【摘要】：[目的/意義]政府?dāng)?shù)據(jù)開(kāi)放共享是中國(guó)大數(shù)據(jù)戰(zhàn)略的核心。政府?dāng)?shù)據(jù)的開(kāi)放共享必須由法律制度予以調(diào)整、推進(jìn)和保障。原則是法律的要素之一,并且法律原則具有基礎(chǔ)性、穩(wěn)定性,對(duì)于中國(guó)政府?dāng)?shù)據(jù)開(kāi)放共享法律制度的構(gòu)建必不可少。然而,中國(guó)尚無(wú)政府?dāng)?shù)據(jù)開(kāi)放的專門(mén)立法。為明確政府?dāng)?shù)據(jù)開(kāi)放應(yīng)循的原則,對(duì)于國(guó)際組織和不同國(guó)家的政府?dāng)?shù)據(jù)開(kāi)放原則進(jìn)行比較分析,以期借鑒。[方法/過(guò)程]首先,闡釋政府?dāng)?shù)據(jù)開(kāi)放的八項(xiàng)原則;其次,評(píng)析美國(guó)、英國(guó)和加拿大的政府?dāng)?shù)據(jù)開(kāi)放原則;最后,提出中國(guó)政府?dāng)?shù)據(jù)開(kāi)放的法律原則。[結(jié)果/結(jié)論]中國(guó)政府?dāng)?shù)據(jù)開(kāi)放應(yīng)當(dāng)遵循公開(kāi)原則、質(zhì)量原則、及時(shí)原則、平等原則、利益平衡原則和安全原則。
[Abstract]:The open sharing of government data is the core of big data's strategy. The open sharing of government data must be adjusted, promoted and guaranteed by the legal system. Principle is one of the elements of law, and the principle of law is basic and stable, which is essential to the construction of the legal system of open data sharing in China. However, there is no specific legislation for the opening up of government data in China. In order to clarify the principles that should be followed in the opening of government data, this paper makes a comparative analysis of the principles of government data openness in international organizations and different countries in order to draw lessons from them. [methods / process] first of all, it explains the eight principles of open government data; secondly, it analyzes the open principles of government data in the United States, Britain and Canada; finally, it puts forward the legal principles of open government data in China. [results / conclusion] the opening of Chinese government data should follow the principles of openness, quality, timeliness, equality, balance of interests and safety.
