【摘要】：行政權(quán)力清單制度作為推動我國法治政府建設的重要內(nèi)容,對依法公開權(quán)力運行流程,加強權(quán)力運行體系建設有著重要的推動作用。但是在權(quán)力清單制度的建立和運行的過程當中,我們發(fā)現(xiàn),因為固有行政體系的僵化和行政人員的依法行政意識的相對淡薄,政府行政權(quán)力清單制度的運行還是不可避免地出現(xiàn)了許多問題。本文就是建立在這樣的基礎上,從政府行政權(quán)力清單制度的基礎理論出發(fā),通過對當下中國政府行政權(quán)力清單制度運行中的上述問題進行分析,并針對這些問題提出相關的對策和解決建議,以期對我國的政府行政權(quán)力清單制度的落實和完善有所裨益。本文通過理清權(quán)力清單制度的概念和特點明確本文所研究權(quán)力清單的范圍;通過對行政權(quán)力清單設立的法理、憲法依據(jù)進行論述,指出權(quán)力清單制度對于當下法治政府的建設具有推動作用,旨在說明行政權(quán)力清單并非“惡法”,擁有扎實的正當性理論基礎,為后文權(quán)力清單制度運行中問題的解決提供正當性前提。然而,由于權(quán)力清單是新興事物,清單許多問題起源于理論并且已在現(xiàn)實中有所暴露,具體而言,包括清單本身定位模糊、各清單適用范圍混亂、清單運行過程中缺乏釋明機制、統(tǒng)籌機制四個方面。接著,本文的核心就在于對行政權(quán)力清單制度運行中的問題進行逐一解決,主要措施及建議包括:規(guī)范行政權(quán)力清單的制定依據(jù);明晰行政權(quán)力清單的制定程序;健全行政權(quán)力清單的配套制度等。
[Abstract]:As an important part of promoting the construction of our country's government ruled by law, the system of administrative power list plays an important role in publicizing the process of power operation according to law and strengthening the construction of power operation system. However, in the process of establishing and running the power list system, we found that because of the rigidity of the inherent administrative system and the relatively weak sense of administration by law among administrative personnel, Many problems inevitably arise in the operation of the government administrative power list system. This paper is based on such a foundation, from the basic theory of the government administrative power list system, through the analysis of the above problems in the current operation of the Chinese government administrative power list system. Some countermeasures and suggestions are put forward to solve these problems in order to benefit the implementation and perfection of our government's administrative power list system. By clarifying the concept and characteristics of the list of powers system, this paper clarifies the scope of the list of powers studied in this paper, and discusses the constitutional basis of the establishment of the list of administrative powers. It is pointed out that the power list system has a positive effect on the construction of the current government under the rule of law. It aims to show that the list of administrative powers is not a "draconian law" and has a solid theoretical foundation of legitimacy. It provides the legitimate premise for the later power list system to solve the problems in the operation. However, because lists of powers are new, many of the problems of lists originate in theory and have been exposed in reality, specifically, the list itself is ill-positioned, the scope of application of each list is chaotic, In the process of inventory operation, there are four aspects: lack of explanation mechanism and coordination mechanism. Then, the core of this paper is to solve the problems one by one in the operation of the administrative power list system. The main measures and suggestions include: standardizing the basis of making the list of administrative powers; clarifying the procedure of making the list of administrative powers; Perfect the supporting system of administrative power list, etc.
