【摘要】：政治義務(wù)問題研究的是是否存在服從法律的道德理由,而一個(gè)令人接受的政治義務(wù)理論必須要滿足四個(gè)標(biāo)準(zhǔn):[1]義務(wù)主體的普遍性;[2]義務(wù)效力的有限性;[3]義務(wù)范圍的整全性;[4]義務(wù)的特殊性。本文先論證在以往的政治義務(wù)理論中,共同體式的理論不能滿足標(biāo)準(zhǔn)[1][2][3];同意理論不能滿足標(biāo)準(zhǔn)[1];經(jīng)典的功利主義不能滿足標(biāo)準(zhǔn)[1][2][3];自然責(zé)任理論不能滿足標(biāo)準(zhǔn)[1][4];經(jīng)典版本的公平游戲理論不能滿足標(biāo)準(zhǔn)[1][3]。它們的共同點(diǎn)就是都不能滿足標(biāo)準(zhǔn)[1]。在論證了以往的政治義務(wù)理論都是失敗的之后,筆者試圖繼續(xù)論證:1、(推定利益版本的)公平游戲理論是如何回應(yīng)對經(jīng)典公平游戲理論的同意反駁與限制性反駁以滿足標(biāo)準(zhǔn)[1]的;2、對公平游戲理論的新近反駁——證成性裂縫反駁何以是失敗的;3、樂善好施原則是如何證成公民有義務(wù)支持現(xiàn)代政府的福利職能而公平游戲理論無法解釋這一點(diǎn)的;4、聯(lián)合式政治義務(wù)理論是如何給我們更強(qiáng)的理由去支持樂善好施原則,并且很好地與公平游戲理論相容來滿足標(biāo)準(zhǔn)[4]的;5、以(推定利益版本的)公平游戲理論為核心的多重原則理論是如何結(jié)合樂善好施原則、聯(lián)合式政治義務(wù)理論以及共同善理論以滿足標(biāo)準(zhǔn)[3]的。6、筆者試圖提出一個(gè)"必要性檢驗(yàn)"來重新對標(biāo)準(zhǔn)[1][3]進(jìn)行理解。
[Abstract]:The question of political obligation is whether there is a moral reason to obey the law, and an acceptable theory of political obligation must meet four criteria:. [(1) the universality of the subject of obligation; [(2) the limitation of the validity of the obligation; [(3) the completeness of the scope of the obligation; [4] the particularity of obligation. This paper first proves that in the former theory of political obligation, the community theory can not meet the standard. [1]. [2]. [3]; the consent theory does not meet the criteria. [Classical utilitarianism does not meet the criteria. [1]. [2]. [3]; the theory of natural responsibility does not meet the criteria. [1]. [[4]; the classic version of fair play theory doesn't meet the standard. [1]. [3. What they all have in common is that they do not meet the criteria. [1]. After demonstrating that the previous theories of political obligation have all failed, the author tries to continue to demonstrate the theory of "1: 1". How does Fair Game Theory respond to agreed and restrictive rebuttal of Classical Fair Game Theory in order to meet the criteria. [1]; (2) the new refutation of fair game theory-why the refutation of proved crack is a failure; (3) how the principle of benevolence proves that citizens have the obligation to support the welfare function of modern government, which can not be explained by the theory of fair play; (4) how does the theory of joint political obligation give us a stronger reason to support the principle of charity, and is well compatible with the theory of fair play to meet the criteria? [4 / 5, how to combine the principle of charity, the theory of political obligation and the theory of common good to meet the standard, with fair game theory as the core.
