網(wǎng)絡(luò)信息治理的行政軟法研究

【摘要】:時(shí)值全球新行政法時(shí)代與互聯(lián)網(wǎng)時(shí)代的交匯碰撞之機(jī),行政法理論與公共治理理論的互動(dòng)更為頻繁密切。具體在網(wǎng)絡(luò)信息治理實(shí)踐中,如何提高政府治理能力需要結(jié)合包括行政法學(xué)在內(nèi)的多學(xué)科理論進(jìn)行反思與重構(gòu)。行政軟法作為新行政法的重要內(nèi)容與表象特征之一,為網(wǎng)絡(luò)信息治理這一新興治理領(lǐng)域提供了理論借鑒。但網(wǎng)絡(luò)信息治理為何可以借助行政軟法,行政軟法介入的正當(dāng)性基礎(chǔ)何在,行政軟法與硬法的適用邊界如何劃定,這些都是需要討論的理論前提。而作為互聯(lián)網(wǎng)技術(shù)發(fā)源地的域外國(guó)家在治理中的經(jīng)驗(yàn),則為我國(guó)網(wǎng)絡(luò)信息的行政軟法治理提供了有益的啟示和借鑒。全文共計(jì)三萬(wàn)四千余字,分為五個(gè)部分。第一部分“緒論”。闡述了研究背景、研究意義、國(guó)內(nèi)外研究現(xiàn)狀、研究方法以及研究的創(chuàng)新和不足。第二部分“網(wǎng)絡(luò)信息治理與行政軟法的相關(guān)理論分析”。在論述網(wǎng)絡(luò)信息的內(nèi)涵與治理范圍和行政軟法的概念、特征基礎(chǔ)上,分析了行政軟法介入網(wǎng)絡(luò)信息治理的必要性,對(duì)硬法與軟法的作用發(fā)揮邊界進(jìn)行了界定,并將傳統(tǒng)硬法與行政軟法的關(guān)系塑造為“中心——外圍”構(gòu)造。第三部分“我國(guó)網(wǎng)絡(luò)信息行政軟法治理的現(xiàn)狀及問(wèn)題”。分析了我國(guó)網(wǎng)絡(luò)信息治理的現(xiàn)狀及存在的問(wèn)題,論述了行政軟法治理網(wǎng)絡(luò)信息的現(xiàn)實(shí)可行性。第四部分“完善我國(guó)網(wǎng)絡(luò)信息行政軟法治理的域外借鑒與建議”。吸取域外國(guó)家治理網(wǎng)絡(luò)信息的實(shí)踐經(jīng)驗(yàn),對(duì)我國(guó)運(yùn)用行政軟法治理網(wǎng)絡(luò)信息進(jìn)行反思,主張:若要實(shí)現(xiàn)行政軟法在網(wǎng)絡(luò)信息治理領(lǐng)域的積極價(jià)值,須遵循硬法與軟法的“中心——外圍”之構(gòu)造范式,完善傳統(tǒng)硬法的框架體系,以為行政軟法的作用發(fā)揮提供依據(jù),在此基礎(chǔ)上積極完善和運(yùn)用行政軟法規(guī)范和軟法實(shí)施機(jī)制,并配套以及時(shí)的救濟(jì)機(jī)制。第五部分“結(jié)語(yǔ)”。網(wǎng)絡(luò)信息的軟法治理要以遵循硬法約束為原則,要保證軟法的明確性和可預(yù)測(cè)性,并注意把握軟法的適用邊界。
[Abstract]:At the moment of the collision between the new administrative law era and the Internet era, the interaction between the theory of administrative law and the theory of public governance is more frequent and close. In the practice of network information governance, how to improve the ability of government governance needs to be reconsidered and reconstructed in combination with the multi-disciplinary theory, including administrative law. As one of the important contents and appearance features of the new administrative law, the administrative soft law provides a theoretical reference for the emerging governance field of network information governance. But why the network information governance can rely on the administrative soft law, what is the justification foundation of the administrative soft law intervention, and how to delimit the applicable boundary between the administrative soft law and the hard law, all these are the theoretical premise that needs to be discussed. As the birthplace of Internet technology, the experience of foreign countries in governance provides beneficial enlightenment and reference for the administrative soft law governance of network information in our country. The full text is more than 34,000 words, divided into five parts. The first part "introduction". The research background, significance, domestic and foreign research status, research methods, innovation and deficiency of research are described. The second part "the network information governance and the administrative soft law correlation theory analysis". On the basis of discussing the connotation and governance scope of network information and the concept and characteristics of administrative soft law, this paper analyzes on the necessity of the involvement of administrative soft law in network information governance, and defines the boundary between hard law and soft law in bringing into play the role of hard law and soft law. And the relationship between the traditional hard law and the administrative soft law is shaped as the structure of "center-periphery". The third part "our country network information administration soft law governs the present situation and the question". This paper analyzes on the present situation and existing problems of network information governance in China, and discusses the practical feasibility of administrative soft law management of network information. The fourth part "consummates our country network information administration soft law governance outside the domain to use for reference and the suggestion". Drawing on the practical experience of extraterritorial national governance network information, this paper reconsiders the application of administrative soft law to network information governance in China, and advocates that: if we want to realize the positive value of administrative soft law in the field of network information governance, We must follow the structural paradigm of "center-periphery" of hard law and soft law, perfect the frame system of traditional hard law, provide the basis for the function of administrative soft law, and on this basis actively perfect and apply the norms of administrative soft law and the enforcement mechanism of soft law. And matching as well as the relief mechanism at the time. The fifth part is the conclusion. The soft law management of network information should be based on the principle of following the hard law constraint, the clarity and predictability of the soft law should be guaranteed, and the applicable boundary of the soft law should be grasped.
