【摘要】：對(duì)文書(shū)、檔案工作的重視是黨和國(guó)家一貫堅(jiān)持的傳統(tǒng)。隨著改革開(kāi)放地深入發(fā)展,我國(guó)檔案工作迎來(lái)了新的契機(jī),而《中華人民共和國(guó)檔案法》(以下簡(jiǎn)稱《檔案法》)的發(fā)布實(shí)施打開(kāi)了依法治檔的大門(mén),使檔案工作邁向法制化的道路�！懊�(令)”是國(guó)家行政機(jī)關(guān)用來(lái)發(fā)布行政法規(guī)、規(guī)章的帶有強(qiáng)制性和權(quán)力象征的公文。國(guó)家及檔案行政管理部門(mén)通過(guò)發(fā)布“命令(令)”的形式來(lái)統(tǒng)籌全國(guó)的檔案事業(yè)、宏觀指導(dǎo)檔案工作,推動(dòng)我國(guó)檔案法制建設(shè)地深入發(fā)展。本文緒論部分首先介紹了“命令(令)”的概念、演變過(guò)程、特點(diǎn)及種類,明確了本文的研究對(duì)象和范疇是1987年至今,以“命令(令)”的形式發(fā)布的中央級(jí)檔案法律法規(guī),包括3個(gè)國(guó)家主席令、10個(gè)國(guó)家檔案局獨(dú)立發(fā)布的令和13個(gè)國(guó)家檔案局和專業(yè)部門(mén)聯(lián)合發(fā)布的令。正是因?yàn)椤懊?令)”是最具強(qiáng)制性和權(quán)威性的下行文,所以本文選取它作為切入點(diǎn)。其次,梳理國(guó)內(nèi)對(duì)中國(guó)檔案“令”的研究概況,為本文提供指導(dǎo)和借鑒。正文第一部分是對(duì)中國(guó)檔案“令”的頒發(fā)背景分析,從改革開(kāi)放的宏觀大背景著手,以《檔案法》的發(fā)布為起點(diǎn),采用從宏觀到微觀的角度逐層分析。第二部分是對(duì)中國(guó)檔案“令”的內(nèi)容構(gòu)成分析,對(duì)26個(gè)檔案“令”主要從檔案法規(guī)及其實(shí)施、檔案管理、專業(yè)領(lǐng)域檔案這三個(gè)方面進(jìn)行分析。第三部分是對(duì)中國(guó)檔案“令”的特點(diǎn)分析,總結(jié)得出檔案“令”的制定,反映出國(guó)家政策的發(fā)展變化、關(guān)注著社會(huì)民生,數(shù)量上整體呈上升趨勢(shì),“令”的制定向?qū)I(yè)領(lǐng)域檔案管理傾斜。最后一部分是對(duì)中國(guó)檔案“令”的影響分析,這些“令”的實(shí)施促使國(guó)家檔案治理能力更加現(xiàn)代化、專業(yè)化;我國(guó)檔案法規(guī)體系得到了完善;檔案各方面的管理規(guī)范得到強(qiáng)化;專業(yè)領(lǐng)域檔案管理規(guī)范更加健全,全國(guó)檔案事業(yè)進(jìn)一步向法制化和科學(xué)化發(fā)展。對(duì)檔案“令”的研究和分析,有助于我們?nèi)姘盐諊?guó)家對(duì)檔案事業(yè)的指導(dǎo)方向,梳理檔案事業(yè)發(fā)展脈絡(luò),有針對(duì)性地指導(dǎo)檔案實(shí)踐。檔案“令”的頒布實(shí)施為未來(lái)檔案工作的發(fā)展、檔案管理的規(guī)范指明了道路。
[Abstract]:It is the tradition of the Party and the state to attach importance to the work of documents and archives.With the deepening development of reform and opening up, the archival work in our country has ushered in a new opportunity, and the promulgation and implementation of the Archives Law of the people's Republic of China (hereinafter referred to as the Archives Law) has opened the door of managing archives according to law.To make the archival work move towards the road of legalization."order" is a mandatory and symbolic document used by state administrative organs to issue administrative laws and regulations.The state and the archives administrative department can coordinate the archival work of the whole country by issuing the "order (order)" form, guide the archives work macroscopically, promote the deep development of the archives legal system construction in our country.The introduction of this paper first introduces the concept, evolution process, characteristics and types of "order (order)", and clarifies that the object and category of this study is the central file laws and regulations issued in the form of "order (order)" from 1987 to present.These include orders issued by 3 state presidents, 10 national archives offices independently and 13 national archives offices and professional departments.Because "order" is the most mandatory and authoritative text, this paper chooses it as the entry point.Secondly, combing the domestic research on Chinese archives "Ling", this paper provides guidance and reference.The first part of the text is the background analysis of the issuance of "order" of Chinese archives, starting from the macro background of reform and opening up, taking the publication of Archives Law as the starting point, using the angle of macro to micro level analysis.The second part is the analysis of the contents of the Chinese archives "order", and the analysis of 26 archives "orders" mainly from the three aspects of archives laws and regulations and their implementation, archives management, professional field archives.The third part is an analysis of the characteristics of the "order" of Chinese archives, and concludes that the formulation of the "order" of archives reflects the development and changes of national policies, pays close attention to the people's livelihood of the society, and shows an overall upward trend in quantity."order" of the professional field of professional orientation file management tilt.The last part is an analysis of the impact of the "order" on Chinese archives. The implementation of these "decrees" has led to the modernization and specialization of the national archives management capacity, the perfection of our country's archival legal system, the strengthening of the management norms of all aspects of archives.The professional field archives management standard is more perfect, the national archives enterprise further develops to the legal system and the scientific development.The research and analysis of the archival "order" is helpful for us to grasp the guiding direction of the national archival cause, to sort out the development of the archival cause, and to guide the archival practice in a targeted way.The promulgation and implementation of the order of Archives indicates the way for the future development of archival work and the standardization of archival management.
