【摘要】：解決農(nóng)業(yè)保險財政補(bǔ)貼中存在的法律問題,對于完善農(nóng)業(yè)保險法律制度,促進(jìn)公共財政支出法治化,以及解決“三農(nóng)”問題、促進(jìn)農(nóng)業(yè)大發(fā)展都有十分重要的意義。本文運(yùn)用規(guī)范分析、實證分析和比較分析的方法對我國農(nóng)業(yè)保險財政補(bǔ)貼中出現(xiàn)的法律問題進(jìn)行分析,并提出解決問題的建議,以求為解決農(nóng)業(yè)保險財政補(bǔ)貼法律問題提供理論依據(jù),同時解決實踐中出現(xiàn)的突出問題,促進(jìn)農(nóng)業(yè)保險財政補(bǔ)貼制度的完善與發(fā)展。除引言外,本文共有五部分內(nèi)容。一、通過對農(nóng)業(yè)保險的概念、作用以及準(zhǔn)公共物品的屬性的分析,得出農(nóng)業(yè)保險的發(fā)展離不開財政補(bǔ)貼支持的觀點。二、界定農(nóng)業(yè)保險財政補(bǔ)貼的概念并從農(nóng)業(yè)風(fēng)險保障權(quán)、國家行使宏觀調(diào)控權(quán)、規(guī)范財政補(bǔ)貼行為的需要以及公共財政支出法治化四個經(jīng)濟(jì)法學(xué)理論出發(fā),論證了農(nóng)業(yè)保險財政補(bǔ)貼的必要性以及對其進(jìn)行法律規(guī)制的理論依據(jù)。三、梳理農(nóng)業(yè)保險以及農(nóng)業(yè)保險財政補(bǔ)貼在我國的發(fā)展現(xiàn)狀,總結(jié)其發(fā)展過程中存在的主要法律問題。在現(xiàn)有立法中,與農(nóng)業(yè)保險財政補(bǔ)貼相關(guān)的立法嚴(yán)重不足且相關(guān)規(guī)定缺乏科學(xué)性。現(xiàn)有的財政補(bǔ)貼法律制度在種類上仍較單一,農(nóng)業(yè)保險財政補(bǔ)貼中各主體法律責(zé)任的規(guī)定不夠具體,同時,沒有對農(nóng)業(yè)保險財政補(bǔ)貼制度形成有效的法律監(jiān)管。四、對國外先進(jìn)農(nóng)業(yè)保險財政補(bǔ)貼制度進(jìn)行比較與借鑒。國外農(nóng)業(yè)保險財政補(bǔ)貼制度主要有財政提供資本金、財政補(bǔ)貼保費和管理費、財政支持再保險、財政提供風(fēng)險基金和減輕稅賦五種。從國外這些財政補(bǔ)貼制度中可以得出對我國的兩點啟示:第一是農(nóng)業(yè)保險的發(fā)展需要體系化的財政補(bǔ)貼制度來支持;第二是農(nóng)業(yè)保險財政補(bǔ)貼制度需要法治保障。五、針對我國農(nóng)業(yè)保險財政補(bǔ)貼中的法律問題,借鑒國外發(fā)展農(nóng)業(yè)保險財政補(bǔ)貼制度的成功經(jīng)驗,對解決我國農(nóng)業(yè)保險財政補(bǔ)貼制度中存在的法律問題提出以下建議:第一,加快制定農(nóng)業(yè)保險財政補(bǔ)貼相關(guān)立法的步伐;第二,科學(xué)制定農(nóng)業(yè)保險財政補(bǔ)貼的相關(guān)法律規(guī)定;第三,建立健全多種類型的財政補(bǔ)貼制度;第四,成立專門性的監(jiān)管機(jī)構(gòu),完善農(nóng)業(yè)保險財政補(bǔ)貼法律監(jiān)管制度;第五,明確補(bǔ)貼制度中各主體的法律責(zé)任。
[Abstract]:It is of great significance to solve the legal problems existing in the financial subsidy of agricultural insurance, to perfect the legal system of agricultural insurance, to promote the legalization of public expenditure, to solve the problem of agriculture, rural areas and farmers, and to promote the development of agriculture. This paper uses the methods of normative analysis, empirical analysis and comparative analysis to analyze the legal problems in the financial subsidy of agricultural insurance in China, and puts forward some suggestions to solve the problems. In order to provide theoretical basis for solving the legal problem of agricultural insurance financial subsidy and to solve the outstanding problems in practice, it can promote the perfection and development of the financial subsidy system of agricultural insurance. In addition to the introduction, there are five parts of this paper. First, through the analysis of the concept and function of agricultural insurance and the attribute of quasi-public goods, it is concluded that the development of agricultural insurance can not be separated from the support of financial subsidies. Second, define the concept of financial subsidy of agricultural insurance and proceed from four economic law theories: the right of agricultural risk protection, the exercise of macro-control by the state, the need of standardizing the behavior of financial subsidy, and the legalization of public financial expenditure. This paper demonstrates the necessity of financial subsidy of agricultural insurance and the theoretical basis of its legal regulation. Third, combing the current situation of agricultural insurance and the financial subsidy of agricultural insurance in our country, and summarizing the main legal problems in the course of its development. In the existing legislation, the legislation related to the financial subsidy of agricultural insurance is seriously inadequate and the relevant provisions are lack of scientific nature. The existing legal system of financial subsidy is still relatively single in kind, the provisions of legal responsibility of each subject in the financial subsidy of agricultural insurance are not specific enough, at the same time, there is no effective legal supervision on the financial subsidy system of agricultural insurance. Fourth, the foreign advanced agricultural insurance financial subsidy system for comparison and reference. There are five kinds of financial subsidy system of agricultural insurance in foreign countries: financial capital, financial subsidy premium and management fee, financial support reinsurance, finance providing risk fund and reducing tax. From these financial subsidy systems abroad, we can draw two enlightenment to our country: first, the development of agricultural insurance needs the system of financial subsidy to support the development of agricultural insurance, and the second is that the financial subsidy system of agricultural insurance needs the protection of the rule of law. Fifthly, aiming at the legal problems in the financial subsidy of agricultural insurance in our country, and drawing on the successful experience of developing the financial subsidy system of agricultural insurance in foreign countries, the following suggestions are put forward to solve the legal problems in the financial subsidy system of agricultural insurance in China: first, Speed up the development of relevant legislation on agricultural insurance financial subsidies; second, scientifically formulate the relevant legal provisions of agricultural insurance financial subsidies; third, establish and perfect various types of financial subsidies system; fourth, set up specialized regulatory bodies, Improve the legal supervision system of agricultural insurance financial subsidy; fifth, clarify the legal responsibility of each subject in the subsidy system.
