【摘要】：科學(xué)技術(shù)是第一生產(chǎn)力。隨著高新技術(shù)的不斷發(fā)展,技術(shù)創(chuàng)新的速度加快,經(jīng)濟(jì)全球化也日益加強(qiáng)。標(biāo)準(zhǔn)必要專利就是在這樣的背景下產(chǎn)生的。將標(biāo)準(zhǔn)與專利結(jié)合在一起,造就了標(biāo)準(zhǔn)必要專利。標(biāo)準(zhǔn)必要專利的產(chǎn)生,將標(biāo)準(zhǔn)的公共性和專利的私權(quán)性融合在一起,力求能夠取得最大的經(jīng)濟(jì)效益。但是,由于二者之間的矛盾,也不可避免的造成了權(quán)利的濫用。盡管現(xiàn)在相關(guān)方已經(jīng)對(duì)標(biāo)準(zhǔn)必要專利許可時(shí)采用的FRAND原則的內(nèi)涵做了解釋,但是仍然比較抽象,這也是造成標(biāo)準(zhǔn)必要專利濫用的原因。關(guān)于標(biāo)準(zhǔn)必要專利的濫用行為,一般都是考慮FRAND原則下的專利濫用,主要包括不合理拒絕許可,濫用禁令權(quán),將標(biāo)準(zhǔn)必要專利與非標(biāo)準(zhǔn)必要專利搭售或者進(jìn)行一攬子許可,還有違反FRAND原則的不合理定價(jià)。在這種情況下來探尋濫用標(biāo)準(zhǔn)標(biāo)準(zhǔn)必要專利的反壟斷救濟(jì)方式是非常必要的。針對(duì)濫用標(biāo)準(zhǔn)必要專利的反壟斷救濟(jì),從法律和實(shí)踐兩個(gè)方面進(jìn)行研究。通過對(duì)國(guó)內(nèi)外的法律規(guī)定和實(shí)踐案例進(jìn)行對(duì)比分析,在實(shí)踐中尋找救濟(jì)的方式。經(jīng)過對(duì)比研究,對(duì)我國(guó)濫用標(biāo)準(zhǔn)必要專利的反壟斷救濟(jì)方式提出建議。
[Abstract]:Science and technology are the primary productive forces. With the continuous development of high-tech, the speed of technological innovation is accelerating, and economic globalization is increasingly strengthened. It is in this context that the necessary patent for standards is produced. Combining standards with patents creates necessary patents for standards. The emergence of the necessary patent of the standard combines the publicity of the standard with the private right of the patent in order to obtain the greatest economic benefit. However, due to the contradiction between the two, also inevitably caused abuse of rights. Although the relevant parties have now explained the connotation of the FRAND principle used in the standard necessary patent license, it is still abstract, which is also the reason for the abuse of the standard essential patent. As for the abuse of standard essential patent, the abuse of patent under the principle of FRAND is generally considered, which mainly includes unreasonable refusal of license, abuse of prohibition power, linking standard essential patent with non-standard essential patent or carrying out a package license. There are also unreasonable pricing in violation of FRAND principles. In this case, it is necessary to explore the anti-monopoly remedies for the abuse of standard essential patents. The anti-monopoly remedy for abuse of standard necessary patent is studied from two aspects: law and practice. Through the comparative analysis of domestic and foreign legal provisions and practical cases, the way of relief is sought in practice. Through comparative study, some suggestions on anti-monopoly remedy for abuse of standard patent are put forward.
