【摘要】：社會危害性是我國刑法學的基本范疇與核心概念。然而罪刑法定原則在九七年刑法典中得到確立之后,并隨著外國刑法思想的影響,社會危害性理論飽受爭議,學者們各執(zhí)己見,褒貶參半。本文站在通說的立場上,通過對社會危害性理論發(fā)展歷程進行概況回顧,并簡單闡述了社會危害性理論爭議的現狀,以及對社會危害性本體理論的研究,對各家學說進行評述并對社會危害性基礎理論進行重新解讀,然后對社會危害性與相鄰概念的關系進行討論,以期進一步明確社會危害性的具體內容,對社會危害性的規(guī)范性、實體性和專屬性進行說明,進而繼續(xù)確立社會危害性在中國刑法體系的地位,從而繼續(xù)展現社會危害性理論之于我國刑法學的合理性。本文分為三個部分。先是簡明的闡述了社會危害性理論的爭議產生的原因和研究現狀,以明確思路。再分別對社會危害性的本質、概念、性質、內容和價值的爭論進行評述并提出自己的觀點重新解釋其基礎理論。最后分別對社會危害性理論在我國刑事立法和刑事司法的立法指導和出罪機能進行闡述,并論述了罪刑法定原則與社會危害性的關系,以二元結構的犯罪構成為出發(fā)點完善犯罪構成與社會危害性的關系,進而完善社會危害性的評價標準。
[Abstract]:Social harmfulness is the basic category and core concept of criminal law in China. However, after the principle of legality was established in the Criminal Code of 1997, and with the influence of foreign criminal law thought, the theory of social harmfulness was controversial. From the standpoint of general theory, this paper reviews the development course of social harmfulness theory, and briefly expounds the status quo of social harmfulness theory controversy and the study of social harmfulness ontology theory. This paper comments on various theories and reinterprets the basic theory of social harmfulness, and then discusses the relationship between social harmfulness and adjacent concepts, in order to further clarify the concrete contents of social harmfulness and the standardization of social harmfulness. In order to establish the status of social harmfulness in the criminal law system of China, the rationality of the theory of social harmfulness in Chinese criminal law can be further demonstrated. This paper is divided into three parts. First of all, the reasons and research status of the controversy of social harmfulness theory are briefly expounded to clarify the ideas. Then it comments on the nature, concept, nature, content and value of social harmfulness, and puts forward its own viewpoint to explain its basic theory. Finally, the author expounds the guidance and function of social harmfulness theory in criminal legislation and criminal justice in China, and discusses the relationship between the principle of legally prescribed punishment for a crime and social harmfulness. Taking the dual structure of crime as the starting point to perfect the relationship between the crime constitution and the social harmfulness, and then to perfect the evaluation standard of the social harmfulness.
