【摘要】：近幾年,服刑人員的權利保障問題一度引起人們的高度關注,尤其是對于特殊身份的服刑人員,即患病的服刑人員,他們在監(jiān)獄醫(yī)院接受治療期間的醫(yī)療權利問題因在法律上缺乏明確的保障更是關注的重點。罪犯的醫(yī)療權利是一種救濟權,目前還沒有法律對此明確的定位,對罪犯的醫(yī)療權利的保障程度也缺乏一定的標準,而罪犯醫(yī)療權利的保障,不僅關系到病犯的人權保障,還有助于減少醫(yī)療糾紛,規(guī)范和指引監(jiān)獄醫(yī)院醫(yī)務人員的醫(yī)療行為,維持監(jiān)管安全,并且對于病犯回歸社會后的傳染性疾病的預防和控制以及罪犯出獄后的社會再適應能力亦有著緊密的影響,因而需要引起大家的共同關注。本文通過臨床真實案例分析,結合臨床實際工作,主要從權利與權利、權利與權力、權利與義務、保障與救濟幾個方面探討監(jiān)獄服刑人員醫(yī)療權利保障問題,全文共分三個部分。第一部分主要介紹我國監(jiān)獄服刑人員醫(yī)療權利的相關概況。首先通過對我國監(jiān)獄服刑人員醫(yī)療權利的界定,導入包括我國監(jiān)獄服刑人員醫(yī)療權利的概念、特點以及醫(yī)療權利與相關權利的關系,明確監(jiān)獄服刑人員醫(yī)療權利的內(nèi)容,進一步分析監(jiān)獄服刑人員醫(yī)療權利的合理性及限度,探討研究保障服刑人員醫(yī)療權利對降低醫(yī)療糾紛、促進罪犯矯正以及對社會疾病預防與控制的意義。第二部分通過具體案例探討我國監(jiān)獄醫(yī)院服刑人員醫(yī)療權利保障的現(xiàn)狀和困境,進而分析引起病犯醫(yī)療權利保障失衡的原因。在對我國監(jiān)獄服刑人員醫(yī)療權利改革現(xiàn)狀,特別是相關政策和保障手段的了解與對比基礎上,分析總結了我國監(jiān)獄服刑人員醫(yī)療權利保障的困境,包括監(jiān)獄醫(yī)院管理體制不健全、監(jiān)獄醫(yī)院對罪犯身體疾患與心理疾患重視力度不均、服刑人員履行醫(yī)療義務的意識不強、監(jiān)獄醫(yī)院知情同意制度落實不嚴格、服刑人員醫(yī)療權利保障救濟渠道受阻等,然后結合實際情況從法律、經(jīng)濟、文化和社會四個方面分析出造成我國監(jiān)獄服刑人員醫(yī)療權利保障不力的原因。第三部分是對完善我國監(jiān)獄醫(yī)院服刑人員醫(yī)療權利保障的建議。針對第二部分中分析的監(jiān)獄醫(yī)院服刑人員醫(yī)療權利保障的困境就完善我國監(jiān)獄服刑人員醫(yī)療權利保障提出相關建議,包括促進完善立法、建立有特色的監(jiān)獄醫(yī)院規(guī)章體系、重視服刑人員的心理建設、加強監(jiān)獄醫(yī)院干警和服刑人員的意識教育、落實監(jiān)獄醫(yī)院知情同意制度、保障服刑人員醫(yī)療權利的法律救濟渠道等,以求客觀合理地完善罪犯醫(yī)療權利保障機制以及切實有效地提高監(jiān)獄醫(yī)院的執(zhí)法水平。
[Abstract]:In recent years, the protection of the rights of prisoners has aroused great concern, especially for prisoners with special status, that is, sick prisoners. Their right to medical care during their treatment in a prison hospital is of great concern due to the lack of clear legal protection. The right to medical treatment of criminals is a right of relief, and there is no clear legal position on it at present, and the degree of protection of medical rights of criminals is also lack of certain standards. The protection of medical rights of criminals is not only related to the protection of human rights of sick offenders, It also helps to reduce medical disputes, regulate and guide the medical behavior of medical personnel in prison hospitals, and maintain the safety of supervision. Moreover, the prevention and control of infectious diseases and the ability of social readjustment after the prisoners are released from prison also have a close impact on the prevention and control of infectious diseases after the return to society, so it is necessary to arouse the common concern of all. Through the analysis of real clinical cases and combining with clinical practice, this paper mainly discusses the protection of medical rights of prison personnel from the aspects of rights and rights, rights and powers, rights and obligations, protection and relief, etc. The paper is divided into three parts. The first part mainly introduces the relevant survey of the medical rights of the prison staff in our country. First of all, by defining the medical rights of prison personnel in China, introducing the concept, characteristics and the relationship between medical rights and related rights, the contents of medical rights of prison staff are clarified. This paper further analyzes the rationality and limitation of the medical rights of prison personnel, and probes into the significance of protecting the medical rights of prisoners in reducing medical disputes, promoting the correction of criminals and preventing and controlling social diseases. The second part discusses the current situation and predicament of medical rights protection for prisoners in prison hospitals through specific cases, and then analyzes the causes of the imbalance of medical rights protection for patients. On the basis of the understanding and comparison of the current situation of the reform of the medical rights of the prison staff in China, especially the relative policies and means of guarantee, this paper analyzes and summarizes the plight of the guarantee of the medical rights of the prison staff in our country. Including the imperfect management system of prison hospitals, the uneven attention paid by prison hospitals to the physical and psychological disorders of criminals, the lack of awareness of prisoners to fulfill their medical obligations, and the lax implementation of the system of informed consent in prison hospitals. According to the actual situation, the author analyzes the reasons for the poor guarantee of medical rights of Chinese prison staff from the four aspects of law, economy, culture and society. The third part is to perfect our country prison hospital prisoner's medical right safeguard suggestion. In the second part of the analysis of prison hospital prisoners' medical rights protection dilemma to improve our prison staff medical rights protection recommendations, including promoting the improvement of legislation, the establishment of a characteristic prison hospital rules and regulations system, Attach importance to the psychological construction of prisoners, strengthen the awareness education of police officers and prisoners in prison hospitals, implement the system of informed consent in prison hospitals, and guarantee the legal relief channels for the medical rights of prisoners, etc. In order to objectively and reasonably perfect the guarantee mechanism of prisoners' medical rights and effectively improve the level of law enforcement in prison hospitals.
