【摘要】：社區(qū)矯正是指將滿足社區(qū)矯正要求的犯罪分子安排在社區(qū)里,由社區(qū)內(nèi)的志愿者和其他組織共同配合國家機(jī)關(guān),在司法機(jī)關(guān)作出的判決、裁定或決定確定的期限內(nèi),對犯罪人員的犯罪行為和心理進(jìn)行矯正,幫助他改過自新并重新融入家庭和社會的非監(jiān)禁刑罰執(zhí)行活動。社區(qū)矯正屬于社會化的行刑方式,它的實(shí)施是離不開社會組織的參與和幫助的。而社會組織是指獨(dú)立于政府和經(jīng)濟(jì)組織,不以營利為目的,具有自治、公益、獨(dú)立等特點(diǎn)的正式組織。其參與社區(qū)矯正雖然取得了一些不菲的成績,但還存在著一些不足,如:對社會組織主體身份缺乏法律保障;忽視對社區(qū)矯正人員工作能力的提升;缺乏科學(xué)工作機(jī)制等問題。我國部分經(jīng)濟(jì)發(fā)達(dá)的省市,在社會組織參與社區(qū)矯正方面取得了成功經(jīng)驗(yàn),本文在研究這些成功經(jīng)驗(yàn)的基礎(chǔ)上,提出完善我國社會組織參與社區(qū)矯正的相應(yīng)對策,一是完善社會組織參與宣傳機(jī)制,增強(qiáng)社會大眾的參與意識;二是完善社會組織參與社區(qū)矯正的介入機(jī)制;三是完善社會組織參與的法律制度;四是完善社會組織的培養(yǎng)機(jī)制;五是完善社會組織的工作機(jī)制,構(gòu)建科學(xué)化的體系。
[Abstract]:Community correction refers to the placement in the community of criminal elements who meet the requirements of community correction, in which volunteers and other organizations in the community cooperate with the state organs and within the time limit set by the judicial organs in the judgment, order or decision,Correction of criminal behavior and psychology, rehabilitation and reintegration into the family and society of non-custodial penalty enforcement activities.Community correction is a socialized execution method, its implementation is inseparable from the participation and help of social organizations.Social organization is a formal organization which is independent of government and economic organization, not for profit, and has the characteristics of autonomy, commonweal, independence and so on.Although its participation in community correction has made some achievements, but there are still some shortcomings, such as: lack of legal protection of the status of the main body of social organizations; neglect of the improvement of the ability of community correction personnel; lack of scientific work mechanism, and so on.Some economically developed provinces and cities in our country have made successful experience in the field of social organization participation in community correction. Based on the study of these successful experiences, this paper puts forward the corresponding countermeasures to improve the participation of social organizations in community correction.The first is to perfect the publicity mechanism of social organizations, to enhance the public's consciousness of participation; second, to perfect the intervention mechanism of social organizations to participate in community correction; third, to perfect the legal system of social organizations' participation; fourth, to perfect the training mechanism of social organizations;Fifth, improve the working mechanism of social organizations and build a scientific system.
