【摘要】：近年來,在城市化進(jìn)程推進(jìn)中,涌進(jìn)大量外來務(wù)工人員,他們?cè)诔鞘薪ㄔO(shè)中發(fā)揮了重要作用,但是大量侵犯農(nóng)民工合法權(quán)益的情況也隨之出現(xiàn)。法律援助作為保障公民基本權(quán)利的一項(xiàng)重要制度,有效地維護(hù)了農(nóng)民工的合法權(quán)益。鄭州市金水區(qū)作為河南省會(huì)鄭州市的中心城區(qū),擁有得天獨(dú)厚的區(qū)位優(yōu)勢和較為優(yōu)質(zhì)的資源稟賦,吸引了大批外來務(wù)工人員來金水區(qū)就業(yè),然而他們?cè)跒榻ㄔO(shè)首善之區(qū)服務(wù)的同時(shí),遇到的侵權(quán)糾紛越來越多,金水區(qū)農(nóng)民工法律援助案件數(shù)占整個(gè)法律援助案件總數(shù)的50%左右,因此有必要研究金水區(qū)的農(nóng)民工法律援助。在廣泛搜集國內(nèi)外現(xiàn)有研究成果的基礎(chǔ)上,依據(jù)維護(hù)平等、人權(quán)保障、權(quán)利救濟(jì)的理論基礎(chǔ),通過調(diào)查問卷和實(shí)證研究進(jìn)行數(shù)據(jù)分析,得出基于需求層面、供給層面、現(xiàn)實(shí)層面法律援助現(xiàn)狀的第一手資料,客觀分析農(nóng)民工在勞動(dòng)違法現(xiàn)象嚴(yán)重、維權(quán)成本高、保障機(jī)制不完善、渠道不暢通等方面的原因,并對(duì)影響農(nóng)民工法律援助的原因進(jìn)行分析研究。法律援助制度在我國經(jīng)歷了13年的發(fā)展,取得了長足的進(jìn)步,發(fā)揮了較大的作用,但是仍然存在著許多不足和缺陷,表現(xiàn)在立法上和實(shí)踐中,法律法規(guī)沒有專門規(guī)定,實(shí)踐中人員和經(jīng)費(fèi)保障不到位等等。這些問題尤其在農(nóng)民工法律援助方面表現(xiàn)更為明顯。一方面,農(nóng)民工法律援助存在維權(quán)難的問題,勞動(dòng)合同簽訂率低、維權(quán)渠道不暢通、維權(quán)成本高等。另一方面,農(nóng)民工維權(quán)組織欠缺。針對(duì)影響農(nóng)民工法律援助的主要原因及存在的問題,進(jìn)一步理清農(nóng)民工維權(quán)的框架,提出切實(shí)可行的解決對(duì)策。首先從建立農(nóng)民工維權(quán)組織入手,拓寬農(nóng)民工利益表達(dá)渠道;其次,從維權(quán)程序上,改革先裁后審的勞動(dòng)爭議處理機(jī)制,設(shè)立專門的農(nóng)民工勞動(dòng)法庭審判委員會(huì);第三,從解決途徑上,三種路徑選擇權(quán):人民調(diào)解、法院訴訟、勞動(dòng)仲裁;第四,從保障機(jī)制上,健全隊(duì)伍,保證經(jīng)費(fèi),加強(qiáng)宣傳,簡化程序,建立異地、區(qū)域合作機(jī)制。筆者從農(nóng)民工的調(diào)查現(xiàn)狀出發(fā),以實(shí)證數(shù)據(jù)為基礎(chǔ),掌握第一手資料,從而發(fā)現(xiàn)農(nóng)民工法律援助在實(shí)踐領(lǐng)域存在的問題,找出解決的對(duì)策。同時(shí),本文研究的主體是農(nóng)民工,研究的內(nèi)容是與法律法規(guī)相關(guān)的課題,具有跨學(xué)科的性質(zhì)。
[Abstract]:In recent years, in the process of urbanization, a large number of migrant workers, they have played an important role in urban construction, but a large number of violations of the legitimate rights and interests of migrant workers also appeared. As an important system to protect citizens' basic rights, legal aid effectively protects the legitimate rights and interests of migrant workers. The Jinshui District of Zhengzhou, as the central city of Zhengzhou, the capital of Henan Province, has unique geographical advantages and relatively high quality resource endowments, which has attracted a large number of migrant workers to work in Jinshui District. However, while they are serving for the construction of the first good area, they encounter more and more infringement disputes. The number of legal aid cases for migrant workers in Jinshui District accounts for about 50% of the total number of legal aid cases. Therefore, it is necessary to study the legal aid of migrant workers in Jinshui District. On the basis of extensive collection of existing research results at home and abroad, according to the theoretical basis of safeguarding equality, human rights protection, right relief, and through questionnaire and empirical research, we can conclude that it is based on demand level, supply level, and so on. First hand information on the current situation of legal aid at the realistic level, and objective analysis of the reasons for the serious phenomenon of illegal labor, the high cost of safeguarding their rights, the imperfect security mechanism, the lack of smooth channels, and so on. And to influence the reason of peasant worker legal aid carries on the analysis research. After 13 years of development, the legal aid system has made great progress and played a great role in our country. However, there are still many deficiencies and defects in the legislation and practice, and there are no special provisions in the laws and regulations. In practice, personnel and financial support is not in place and so on. These problems especially in the migrant workers legal aid performance is more obvious. On the one hand, the legal aid of migrant workers is difficult to protect their rights, the labor contract signing rate is low, the channel of protecting rights is not smooth, and the cost of protecting rights is high. On the other hand, migrant workers rights organizations lack. In view of the main reasons and existing problems affecting the legal aid of migrant workers, this paper further clarifies the framework of the rights of migrant workers and puts forward practical countermeasures. First of all, starting with the establishment of migrant workers' rights organizations to broaden the channels of expression of migrant workers' interests; secondly, from the rights protection procedures, reform the labor dispute handling mechanism before adjudication, and set up a special trial committee of migrant workers' labor court; third, From the solution way, three path options: people mediation, court litigation, labor arbitration; fourth, from the security mechanism, improve the team, guarantee funds, strengthen publicity, simplify procedures, establish a regional cooperation mechanism. On the basis of empirical data, the author finds out the problems existing in the field of legal aid of migrant workers and finds out the countermeasures to solve them. At the same time, the main body of this study is migrant workers, the content of the study is related to laws and regulations, with interdisciplinary nature.
