三網(wǎng)融合下信息網(wǎng)絡傳播權(quán)與廣播權(quán)重構(gòu)的理論與實踐研究

【摘要】:自2000年首提三網(wǎng)融合概念以來我國在三網(wǎng)融合方面進行了大量的嘗試,2015年國務院頒布的《三網(wǎng)融合推廣方案》標志著三網(wǎng)融合在我國開始了全面推廣的進程。三網(wǎng)融合帶來的便利顯而易見,但是設備終端的多功能化在給用戶帶來便利的同時也給著作權(quán)法尤其是信息網(wǎng)絡傳播權(quán)和廣播權(quán)層面帶來了極大的沖擊。究其原因,一是由于立法本身的滯后屬性,二是我國著作權(quán)法中關于信息網(wǎng)絡傳播權(quán)與廣播權(quán)的法律設置與技術層面聯(lián)系太深。我國學界先后提出了多種重構(gòu)方案,然而對于重構(gòu)方案的理論依據(jù)和實踐支撐尚缺乏深入的分析和探索。以學界現(xiàn)有的重構(gòu)方案為出發(fā)點,通過對現(xiàn)有重構(gòu)方案進行分類與評價,選擇技術中立的遠程傳播權(quán)重構(gòu)方案作為研究對象;橫向?qū)Ρ任覈⒎ㄅc世界的向公眾傳播權(quán),為遠程傳播權(quán)重構(gòu)方案的選擇尋求理論支撐;通過剖析我國司法中的典型案例提出對信息網(wǎng)絡傳播權(quán)與廣播權(quán)進行重構(gòu)的現(xiàn)實需求;結(jié)合我國著作權(quán)法草案的修改歷程提出送審稿中對播放權(quán)和信息網(wǎng)絡傳播權(quán)的規(guī)定在三網(wǎng)融合的大趨勢下并非長久之計,三網(wǎng)融合并隨的技術融合局面要求立法必須保持足夠的技術中立,遠程傳播權(quán)的行為主義立法路徑是較為明智的選擇,同時對遠程傳播權(quán)進行了簡單細化。
[Abstract]:Since the concept of triple network fusion was first put forward in 2000, China has made a great deal of attempts in the field of triple network integration. In 2015, the State Council promulgated the "Tri-Network Fusion Promotion Program", which marks the beginning of the process of all-around promotion of Tri-net Fusion in China. The convenience brought by the integration of three networks is obvious, but the multifunction of the equipment terminal not only brings convenience to the user, but also brings great impact to the copyright law, especially the information network transmission right and the broadcasting right level. The reasons are, firstly, the lagging attribute of the legislation itself, and second, the legal setting and technical connection between the right of information network communication and the right of broadcasting in the copyright law of our country are too deep. The academic circles of our country have put forward many kinds of reconstruction schemes, but the theoretical basis and practical support of the reconstruction schemes are still lack of deep analysis and exploration. By classifying and evaluating the existing reconstruction schemes, the author chooses the technology neutral reconstruction scheme as the research object, and compares the legislation of our country with the public transmission right in the world. By analyzing the typical cases in our country, the author puts forward the realistic demand for the reconstruction of information network communication right and broadcasting right. According to the revision course of the draft copyright Law of our country, it is not a long-term plan to put forward the regulations on broadcast right and information network transmission right in the draft submitted for review under the general trend of the integration of three networks. The integration of three networks and accompanying technology requires legislation to maintain sufficient technical neutrality. The behaviorist legislative path of remote communication right is a more sensible choice, and the remote communication right is simply refined.
