【摘要】：近年來，隨著互聯(lián)網(wǎng)的飛速發(fā)展，人們可以在網(wǎng)絡空間中自由地表達自己的意愿。可以說，言論自由的疆域得到了極大的拓展。但是，隨著網(wǎng)絡謠言侵權(quán)，甚至違法犯罪案件的不斷增多，網(wǎng)絡謠言問題成了政府和公眾討論的話題。如何既不扼殺網(wǎng)絡言論的創(chuàng)造性和活力，又有效防止網(wǎng)絡言論異化是亟待解決的關(guān)鍵性問題。 本論文約3萬字，，正文結(jié)構(gòu)分為三部分。具體而言，第一部分是“網(wǎng)絡謠言與法律責任”，主要包括網(wǎng)絡謠言的內(nèi)涵、成因以及法律責任。通過該部分的論述，可以對網(wǎng)絡謠言形成一個整體的認知。第二部分是“網(wǎng)絡謠言的入罪機制”。主要包括網(wǎng)絡謠言的犯罪構(gòu)成以及對網(wǎng)絡言論自由的影響。第三部分是“網(wǎng)絡謠言入罪與網(wǎng)絡謠言治理”。主要包括網(wǎng)絡謠言治理中存在的問題以及治理網(wǎng)絡謠言的新路徑。也即是，在人權(quán)保障基礎上形成網(wǎng)絡謠言治理的新體系。
[Abstract]:In recent years, with the rapid development of the Internet, people can freely express their wishes in cyberspace. It can be said that the territory of freedom of speech has been greatly expanded. However, with the incessant increase of online rumor infringement and even criminal cases, the issue of Internet rumor has become a topic of discussion between the government and the public. How to not stifle the creativity and vitality of online speech and effectively prevent the alienation of online speech is a key problem to be solved. This paper is about 30,000 words, the text structure is divided into three parts. Specifically, the first part is "Internet rumors and legal liability", mainly including the connotation, causes and legal liability of Internet rumors. Through the discussion of this part, we can form a whole cognition to the network rumor. The second part is the conviction mechanism of network rumor. It mainly includes the criminal constitution of network rumor and its influence on the freedom of speech on the network. The third part is the crime of network rumor and the governance of network rumor. It mainly includes the problems existing in the network rumor management and the new way to manage the network rumor. That is, on the basis of human rights protection to form a new network rumor governance system.
