【摘要】：公共體育服務(wù)是國(guó)家基本公共服務(wù)的重要內(nèi)容,也是國(guó)家體育發(fā)展戰(zhàn)略之一。按照國(guó)家總體要求到2020年,各級(jí)政府應(yīng)建成覆蓋城鄉(xiāng)、功能完善的全民健身公共服務(wù)體系,滿足不同人群、不同年齡多樣化的體育健身需求,讓全民健身在倡導(dǎo)健康生活、凝聚人心、促進(jìn)社會(huì)經(jīng)濟(jì)發(fā)展等方面發(fā)揮更加積極的作用。西安市公共體育服務(wù)發(fā)展也緊跟國(guó)家要求積極推進(jìn),并在健身場(chǎng)地設(shè)施建設(shè)和人員培訓(xùn)方面成效顯著。然而,西安市公共體育服務(wù)發(fā)展與國(guó)家的法律文件要求還存在落實(shí)不到位現(xiàn)象,與其他城市相比還有很大差距,還有一些在理論上較為困惑、實(shí)踐中無(wú)法繞開、必須直面的重大法律問(wèn)題,比如,政府購(gòu)買服務(wù)的供給方式、財(cái)政的支出責(zé)任和公共體育服務(wù)均等化的實(shí)現(xiàn)等方面依然顯得蒼白,一方面與地方政府自身治理能力有關(guān),更主要的是在落實(shí)法律法規(guī)和法律環(huán)境的保障方面明顯措施不利。本文試圖從法律規(guī)制的視角進(jìn)一步探究西安市公共體育服務(wù)供給的相關(guān)問(wèn)題,以期對(duì)西安市地方政府從理性層面提些參考性建議。本文運(yùn)用文獻(xiàn)資料法、實(shí)地調(diào)查和專家訪談法、邏輯分析法、比較法對(duì)西安市公共體育服務(wù)供給法律規(guī)制問(wèn)題進(jìn)行研究,主要從五個(gè)方面展開分析:第一,對(duì)公共服務(wù)、公共體育服務(wù)、公共體育服務(wù)供給,法律與政策環(huán)境等相關(guān)概念進(jìn)行梳理界定;第二,分析了西安市公共體育服務(wù)供給的現(xiàn)狀;第三,分析了西安市公共體育服務(wù)供給的法律現(xiàn)狀;第四,分析了影響西安市公共體育服務(wù)供給的兩大法律困惑;第五,提出解決西安市公共體育服務(wù)供給的法律制度構(gòu)建思路。得出結(jié)論如下:一是西安市各級(jí)政府是西安市公共體育服務(wù)的主要提供者(供給方),政府體育部門應(yīng)該把主要貫徹國(guó)家方針政策和法律的執(zhí)行,研究制定體育公共服務(wù)供給中的法律制度和規(guī)范法律程序,有效推進(jìn)公共體育服務(wù)供給方式多樣化和市場(chǎng)化,將政府職能切實(shí)轉(zhuǎn)變到依法加強(qiáng)公共體育服務(wù)管理和提供服務(wù)上來(lái)。二是西安市公共體育服務(wù)供給中的法律環(huán)境還存在一些問(wèn)題,諸如制度化法律化程度不高、公共體育服務(wù)項(xiàng)目的支出責(zé)任的履行模糊、合同適用項(xiàng)目不平衡、法律體系不完善等問(wèn)題�；谶@些問(wèn)題,還面臨選擇性執(zhí)法和行政壟斷兩大法律困惑,直接影響西安市公共體育服務(wù)有效供給。三是西安市公共體育服務(wù)供給需要法律規(guī)制,但應(yīng)該緊密結(jié)合西安市新的發(fā)展需求,適應(yīng)健身設(shè)施、健身組織、健身指導(dǎo)、體育活動(dòng)、體育咨詢等方面的實(shí)際情況,進(jìn)行針對(duì)有效的法律制度的構(gòu)建,同時(shí)注意要與西安市公共法律服務(wù)體系建設(shè)實(shí)現(xiàn)對(duì)接。
[Abstract]:Public sports service is an important part of national basic public service and one of the national sports development strategies. According to the overall requirements of the country, by 2020, governments at all levels should build a comprehensive public service system covering urban and rural areas, with perfect functions, to meet the diverse physical fitness needs of different population groups and different ages, so that the national fitness system can advocate a healthy life. Rally the people, promote social and economic development and play a more active role. The development of Xi'an public sports service is also in line with the requirements of the state, and has achieved remarkable results in the construction of fitness facilities and personnel training. However, the development of Xi'an public sports service and the requirements of the national legal documents still exist the phenomenon of implementation is not in place, compared with other cities, there is still a big gap, and some are more confused in theory, and can not be bypassed in practice. The major legal issues that must be faced directly, such as the way the government buys services, the responsibility of expenditure and the realization of equalization of public sports services, are still pale. On the one hand, they have something to do with the ability of local governments to govern themselves. More important is in the implementation of laws and regulations and the protection of the legal environment obvious measures are disadvantageous. This paper attempts to further explore the supply of public sports services in Xi'an from the perspective of legal regulation, in order to give some reference suggestions to the local government in Xi'an from the rational level. This article uses the literature method, the field investigation and the expert interview method, the logic analysis method, the comparative method carries on the research to the Xi'an city public sports service supply legal regulation question, mainly from five aspects to carry on the analysis: first, to the public service, Public sports service, public sports service supply, law and policy environment and other related concepts to sort out the definition; second, analyzed the current situation of Xi'an public sports service supply; third, This paper analyzes the current legal situation of the supply of public sports service in Xi'an; fourth, analyzes the two major legal puzzles affecting the supply of public sports service in Xi'an; fifthly, puts forward the idea of constructing the legal system to solve the supply of public sports service in Xi'an. The conclusions are as follows: first, the governments at all levels in Xi'an are the main providers of public sports services in Xi'an. The government sports departments should mainly carry out the implementation of national policies and laws. To study and formulate the legal system and standardize the legal procedures in the supply of public sports services, and to effectively promote the diversification and marketization of the modes of supply of public sports services, The function of government should be transformed into strengthening the management of public sports service and providing service according to law. Second, there are still some problems in the legal environment of the supply of public sports service in Xi'an, such as the low degree of institutionalization and legalization, the vague implementation of the expenditure responsibility of public sports service items, and the imbalance of the applicable items of the contract. Imperfect legal system and so on. Based on these problems, it also faces two major legal puzzles, namely selective law enforcement and administrative monopoly, which directly affect the effective supply of public sports services in Xi'an. Third, the supply of public sports services in Xi'an needs legal regulation, but it should be closely combined with the new development needs of Xi'an to adapt to the actual conditions of fitness facilities, fitness organizations, fitness guidance, sports activities, sports consultation, etc. To build an effective legal system, and pay attention to the construction of Xi'an public legal service system to achieve docking.
