闡釋的三大原則進(jìn)行闡述分析，另一方面則從闡釋學(xué)的三大原則進(jìn)行分析，并采用中英文法律條規(guī)之間的翻譯例子進(jìn)行論證。 本文將闡釋學(xué)原理與法律翻譯相結(jié)合，論述了在法律文本翻譯過(guò)程中相關(guān)的闡釋學(xué)原理對(duì)法律翻譯的意義。本研究從闡釋學(xué)的角度下研究法律翻譯的過(guò)程，具有一定的理論意義。作者希望通過(guò)這一研究，能夠?qū)Ψ煞g的過(guò)程有更深入的認(rèn)識(shí)，并且對(duì)于法律文本的理解更為準(zhǔn)確，最終能更好的為不同法律體系間的交流提供更好的方法，也希望對(duì)闡釋學(xué)原理在法律翻譯中的運(yùn)用起到一定的啟發(fā)性作用。
[Abstract]:In the West, the application of hermeneutics to translation studies began in the 1970s. The principle of hermeneutics plays a guiding role in translation theory and practice. In the theoretical research and practice of legal translation, the relevant principles of hermeneutics can also be used to understand the process of legal translation. The process of legal translation is a dual process of law conversion and language conversion. It involves not only the author, the reader, the language factor, the communicative purpose, but also the two legal systems, legal culture and legal concept. In order to achieve the communicative purpose of the two legal systems, the quality of the interpreter is very high, and the legal language is always famous for being difficult to understand. The important link in the process of legal translation is the correct understanding of the original text of the law. The correct understanding depends on the correct interpretation of the original text. Since the study of hermeneutics contributes to the understanding and interpretation of the meaning of the text, it has a natural and essential relationship with the translation, and also has an inextricable relationship with the legal translation. From the perspective of hermeneutics, this thesis will analyze the significance of the principles of hermeneutics in the translation of legal texts. As there are more branches and assignments of hermeneutics, so this paper mainly discusses from two aspects: on the one hand, from the three principles of the interpretation of philosophy of law, on the other hand, from the three principles of hermeneutics. And use the translation examples between Chinese and English legal regulations to demonstrate. By combining hermeneutics with legal translation, this paper discusses the significance of hermeneutics in legal translation. The study of legal translation from the perspective of hermeneutics has certain theoretical significance. Through this study, the author hopes to have a better understanding of the process of legal translation, to understand the legal texts more accurately, and finally to provide a better way for the communication between different legal systems. It also hopes to enlighten the application of hermeneutics in legal translation.
