論地方立法公眾參與

【摘要】：新中國成立后經(jīng)過幾十年的發(fā)展建立了一套完整的中國特色社會主義體制,而中國法治層面的發(fā)展也經(jīng)歷了多個階段,才有了如今的中國特色社會主義法治社會的局面�！读⒎ǚā返纫幌盗蟹�、法規(guī)的頒布,為整個立法體系提供了有效的法律支撐,公共參與立法也在地方立法中得到了大力推廣。各地方政府根據(jù)各地的具體形式和我國社會的發(fā)展趨勢,逐步總結(jié)出符合地方特色和實際需要的制度和經(jīng)驗。隨著《立法法》的修改,地方立法權(quán)主體的擴(kuò)大,以及之前存在于地方立法中還未解決的問題,使得今后地方立法工作的開展也存在一定難度。文章首先介紹了選題的背景以及地方立法公眾參與的國內(nèi)外研究現(xiàn)狀。其次,對地方立法、公眾參與的概念作出了解釋,并在此基礎(chǔ)上闡述了地方立法公眾參與的基本理論、基本價值和基本要求。理論基礎(chǔ)包括了人民主權(quán)理論、參與民主理論、協(xié)商民主理論,基本價值包括了增強(qiáng)地方立法的科學(xué)性和民主性、加強(qiáng)對地方立法的監(jiān)督、提高公民的參與意識和法律素養(yǎng)三方面,基本要求為科學(xué)立法、民主立法。再次,主要是對我國地方立法公眾參與的現(xiàn)狀做一個分析,將我國地方立法公眾參與分為起步階段、發(fā)展階段、全面提高階段,從政治民主制度、經(jīng)濟(jì)發(fā)展條件、傳統(tǒng)文化三個方面闡述了影響地方立法公眾參與的原因。之后,從參與主體、平臺建設(shè)、制度建設(shè)三個方面提出了地方立法公眾參與過程中存在的問題。最后,對完善地方立法公眾參與做一個思考,通過擴(kuò)大地方立法參與主體的范圍、完善地方立法公眾參與的平臺、完善地方立法公眾參與的制度為地方立法公眾參與提供有效的保障。立法體系的建立不是一蹴而就的事情,而是一個長期、持續(xù)、漸進(jìn)的過程,它需要我們不斷思考,不斷創(chuàng)新。
[Abstract]:After decades of development, after the founding of New China, a set of complete socialist systems with Chinese characteristics were established, and the development of China's level of rule of law also went through many stages. Only now has the situation of a socialist society ruled by law with Chinese characteristics. The promulgation of a series of laws and regulations, such as the Legislative Law, has provided effective legal support for the entire legislative system. Public participation legislation has also been vigorously promoted in local legislation. According to the specific forms of local governments and the development trend of our society, the local governments gradually sum up the systems and experiences that meet the local characteristics and actual needs. With the revision of the Legislative Law, the expansion of the main body of the local legislative power and the problems that have not been solved in the local legislation before, it is difficult to carry out the local legislative work in the future. The paper first introduces the background of the topic and the status quo of the local legislative public participation at home and abroad. Secondly, it explains the concept of local legislation and public participation, and on this basis expounds the basic theory, basic value and basic requirements of public participation in local legislation. The theoretical basis includes the theory of people's sovereignty, the theory of participation in democracy, and the theory of deliberative democracy. The basic values include enhancing the scientific and democratic nature of local legislation and strengthening the supervision of local legislation. To improve citizens' participation consciousness and legal literacy, the basic requirements are scientific legislation and democratic legislation. Thirdly, it mainly analyzes the current situation of public participation in local legislation in our country, and divides the public participation in local legislation into the initial stage, the stage of development, the stage of overall improvement, and the conditions of political democracy and economic development from the point of view of the political democracy system and the conditions for economic development. Three aspects of traditional culture explain the reasons that affect the public participation in local legislation. After that, the problems existing in the process of public participation in local legislation are put forward from three aspects: participation subject, platform construction and system construction. Finally, to perfect the local legislative public participation to do a thinking, by expanding the scope of local legislative participation in the main body, improve the local legislative public participation platform, Perfecting the system of public participation in local legislation provides an effective guarantee for public participation in local legislation. The establishment of the legislative system is not a matter of one action, but a long, continuous and gradual process, which requires us to constantly think and innovate.
