從對(duì)立到互動(dòng):西方自由主義語(yǔ)境中的“國(guó)家—社會(huì)”關(guān)系研究

【摘要】:自由民之所向,尤其是在市場(chǎng)經(jīng)濟(jì)飛速發(fā)展的今天。我國(guó)正處在改革的攻堅(jiān)期和發(fā)展的深水區(qū),市場(chǎng)經(jīng)濟(jì)“在資源配置中起決定作用”社會(huì)正在經(jīng)歷巨大變革,新的社會(huì)秩序應(yīng)然而生,國(guó)家的地位是否會(huì)被改寫(xiě)?社會(huì)的和諧發(fā)展取決于國(guó)家與社會(huì)兩個(gè)維度,取決于國(guó)家與社會(huì)關(guān)系的存在合理性以及合法性,取決于國(guó)家與社會(huì)各自的效能。自由主義見(jiàn)證著國(guó)家與社會(huì)發(fā)展的歷史變化,因此以自由主義為視角反觀國(guó)家與社會(huì)關(guān)系可以為現(xiàn)代化互動(dòng)式國(guó)家與社會(huì)關(guān)系提供基本歷史論證以及理論支撐。本文對(duì)在自由主義理論中國(guó)家與社會(huì)關(guān)系的發(fā)展變化進(jìn)行邏輯梳理。從古羅馬的私法對(duì)私人財(cái)產(chǎn)的承認(rèn)與保護(hù),泛希臘化時(shí)期伊壁鳩魯?shù)葘W(xué)派對(duì)個(gè)人心靈的關(guān)懷,到中世紀(jì)“兩把劍”理論和政教二元格局順延出古典自由主義時(shí)期國(guó)家與社會(huì)的二元分離,并通過(guò)人性論、自然法、社會(huì)契約論等邏輯前提分析古典自由主義時(shí)期二分的國(guó)家與社會(huì)關(guān)系以及其發(fā)展趨勢(shì)以及政治實(shí)踐;資本主義席卷全球市場(chǎng)經(jīng)濟(jì)飛速擴(kuò)張,古典自由主義走向落寞,新自由主義取得接力棒。資本主義市場(chǎng)代表私域與國(guó)家對(duì)立,為消極國(guó)家轉(zhuǎn)向積極國(guó)家奠定了社會(huì)基礎(chǔ);經(jīng)濟(jì)危機(jī)脅迫新自由主義返璞歸宗,理論回歸古典自由主義并超越了古典自由主義,市場(chǎng)存在不容置疑,但其被劃出社會(huì)領(lǐng)域,國(guó)家——市場(chǎng)——社會(huì)的三分格局逐步清晰。無(wú)論是二元分離還是三分格局自由主義始終是維護(hù)資本主義的利益的基礎(chǔ)上面對(duì)現(xiàn)實(shí)對(duì)自我的調(diào)適。本文通過(guò)對(duì)自由主義的語(yǔ)境下國(guó)家與社會(huì)所呈現(xiàn)出的關(guān)系分析其國(guó)家與社會(huì)關(guān)系從對(duì)立到互動(dòng)的演化軌跡和從“二分”到“三分”的歷史演進(jìn)和邏輯推論,試圖以自由主義為理論視角梳理國(guó)家與社會(huì)關(guān)系變化的發(fā)展脈絡(luò)及其發(fā)展邏輯,并最終面對(duì)時(shí)代發(fā)展的新形勢(shì),探尋理性的國(guó)家與社會(huì)互動(dòng)關(guān)系,考量傳統(tǒng)的國(guó)家和社會(huì)關(guān)系的現(xiàn)代轉(zhuǎn)型,探尋符合社會(huì)現(xiàn)代化要求的新型的國(guó)家和社會(huì)關(guān)系結(jié)構(gòu)。
[Abstract]:The direction of the free people, especially in the rapid development of the market economy today. Our country is in the period of reform and the deep water area of development. The market economy "plays a decisive role in the allocation of resources" society is undergoing great changes, a new social order should be born, will the status of the country be rewritten? The harmonious development of society depends on the two dimensions of state and society, on the rationality and legitimacy of the existence and legitimacy of state and social relations, and on the effectiveness of the state and society. Liberalism bears witness to the historical changes in the development of state and society. Therefore, from the perspective of liberalism, the relationship between state and society can provide basic historical argumentation and theoretical support for modern interactive state and social relations. This paper logically combs the development and change of state and social relations in liberalism theory. From the recognition and protection of private property in ancient Roman private law, the concern of Epicurus and other schools of thought for the individual during the pan-Greek period. By the Middle Ages, the theory of "two swords" and the dualistic pattern of politics and religion extended the binary separation of state and society in the period of classical liberalism, and adopted the theory of human nature and natural law. The logical premise, such as social contract theory, analyzes the dichotomous state and social relations in the period of classical liberalism, as well as its development trend and political practice. Capitalism swept through the rapid expansion of the global market economy, classical liberalism towards desolation, neoliberalism achieved baton. The capitalist market represents the opposition between the private domain and the state, which lays the social foundation for the negative country to turn to the positive state. The economic crisis coerces neoliberalism to return to nature, the theory returns to classical liberalism and surpasses classical liberalism, the existence of the market is indisputable, but it is classified as the social field, and the three-part pattern of the state, the market and the society is gradually clear. Whether it is dual separation or triplet liberalism, it is always the adjustment of self to reality on the basis of safeguarding the interests of capitalism. Based on the analysis of the relationship between the state and the society in the context of liberalism, this paper analyzes the evolution track of the social relations between the state and the society from opposition to interaction, and the historical evolution and logical inference from the "dichotomous" to the "three points". This paper attempts to sort out the development and logic of the change of state and social relations from the perspective of liberalism, and finally to explore the rational interaction between state and society in the face of the new situation of the development of the times. Considering the modern transformation of traditional state and social relations, this paper explores a new structure of state and social relations that meets the requirements of social modernization.
