【摘要】：知識經(jīng)濟(jì)時代,專利成為企業(yè)最具潛在價值的資產(chǎn)。專利儲備增多,專利競賽越演越烈,越來越多的單項(xiàng)專利演化成為組合專利競爭,諸多企業(yè)認(rèn)識到專利組合的價值,逐漸發(fā)展成專利聯(lián)盟。隨著國際市場專利競爭的加劇,外國相繼成立本國主權(quán)專利基金,以此來扶持本國企業(yè)走向國際市場,如法國的France Brevets,韓國的Intellectual Discovery公司,以及日本的IP Bridge等,被認(rèn)為是第一代主權(quán)專利基金。為了推動中國專利轉(zhuǎn)化運(yùn)營,發(fā)展產(chǎn)業(yè)聯(lián)盟,提升本國企業(yè)在國際國內(nèi)市場的競爭力,推動創(chuàng)新型國家的發(fā)展,中國參考外國主權(quán)專利基金的運(yùn)營模式,積極建立政府專利基金。政府專利基金是指基于保護(hù)本國相關(guān)產(chǎn)業(yè)發(fā)展,由政府主導(dǎo)出資,通過整合各方社會資源設(shè)立的用于全方位布局運(yùn)營專利的基金。其與主權(quán)專利基金不同之處主要在于,政府專利基金是由中央或者地方政府出資扶持運(yùn)營的,政府主導(dǎo)基金成立。目前,我國對政府專利基金做了一些有益的嘗試,比如在北京、四川等地區(qū)成立了專利運(yùn)營基金。政府專利基金將專利技術(shù)與基金相結(jié)合,既能為創(chuàng)新創(chuàng)業(yè)、微小企業(yè)提供技術(shù)發(fā)展的資金,也能優(yōu)化專利運(yùn)營機(jī)制,提高我國專利質(zhì)量。同時,政府專利基金作為專利融資的途徑之一,其對專利轉(zhuǎn)化、專利運(yùn)營發(fā)揮著重要作用,在各國普遍成立本國政府專利基金的情況下,其逐漸成為國家專利技術(shù)整合與專利市場競爭的主要途徑�，F(xiàn)階段,政府專利基金還處于初步探索階段,其在基金投入、使用機(jī)制以及監(jiān)管規(guī)制等方面正在摸索。通過梳理國內(nèi)外專利基金設(shè)立、運(yùn)行現(xiàn)狀,分析政府專利基金設(shè)立、運(yùn)作之具體流程,可發(fā)現(xiàn)現(xiàn)階段中國各政府專利基金運(yùn)行存在的相關(guān)法律問題;可嘗試借鑒國內(nèi)外專利基金機(jī)制構(gòu)建之經(jīng)驗(yàn),結(jié)合我國自身國情,考慮從機(jī)構(gòu)設(shè)置、利益分配、糾紛解決司法途徑以及基金監(jiān)管等方面完善我國政府專利基金及解決其存在的法律問題。
[Abstract]:In the era of knowledge economy, patents have become the most potential assets of enterprises. With the increase of patent reserve, patent competition becomes more and more intense, and more individual patents evolve into combinatorial patent competition. Many enterprises realize the value of patent combination and gradually develop into patent alliance. With the intensification of patent competition in the international market, foreign countries have set up their own sovereign patent funds one after another to support domestic enterprises to enter the international market, such as France Brevets in France, Intellectual Discovery in Korea, and IP Bridge in Japan. It is considered the first-generation sovereign patent fund. In order to promote the operation of patent transformation in China, develop industrial alliances, enhance the competitiveness of domestic enterprises in the international and domestic markets, and promote the development of innovative countries, China refers to the operation mode of foreign sovereign patent funds. We will actively establish government patent funds. The government patent fund refers to the fund set up by the government to protect the development of related industries in China, which is financed by the government, and which is set up by integrating the social resources of all parties for the purpose of operating the patent in all aspects. The main difference from sovereign patent fund is that the government patent fund is supported by the central or local government, and the government-led fund is established. At present, China has made some beneficial attempts on the government patent fund, such as the establishment of patent operating fund in Beijing, Sichuan and other regions. The government patent fund combines the patent technology with the fund, which can not only provide the funds for the technological development of the innovation and small enterprises, but also optimize the patent operation mechanism and improve the patent quality of our country. At the same time, as one of the ways of patent financing, government patent fund plays an important role in patent transformation and patent operation. It has gradually become the main way of national patent technology integration and patent market competition. At present, the government patent fund is still in the preliminary exploration stage, and it is groping in the aspects of fund investment, usage mechanism and supervision and regulation. Through combing the current situation of the establishment and operation of the patent fund at home and abroad and analyzing the concrete process of the establishment and operation of the government patent fund, we can find out the relevant legal problems existing in the operation of the patent fund of each government in China at the present stage. We may try to draw lessons from the experience of the establishment of patent fund mechanism at home and abroad, and consider the establishment of institutions and the distribution of benefits according to the national conditions of our country. To perfect the patent fund of our government and to solve the existing legal problems in the aspects of dispute settlement judicial approach and fund supervision.
