【摘要】：研究圖書(shū)館權(quán)利須從相關(guān)文件的文本出發(fā)。文本分析顯示:《圖書(shū)館權(quán)利法案》規(guī)定的是圖書(shū)館義務(wù)而非圖書(shū)館權(quán)利,圖書(shū)館權(quán)利性文件中也包含有大量的圖書(shū)館義務(wù)性規(guī)定。圖書(shū)館權(quán)利性文件之所以要規(guī)定義務(wù),是因?yàn)闄?quán)利性條款存在缺乏具體行為指引、有相互沖突情形、需要相對(duì)義務(wù)人履行義務(wù)等不足,需要義務(wù)性規(guī)定來(lái)彌補(bǔ)。圖書(shū)館義務(wù)有公法層面和私法層面兩種類(lèi)型,區(qū)分公法層面的圖書(shū)館義務(wù)和私法層面的圖書(shū)館義務(wù)對(duì)保護(hù)私權(quán)利、限制公權(quán)力、明確救濟(jì)方式、落實(shí)責(zé)任追究、促進(jìn)我國(guó)《公共圖書(shū)館法》的制定和實(shí)施等有重要的意義。
[Abstract]:The study of library rights should be based on the text of the relevant documents. Text analysis shows that the Library Bill of rights stipulates library obligations rather than library rights. Library rights documents also contain a large number of Library compulsory provisions. The reason why library rights documents need to stipulate obligations is that there are deficiencies in the rights provisions, such as lack of specific behavior guidance, conflicting situations, obligations of relative obligor, etc., which need to be compensated by compulsory provisions. Public law and private law library obligations level two types, the distinction between public and private law library level compulsory level library obligations on the protection of private rights and restricting public power, clear relief, the implementation of accountability, and promote China's "Public Library Law" the formulation and implementation has important significance.
