論不當(dāng)個(gè)人網(wǎng)絡(luò)求助行為及其法律規(guī)制

【摘要】:本研究以不當(dāng)個(gè)人網(wǎng)絡(luò)求助行為為研究對(duì)象,結(jié)合網(wǎng)絡(luò)社會(huì)的大背景和剛剛發(fā)生的典型案例,分析不當(dāng)個(gè)人網(wǎng)絡(luò)求助行為的實(shí)際表現(xiàn)和社會(huì)危害,在此基礎(chǔ)上,進(jìn)一步探究不當(dāng)個(gè)人網(wǎng)絡(luò)求助行為產(chǎn)生的法律和社會(huì)根源,提出減少和遏制不當(dāng)個(gè)人網(wǎng)絡(luò)求助行為的法律規(guī)制措施,從而促進(jìn)個(gè)人網(wǎng)絡(luò)求助的健康發(fā)展。不當(dāng)個(gè)人網(wǎng)絡(luò)求助行為是個(gè)人網(wǎng)絡(luò)求助行為的一種特殊表現(xiàn)。它是指?jìng)(gè)人在網(wǎng)絡(luò)平臺(tái)向大眾發(fā)布求助信息、尋求社會(huì)和他人幫助的過程中存在不正當(dāng)、不適當(dāng)?shù)男袨椤2徽?dāng)、不適當(dāng)性主要表現(xiàn)在,在求助過程中存在弄虛作假、涉嫌欺騙的行為,或者夸大、隱瞞有關(guān)信息,或者發(fā)布不實(shí)信息,博取人們同情、騙取他人善心,或者偽造、篡改善款善物使用明細(xì),意圖私吞物資,據(jù)為己有。不當(dāng)個(gè)人網(wǎng)絡(luò)求助行為侵害了捐助者和其他求助者權(quán)益,侵蝕了公眾的信任和愛心,破壞了慈善捐贈(zèng)秩序。通過分析典型案例,并結(jié)合相關(guān)法律規(guī)定,不當(dāng)個(gè)人網(wǎng)絡(luò)求助行為的產(chǎn)生原因在于:主體資格缺乏明確的審查標(biāo)準(zhǔn);可信度考量機(jī)制缺位;個(gè)人隱私缺乏保護(hù);網(wǎng)絡(luò)求助信息平臺(tái)缺乏監(jiān)管;善款使用明細(xì)及余額歸屬不清。治理不當(dāng)個(gè)人網(wǎng)絡(luò)求助行為,維護(hù)正當(dāng)個(gè)人網(wǎng)絡(luò)求助行為,促進(jìn)個(gè)人網(wǎng)絡(luò)求助健康發(fā)展,需要從以下幾方面入手:第一,加快立法進(jìn)程,完善個(gè)人網(wǎng)絡(luò)求助行為相關(guān)立法。包括對(duì)“個(gè)人網(wǎng)絡(luò)求助行為”和“個(gè)人公開募捐行為”等法律概念進(jìn)行清晰的界定和區(qū)分;明確參與者的權(quán)利義務(wù);規(guī)范追責(zé)機(jī)制。第二,建立完善的網(wǎng)絡(luò)求助監(jiān)管體系,建立事前、事中和事后的一體化監(jiān)管體系,構(gòu)建網(wǎng)絡(luò)平臺(tái)、專業(yè)機(jī)構(gòu)和媒體大眾協(xié)作的全方位監(jiān)管模式。第三,搭建規(guī)范的網(wǎng)絡(luò)求助信息平臺(tái)。最后,構(gòu)建嚴(yán)格的個(gè)人信用評(píng)價(jià)機(jī)制,建立公民信用等級(jí)數(shù)據(jù)庫(kù),制定完善的“失信懲戒機(jī)制”。
[Abstract]:Based on the background of the network society and the typical cases that have just occurred, this study analyzes the actual performance and social harm of improper personal network help-seeking behavior. In order to promote the healthy development of personal network help, the author further probes into the legal and social root of improper personal network help-seeking behavior, and puts forward the legal regulation measures to reduce and curb the improper individual network help-seeking behavior. Improper personal network help-seeking behavior is a special manifestation of personal network help-seeking behavior. It refers to the improper and inappropriate behavior of individuals in the process of issuing information for help to the public on the network platform and seeking help from society and others. Inappropriateness is mainly manifested in the existence of fraud, suspected deception, or exaggeration, concealment of relevant information, or publication of false information, obtaining sympathy from people, deceiving others' kindness, or forgery in the process of seeking help. Tamper with the details of the use of good money, with the intention of misappropriation of materials, for their own possession. Improper personal network help-seeking infringes the rights of donors and other suitors, erodes public trust and love, and undermines the order of charitable donations. By analyzing typical cases and combining with relevant laws and regulations, the causes of improper personal network seeking help behavior are: lack of clear examination standard of subject qualification, absence of credibility evaluation mechanism, lack of protection of personal privacy; Network help information platform lack of supervision; the use of charitable details and the balance is unclear. In order to manage improper personal network help-seeking behavior, maintain proper personal network help-seeking behavior, and promote the healthy development of personal network help-seeking, we should start from the following aspects: first, speed up the legislative process and perfect the relevant legislation of personal network help-seeking behavior. It includes clearly defining and distinguishing the legal concepts of "personal network seeking help" and "individual public solicitation"; clarifying the rights and obligations of participants; and standardizing the mechanism of accountability. Second, we should establish a perfect supervision system of network help, establish an integrated supervision system in advance, during and after the event, build a network platform, professional organizations and the media cooperation of the omni-directional regulatory model. Third, build a standardized network help information platform. Finally, we should build a strict personal credit evaluation mechanism, establish a civil credit rating database, and establish a perfect punishment mechanism for breach of trust.
