【摘要】：法治中國建設(shè)是當今中國改革進行的偉大實踐。這一實踐所追求的價值目標是良法善治,主要表現(xiàn)為法律宏觀上實現(xiàn)應(yīng)然向?qū)嵢坏膬r值轉(zhuǎn)化,公民微觀上自覺履行法律義務(wù)、行使法律權(quán)利。而這取決于公民是否具有守法道德意識,即公民守法道德意識的培育是法治中國建設(shè)的德性保證。公民道德建設(shè)的重要性被黨的十八大推至新的高度,是關(guān)系到全面建成小康社會能否實現(xiàn)、全民素質(zhì)能否提升的關(guān)鍵。在《關(guān)于進一步把社會主義核心價值觀融入法治建設(shè)的指導(dǎo)意見》中,法治體現(xiàn)道德理念、強化法律對道德建設(shè)的促進作用�？梢�,對道德建設(shè)重要內(nèi)容的公民守法問題的探究,不僅是法治建設(shè)的要求,也是我國道德建設(shè)“軟性要求”向“硬性規(guī)范”的時代必需。培育公民守法道德意識不僅對人民踐行法律具有促進作用,且有利于人民群眾深化理解貫徹法律所蘊含的倫理、道德,提高守法行為的堅定性與自覺性,從理論與實踐上促進公民守法行為。本文從實證分析出發(fā),發(fā)現(xiàn)當今守法道德意識的缺乏由于我國傳統(tǒng)社會重“術(shù)”、“勢”和刑罰,人民責任意識缺乏,主體意識淡漠,人民對法律多是畏懼和服從,使得我國公民守法多是消極被動,加之現(xiàn)代法律善惡標準不統(tǒng)一,守法功利心理、公權(quán)力主體守法表率性差和守法道德教育缺乏造成的。因此公民守法道德意識的培育要建立新的培育模型,從優(yōu)化社會環(huán)境、強化主體意識和培養(yǎng)批判性思維、完善監(jiān)督保障機制、深挖傳統(tǒng)文化精華出發(fā),以促進公民守法道德意識培養(yǎng)目標的實現(xiàn)。
[Abstract]:The construction of China under the rule of law is a great practice of China's reform today. The value goal pursued in this practice is good law and good governance, which is mainly manifested in the realization of the transformation of value from the law to the real one, the realization of the legal obligation and the exercise of the legal right by the citizens on the micro level. This depends on whether the citizen has the moral consciousness of abiding by the law, that is, the cultivation of the moral consciousness of abiding by the law is the moral guarantee of the construction of the rule of law in China. The importance of citizen moral construction has been pushed to a new height by the 18th National Congress of the Party, which is the key to the realization of building a well-off society in an all-round way and whether the quality of the whole people can be improved. In the guiding opinion on further integrating the socialist core values into the construction of the rule of law, the rule of law embodies the moral concept and strengthens the role of the law in promoting the moral construction. Therefore, it is not only the requirement of the rule of law, but also the necessity of the "soft requirement" to the "hard norm" of the moral construction to explore the problem of citizen abiding by the law in the important content of the moral construction. Cultivating citizens' awareness of abiding by the law not only promotes the people's practice of the law, but also helps the people to deepen their understanding of the ethics and morality contained in the implementation of the law, and to enhance the firmness and consciousness of law-abiding behavior. To promote citizens' law-abiding behavior in theory and practice. Based on the empirical analysis, this paper finds that the lack of moral consciousness of abiding by the law is due to the traditional society's emphasis on "skill", "power" and punishment, people's lack of sense of responsibility, lack of awareness of subject, people's fear and obedience to the law. It makes the citizens obey the law passively and passively, in addition to the disunity of the standards of good and evil of modern law, the utilitarian psychology of abiding by the law, the poor exemplary of abiding by the law and the lack of moral education of abiding by the law. Therefore, the cultivation of citizen's moral consciousness of abiding by the law should establish a new cultivation model, starting from optimizing the social environment, strengthening the consciousness of subject and cultivating critical thinking, perfecting the mechanism of supervision and security, and digging deeply into the essence of traditional culture. In order to promote the citizens to abide by the law moral awareness of the realization of the goal.
