CEMAC法對海事承運(yùn)人海事義務(wù)的研究

  海上運(yùn)輸在當(dāng)今國際貿(mào)易中占有重要地位,海商法因此取得了很大發(fā)展。世界經(jīng)濟(jì)貿(mào)易的90%是通過海上運(yùn)輸進(jìn)行。海上貨物運(yùn)輸中海上承運(yùn)人義務(wù)的規(guī)則是一套規(guī)范海上貨物妥善運(yùn)輸?shù)囊?guī)則。這些義務(wù)大部分是由國際公約規(guī)定的,并已納入國家的法律規(guī)則。但是,各國都可以制定其立法。與非洲法語國家一樣,中非國家元首理事會的一項(xiàng)聯(lián)合決定也通過1994年12月22日第6/94-UDEAC-594-CE-30號法規(guī)而適用海事規(guī)則,其第406條對承運(yùn)人施加了《海牙規(guī)則》和《漢堡規(guī)則》的規(guī)定下的妥善運(yùn)輸?shù)牧x務(wù)。為此,立法者考慮了托運(yùn)人的利益,并通過2012年7月22日簽署的第08/12-UDEAC-088-CM-23號法規(guī)對舊法規(guī)進(jìn)行了修訂,在其第525條中規(guī)定了更多的承運(yùn)人義務(wù)。因此,作為使承運(yùn)人的權(quán)利減至最小的一種手段,應(yīng)將承運(yùn)人的義務(wù)作為重點(diǎn),即不僅應(yīng)在航程開始之前使船舶適航,而且應(yīng)在整個航行期間保持船舶適航。通過這種方式,可以防止反復(fù)出現(xiàn)的不安全狀況困擾海上運(yùn)輸行業(yè),并且可以避免由于船舶面對海上風(fēng)險(xiǎn)時不適航而在海上運(yùn)輸中發(fā)生越來越多的事故。不適航有時是船舶層面上的原因,可能因船齡導(dǎo)致運(yùn)輸?shù)陌踩燃壓艿?還有船員對...
