【摘要】：最近幾年,我國水產(chǎn)品養(yǎng)殖業(yè)發(fā)展迅速,“吃魚難”的問題一去不復(fù)返,但隨之而來的卻是眾多水產(chǎn)品質(zhì)量安全事件,諸如“濟南海米胭脂紅事件”、“2007年鰻魚被扣事件”等等,水產(chǎn)品的質(zhì)量問題已經(jīng)成為熱點問題。水產(chǎn)品在養(yǎng)殖、生產(chǎn)、銷售方面都有其特殊性,需要有專門的制度對其進行監(jiān)管,但我國目前并沒有專門的法律,現(xiàn)有的《食品安全法》規(guī)定過于原則,不能很好地保證水產(chǎn)品的質(zhì)量安全。目前,我國水產(chǎn)品質(zhì)量安全監(jiān)管制度仍存在一些不足,主要表現(xiàn)在市場準(zhǔn)入制度不健全、追溯制度不完善、召回制度不全面等等,相較于國內(nèi),國外在水產(chǎn)品質(zhì)量安全監(jiān)管制度方面有比較完善的法律體系、系統(tǒng)的標(biāo)準(zhǔn)體系、先進的追溯技術(shù)和有效的救濟途徑。要想完善我國水產(chǎn)品質(zhì)量安全監(jiān)管制度,必須要從水產(chǎn)品的養(yǎng)殖、生產(chǎn)、銷售三個環(huán)節(jié)入手,從水產(chǎn)品質(zhì)量安全市場準(zhǔn)入標(biāo)準(zhǔn)建設(shè)、檢測體系建設(shè)、監(jiān)管手段建設(shè)以及許可后的監(jiān)督來完善水產(chǎn)品的市場準(zhǔn)入制度;通過完善追溯法律法規(guī)、提高相關(guān)企業(yè)參與積極性、追溯技術(shù)的開發(fā)以及對追溯體系的認(rèn)可度來健全水產(chǎn)品追溯制度;通過降低水產(chǎn)品召回成本、轉(zhuǎn)變水產(chǎn)品召回觀念、加大懲罰力度等手段來完善水產(chǎn)品召回制度。
[Abstract]:In recent years, the aquaculture industry in China has developed rapidly, and the problem of "hard to eat fish" has gone forever. However, it has been followed by numerous incidents of quality and safety of aquatic products, such as the "Jinan Haimi Carmine incident." The 2007 eel arrest incident, etc., the quality of aquatic products has become a hot issue. Aquaculture, production and marketing of aquatic products have their own particularities, which need a special system to supervise them. However, at present, there is no special law in our country, and the existing Food Safety Law provides for too many principles. The quality and safety of aquatic products can not be guaranteed well. At present, there are still some deficiencies in the quality and safety supervision system of aquatic products in our country, which are mainly manifested in the imperfect market access system, the imperfect traceability system, the incomplete recall system, and so on. Foreign countries have perfect legal system, systematic standard system, advanced traceability technology and effective remedy way in the supervision system of aquatic product quality and safety. In order to improve the quality and safety supervision system of aquatic products in China, we must start with the aquaculture, production and sale of aquatic products, and start with the construction of market access standards for quality and safety of aquatic products and the construction of testing systems. Construction of regulatory means and supervision after licensing to improve the market access system of aquatic products; by improving the traceability of laws and regulations to enhance the enthusiasm of relevant enterprises to participate, The development of traceability technology and recognition of traceability system to perfect the aquatic product recall system, by reducing the cost of aquatic product recall, changing aquatic product recall concept, increasing punishment and other means to improve the aquatic product recall system.
