【摘要】:動(dòng)漫是動(dòng)畫和漫畫的統(tǒng)稱。動(dòng)漫作品中的出場形象,由于在實(shí)際生活中成為群眾喜聞樂見的虛擬明星而產(chǎn)生了一種消費(fèi)吸引力,許多精明的商家隨之將其商業(yè)化開發(fā),從而與原有的作品版權(quán)市場共同構(gòu)成了完整的動(dòng)漫市場。現(xiàn)在,動(dòng)漫業(yè)正在邁著建立完善產(chǎn)業(yè)鏈條的步伐,朝著“產(chǎn)業(yè)化”和“全球化”的方向快速發(fā)展。動(dòng)漫產(chǎn)業(yè)已被國際社會(huì)公認(rèn)為是“2l世紀(jì)知識(shí)經(jīng)濟(jì)的核心產(chǎn)業(yè)”、“2l世紀(jì)最有希望的朝陽產(chǎn)業(yè)”。然而,隨著動(dòng)漫經(jīng)濟(jì)的升溫,盜版、惡意搶注、仿制衍生品等各種侵權(quán)現(xiàn)象也大量出現(xiàn)。由于商品化權(quán)是基于動(dòng)漫作品中的動(dòng)漫形象的一種“二次開發(fā)”權(quán)利,現(xiàn)有法律沒有任何明確的依據(jù)可以加以規(guī)制,這顯然不利于動(dòng)漫產(chǎn)業(yè)的健康發(fā)展。為此,本文從我國現(xiàn)在的動(dòng)漫產(chǎn)業(yè)知識(shí)產(chǎn)權(quán)保護(hù)現(xiàn)狀入手,對(duì)其進(jìn)行全面深入的分析和評(píng)價(jià),再在此基礎(chǔ)上介紹了目前主要?jiǎng)勇䥽业闹R(shí)產(chǎn)權(quán)保護(hù)模式并進(jìn)行了借鑒性分析,最后提出構(gòu)建動(dòng)漫角色商品化權(quán)為核心的全面知識(shí)產(chǎn)權(quán)保護(hù)體系。 正文分為三個(gè)部分: 第一部分是對(duì)我國動(dòng)漫產(chǎn)業(yè)知識(shí)產(chǎn)權(quán)保護(hù)現(xiàn)狀的介紹和評(píng)析。其中,首先對(duì)我國動(dòng)漫產(chǎn)業(yè)中知識(shí)產(chǎn)權(quán)侵權(quán)的表現(xiàn)進(jìn)行歸納,對(duì)我國動(dòng)漫產(chǎn)業(yè)知識(shí)產(chǎn)權(quán)保護(hù)法律的現(xiàn)狀進(jìn)行介紹。接下來,對(duì)上述現(xiàn)狀進(jìn)行了全面深入的分析,歸結(jié)出立法、執(zhí)法管理體制、保護(hù)力度薄弱等原因。 第二部分對(duì)主要?jiǎng)勇䥽覄?dòng)漫產(chǎn)業(yè)知識(shí)產(chǎn)權(quán)保護(hù)模式進(jìn)行介紹和借鑒。第一節(jié),對(duì)美國動(dòng)漫產(chǎn)業(yè)知識(shí)產(chǎn)權(quán)法律保護(hù)經(jīng)驗(yàn)和虛擬角色的商標(biāo)法和不正當(dāng)競爭法保護(hù),以及虛擬角色的商品化權(quán)保護(hù)方式進(jìn)行了比較全面的介紹,并對(duì)其進(jìn)行了簡略的評(píng)析。第二節(jié)對(duì)日本的保護(hù)模式進(jìn)行詳細(xì)的介紹和評(píng)析,以期對(duì)我國動(dòng)漫產(chǎn)業(yè)知識(shí)產(chǎn)權(quán)保護(hù)體系的構(gòu)建有所借鑒。 第三部分是最具建設(shè)性的對(duì)我國動(dòng)漫產(chǎn)業(yè)知識(shí)產(chǎn)權(quán)保護(hù)體系的構(gòu)建。在上述分析和借鑒的基礎(chǔ)上,首先引入動(dòng)漫角色商品化權(quán)理論,進(jìn)而提出以構(gòu)建動(dòng)漫角色商品化權(quán)保護(hù)為核心、從行業(yè)協(xié)會(huì)、動(dòng)漫企業(yè)、作品作者等方面進(jìn)行補(bǔ)充完善的全面動(dòng)漫產(chǎn)業(yè)知識(shí)產(chǎn)權(quán)保護(hù)體系。
[Abstract]:Animation is the general name for animation and comics. The appearance image in animation works has produced a kind of consumer attraction by becoming a popular virtual star in real life, and many savvy businesses have commercialized it with it. Thus, together with the original copyright market of works, it constitutes a complete animation market. Now, the animation industry is taking the pace of establishing and perfecting the industrial chain. The animation industry has been recognized by the international community as "the core industry of the 21st century knowledge economy" and "the most promising sunrise industry in the 21st century." however, with the heating up of the animation economy, piracy, Malevolent grabbing, imitation derivatives and other kinds of tortious phenomena also appear in large quantities. Because the right to commercialize is a kind of "secondary development" right based on the animation image in the animation works, there is no clear basis for the existing law to regulate it. This is obviously not conducive to the healthy development of the animation industry. For this reason, this paper starts with the current situation of intellectual property protection of the animation industry in China, and makes a comprehensive and in-depth analysis and evaluation of it. On this basis, this paper introduces the current intellectual property protection model of the main animation countries and analyzes it for reference. Finally, it proposes to build a comprehensive intellectual property protection system with the commoditising rights of animation characters as the core. The text is divided into three parts:. The first part is the introduction and analysis of the current situation of intellectual property protection in China's animation industry. This paper introduces the current situation of intellectual property protection law in China's animation industry. Then, the author makes a comprehensive and in-depth analysis of the above situation, and concludes that legislation, law enforcement management system, weak protection and other reasons. The second part introduces and draws lessons from the main animation countries' intellectual property protection mode of animation industry. The first section is the trademark law and unfair competition law protection of American animation industry intellectual property rights protection experience and virtual role. And the way to protect the commercial rights of the virtual characters is introduced in a comprehensive way, and a brief analysis is made on the protection mode of the virtual characters. The second section gives a detailed introduction and evaluation of the protection mode of Japan. In order to our country animation industry intellectual property protection system construction reference. The third part is the most constructive construction of the intellectual property protection system of China's animation industry. On the basis of the above analysis and reference, the theory of commoditization rights of animation characters is first introduced. Then it puts forward a comprehensive system of intellectual property protection of animation industry, which is based on the protection of commoditization rights of animation characters, and is supplemented by industry associations, animation companies, authors of works and so on.
