【摘要】：文章對當(dāng)前國際公約和私法機制提出質(zhì)疑,剖析其在我國追索流失海外檔案過程中存在的諸多問題,力求對國際公約、私法機制和我國國內(nèi)法的修改、完善有所裨益。同時,探討了在新的國際、國內(nèi)形勢背景下,追索流失海外檔案文獻(xiàn)的多元化路徑選擇。
[Abstract]:This paper questions the current international conventions and private law mechanisms, analyzes the problems existing in the process of recovering and losing overseas archives in our country, and makes every effort to perfect and perfect the international conventions, the private law mechanisms and the domestic laws of our country. Under the background of the new international and domestic situation, this paper discusses the choice of multiple ways to seek the lost overseas archival documents.
