我國網(wǎng)約車準(zhǔn)入規(guī)范研究

【摘要】:作為互聯(lián)網(wǎng)經(jīng)濟(jì)下的新興行業(yè),網(wǎng)絡(luò)預(yù)約出租汽車(以下簡稱“網(wǎng)約車”)自興起以來一直飽受爭議。2016年7月,國務(wù)院七部委聯(lián)合出臺《網(wǎng)絡(luò)預(yù)約出租汽車經(jīng)營服務(wù)管理暫行辦法》,網(wǎng)約車合法化的時(shí)代到來。合法性問題解決之后,當(dāng)前網(wǎng)約車準(zhǔn)入規(guī)范值得關(guān)注。我國網(wǎng)約車準(zhǔn)入這一行政行為在性質(zhì)上屬于行政許可。從行政許可法的視角考察,國務(wù)院部委以部門規(guī)章設(shè)定行政許可不合法;要求駕駛員、車輛和平臺均須取得許可證的規(guī)定,基本沿用傳統(tǒng)出租車的準(zhǔn)入制度,許可范圍過大。對于地方出臺的網(wǎng)約車準(zhǔn)入規(guī)范,存在地方政府規(guī)章增設(shè)行政許可條件、許可條件過于嚴(yán)苛、關(guān)于戶籍車型的不當(dāng)限制違反比例原則等問題;谀壳熬W(wǎng)約車準(zhǔn)入規(guī)范的問題,對網(wǎng)約車準(zhǔn)入設(shè)立行政許可,應(yīng)首先完善法律位階,制定地方政府規(guī)章上位法,交由國務(wù)院制定行政法規(guī)作為法律依據(jù),當(dāng)前可由國務(wù)院采用發(fā)布決定的方式進(jìn)行規(guī)范。在具體準(zhǔn)入方式上,設(shè)計(jì)“政府管平臺,平臺管人和車”的模式,保留對網(wǎng)約車平臺的許可,取消對網(wǎng)約車輛和駕駛員的行政許可。在準(zhǔn)入條件上,降低準(zhǔn)入門檻,激發(fā)網(wǎng)約車市場活力。
[Abstract]:As a burgeoning industry in the Internet economy, online taxi booking has been controversial since its rise. In July 2016, Seven ministries and commissions of the State Council jointly issued the interim measures for the Management of Network booking Taxi Business Service, the era of legalization of network ride-hailing came. After the legality problem is solved, the current network ride-hailing admittance standard is worth paying attention to. In our country, the administrative behavior of entering into the net car is administrative license in nature. From the perspective of the administrative license law, the ministries and commissions of the State Council set the illegal administrative license by departmental regulations; required drivers, vehicles and platforms to obtain permits, and basically followed the traditional taxi access system, and the scope of permission was too large. There are some problems such as adding administrative license conditions to local government rules and regulations, too strict licensing conditions, improper restrictions on household registration models and so on. In view of the problem of the current regulations for the access to the net car, the establishment of the administrative license for the access to the net charter car should first perfect the legal rank, formulate the upper law of the local government regulations, and hand it over to the State Council to formulate the administrative regulations as the legal basis. At present, the State Council may adopt the method of issuing decisions to regulate. In the specific access mode, the "government management platform, platform management and vehicle" mode is designed to retain the license to the net-chartering platform and cancel the administrative license for the net-contracted vehicle and driver. In the access conditions, reduce the entry threshold, stimulate the market vitality.
