【摘要】：一直以來,刑事領(lǐng)域的刑事被告人權(quán)利保護(hù)都是我國開展刑事立法實(shí)踐的重要內(nèi)容。2012年《刑事訴訟法》的修改完善,更是標(biāo)志著我國對(duì)于刑事被告人權(quán)利的保護(hù)達(dá)到了一個(gè)新的高度。但長期以來,受傳統(tǒng)司法理念、思想觀念、經(jīng)濟(jì)文化差異等諸多因素影響,作為“弱勢(shì)群體”的刑事被害人卻被遺忘在了刑事司法的角落,他們的合法權(quán)益經(jīng)常得不到有效保障,這不僅是我國刑事司法體系的缺陷,同時(shí)也是世界各國法治發(fā)展的共性問題。我國的刑事被害人救助制度是伴隨著我國司法救助制度的出現(xiàn)而發(fā)展起來的。我國的司法救助制度經(jīng)歷了內(nèi)涵單一的訴訟費(fèi)用減免制度,到訴訟費(fèi)用減免制度與刑事被害人救助制度共同發(fā)展,再到更加側(cè)重救助制度完善的轉(zhuǎn)變。本文主要是以我國現(xiàn)行刑事被害人救助制度為視角,通過分析研究我國司法救助的歷史變革和價(jià)值屬性,從總體上把握我國刑事被害人救助制度的性質(zhì)。立足我國司法救助制度改革的現(xiàn)實(shí)需要,分析以《關(guān)于建立完善司法救助制度的意見(試行)》為藍(lán)本的刑事被人救助制度,查找當(dāng)前我國刑事被害人救助制度存在的癥結(jié)和問題,并通過比較部分先進(jìn)國家和地區(qū)的刑事被害人救助制度,對(duì)如何完善我國現(xiàn)有的刑事被害人救助制度,特別是對(duì)構(gòu)建具有中國特色的刑事被害人救助制度提出建議。
[Abstract]:All along, the protection of the rights of the criminal defendants in the criminal field is an important part of the criminal legislation practice in China. The revision and perfection of the Criminal procedure Law in 2012, It also indicates that the protection of the rights of the criminal defendants has reached a new height in our country. But for a long time, affected by the traditional judicial ideas, economic and cultural differences and other factors, as a "vulnerable group", the criminal victims have been forgotten in the corner of criminal justice. Their legal rights and interests often can not be effectively protected, which is not only a defect of our criminal justice system, but also a common problem in the development of the rule of law in the world. The system of criminal victim assistance develops with the appearance of judicial aid system in our country. Our judicial aid system has experienced a single connotation of the system of relief and relief of litigation costs to the system of relief and relief of criminal victims to the development of the system and then to more emphasis on the improvement of the relief system. This article is mainly based on the current criminal victim relief system as a visual angle, through the analysis of the historical changes and value attributes of judicial assistance in China, from the overall grasp of the nature of our criminal victim relief system. Based on the practical needs of the reform of the judicial aid system in China, this paper analyzes the criminal relief system based on "opinions on establishing and perfecting the Judicial Aid system (trial)". To find out the sticking points and problems existing in the current criminal victim relief system in China, and by comparing the criminal victim relief systems in some advanced countries and regions, how to improve the existing criminal victim rescue system in our country, In particular, some suggestions are put forward to construct the system of criminal victim relief with Chinese characteristics.
