【摘要】：馬克思法學思想是馬克思主義理論的重要組成部分。馬克思通過對黑格爾、費爾巴哈等哲學家的批判與繼承,使法學思想從唯心主義的牢籠中掙脫出來,創(chuàng)立了唯物主義的法學思想。馬克思法學思想的完整體系經(jīng)歷了由不完善的法哲學思想向完整龐大的法學思想的轉變,因此馬克思法學思想不僅為人類認識世界和改造世界提供了強大的思想武器,也為中國特色社會主義法治建設起到了指引和導向的作用。馬克思恩格斯沒有留下專門論述法學方面的專著,但馬克思恩格斯在不同時期,從不同的側面、不同的語境、不同的維度對法學思想進行了深刻的論述,這些基本思想就構成了馬克思法學思想。馬克思法學思想雖散見于不同時期的馬克思恩格斯的經(jīng)典著作中,但這些思想?yún)s不是彼此孤立的,而是以一定的邏輯思維展開的,在這一思想形成的過程中,馬克思恩格斯始終堅持唯物辯證法和唯物史觀的基本觀點論證馬克思法學思想的革命性與科學性,以此來彰顯馬克思法學思想的在法治建設中強大的理論價值和實踐價值。本文除緒論外共由三個部分組成:第一部分:馬克思法學思想發(fā)展歷程。是本文的重點部分,用馬克思各個時期的經(jīng)典著作論述馬克思法學思想的發(fā)展歷程,包括馬克思法學思想的創(chuàng)立、發(fā)展和最終確立,以及恩格斯對馬克思法學思想具體內容的捍衛(wèi)和發(fā)展;第二部分:馬克思法學思想基本概述。是本文的核心部分,由于馬克思法學思想的內容龐大而冗雜,因此本文只論述了部分重要的馬克思法學思想的內容,包括法的階級性與歷史性、法與經(jīng)濟的關系、法與國家的關系、社會主義法治的歷史必然四個重要部分;第三部分:馬克思法學思想的價值。是本文的亮點部分,馬克思法學思想的價值涵蓋了理論價值和當代價值兩個具體方面,其中理論價值主要體現(xiàn)在拓寬了法學的寬度、拓展了法學的深度、提升了法學的高度,當代價值主要體現(xiàn)在引導和推進我國的社會主義法治建設上。
[Abstract]:Marxist legal thought is an important part of Marxist theory. By criticizing and inheriting philosophers such as Hegel and Feuerbach, Marx broke free from the cage of idealism and founded the materialistic legal thought. The complete system of Marx's legal thought has gone through the transformation from imperfect legal philosophy to complete and huge legal thought. Therefore, Marx's legal thought not only provides a powerful ideological weapon for human beings to understand and transform the world. Also for the construction of socialist rule of law with Chinese characteristics played a guiding and guiding role. Marx and Engels did not leave a monographs on law, but Marx and Engels discussed the thought of law from different aspects, different contexts and different dimensions in different periods. These basic ideas constitute Marxist legal thought. Although Marx's legal thought is scattered in the classical works of Marx and Engels in different periods, these thoughts are not isolated from each other, but spread out with certain logical thinking. In the course of the formation of this thought, Marx and Engels always insist on materialistic dialectics and historical materialism to demonstrate the revolutionary and scientific nature of Marx's legal thought, so as to highlight the strong theoretical and practical value of Marx's legal thought in the construction of the rule of law. This paper consists of three parts except introduction: the first part: the development of Marxist legal thought. Is the key part of this paper, using the classical works of each period of Marx to discuss the course of the development of Marxist legal thought, including the establishment, development and final establishment of Marxist legal thought. And Engels defend and develop the concrete content of Marx's legal thought; the second part: the basic outline of Marx's legal thought. Is the core part of this paper, because the content of Marxist legal thought is huge and jumbled, so this paper only discusses some important contents of Marxist legal thought, including the class nature and history of law, the relationship between law and economy. The relationship between law and state, the historical necessity of socialist rule of law, four important parts; the third part: the value of Marx's legal thought. The value of Marx's legal thought covers both theoretical value and contemporary value, in which the theoretical value is mainly reflected in broadening the breadth of jurisprudence, expanding the depth of jurisprudence, and elevating the height of jurisprudence. Contemporary value is mainly embodied in guiding and promoting the construction of socialist rule of law in our country.
