【摘要】：近年來,隨著人權(quán)保障理念的不斷深入,辯護制度改革成為我國法學(xué)界和實務(wù)界共同關(guān)注的一個熱點問題。學(xué)者們對辯護權(quán)的概念,辯護制度的理論基礎(chǔ),刑事辯護制度的意義,辯護的種類、范圍,辯護人的責(zé)任,辯護人的訴訟地位,辯護人的訴訟權(quán)利和訴訟義務(wù)進行了較為深入的研究。但是,在司法實務(wù)中,律師擔(dān)任辯護人的時候,其辯護權(quán)的行使問題卻一直是困擾我國刑事司法的一大難題,律師辯護權(quán)保障問題仍然突出。律師辯護權(quán)的保障不僅直接影響著辯護權(quán)的行使效果,而且對于制約司法權(quán),促進司法公正,保障人權(quán)具有重要價值。本文試圖在闡釋律師辯護權(quán)保障制度價值的基礎(chǔ)上,通過對兩大法系國家的律師辯護權(quán)保障制度的考察,為我國律師辯護權(quán)保障制度的完善提供經(jīng)驗借鑒。然后,分析司法實務(wù)中我國律師辯護權(quán)運行中的障礙,揭示我國律師辯護權(quán)保障制度存在的重要問題,最后從立法上提出完善辯護權(quán)保障制度的建議。全文共有四個部分,具體如下:第一部分:闡釋律師辯護權(quán)保障制度的一般理論。首先厘清辯護與辯護權(quán)的概念,在認識清楚辯護權(quán)保障制度的基礎(chǔ)上,探討了律師辯護權(quán)保障制度的價值,指出有效辯護制度在權(quán)力制衡、實現(xiàn)司法公正、保障人權(quán)等方面的積極作用。第二部分:國外律師辯護權(quán)保障制度探究。主要介紹了英美德法四國關(guān)于律師辯護權(quán)保障制度的立法經(jīng)驗,指出了各國制度的特色,并綜合分析比較了各國的制度,評析論證制度中具有進步意義的法律規(guī)則。第三部分:揭示我國律師辯護權(quán)保障制度立法規(guī)定的不足之處。采用實證分析的方法從律師會見權(quán)保障不充分、調(diào)查取證權(quán)形式化、法庭質(zhì)證難落實、辯護律師在場權(quán)缺失、律師辯護權(quán)救濟機制不健全這五個方面揭示出我國現(xiàn)在刑事訴訟中律師辯護權(quán)保障制度立法規(guī)定的不足之處。第四部分:提出完善我國律師辯護權(quán)保障制度的建議。針對存在的問題,提出相應(yīng)完善制度的建議:加強辯護律師會見保障力度;賦辯護律師實質(zhì)化的調(diào)查取證權(quán);保障辯護律師庭審質(zhì)證權(quán);賦予辯護律師的在場權(quán);賦予辯護律師豁免權(quán);構(gòu)建侵犯辯護權(quán)的制裁機制。
[Abstract]:In recent years, with the deepening of the concept of human rights protection, the reform of defense system has become a hot issue of common concern in the field of law and practice in our country. The concept of the right to defense, the theoretical basis of the defense system, the significance of the criminal defense system, the types and scope of the defence, the responsibilities of the defender, the litigation status of the defender, Defenders' litigation rights and obligations have been studied in depth. However, in the judicial practice, when lawyers are defenders, the exercise of their right to defense has always been a major problem puzzling our criminal justice, and the protection of lawyers' right to defense is still prominent. The guarantee of lawyers' right of defense not only directly affects the effect of the exercise of the right of defense, but also has important value for restricting judicial power, promoting judicial justice and safeguarding human rights. On the basis of explaining the value of lawyers' right to defense, this paper attempts to provide experience for the perfection of the system of lawyers' right of defense in China through the investigation of the system of safeguarding lawyers' right of defense in the countries of two legal systems. Then, the author analyzes the obstacles in the operation of lawyers' right to defense in judicial practice, reveals the important problems existing in the system of safeguarding lawyers' right of defense, and finally puts forward some suggestions for perfecting the system of safeguarding the right of defense in legislation. There are four parts in this paper: the first part: explain the general theory of lawyer's right to defense. First of all, it clarifies the concept of defense and the right to defense, on the basis of clearly understanding the system of safeguarding the right to defense, discusses the value of the system of safeguarding the right of defense of lawyers, points out that the effective system of defense is balancing power and realizing judicial justice. The protection of human rights and other aspects of the positive role. The second part: the protection system of lawyers' right to defense abroad. This paper mainly introduces the legislative experience of Anglo-American and German-French countries on the protection system of lawyers' right to defense, points out the characteristics of each country's system, and comprehensively analyzes and compares the systems of various countries, and comments on the progressive legal rules in the system of argumentation. The third part: reveals the deficiency of our country lawyer's defense right safeguard system legislation stipulation. By using the method of empirical analysis, the rights of lawyers' meeting are not fully guaranteed, the right to investigate and collect evidence is formalized, the court cross-examination is difficult to carry out, and the right of defense counsel to be present is missing. The remedy mechanism of lawyers' right of defense is not perfect in these five aspects, which reveals the deficiency of the legal provisions of the system of safeguarding lawyers' right of defense in the present criminal proceedings in our country. The fourth part: put forward the suggestion of perfecting our country lawyer's defense right safeguard system. In view of the existing problems, the author puts forward some suggestions on how to improve the system: strengthening the guarantee of defense counsel meeting; giving defense counsel the substantive right to investigate and collect evidence; ensuring the right of defense counsel to cross-examine in court; giving defense counsel the right to be present; To grant immunity to defence counsel; to establish sanctions for infringement of the right to defense.
