網(wǎng)絡(luò)消費(fèi)者權(quán)益保護(hù)的法律問(wèn)題研究

【摘要】:互聯(lián)網(wǎng)技術(shù)飛速發(fā)展,不可否認(rèn)的是信息產(chǎn)業(yè)的發(fā)展給我們的生活帶來(lái)了很多的便利,網(wǎng)絡(luò)為我們的生活提供很多的在線服務(wù),突破了時(shí)間和地域的局限,尤其是網(wǎng)絡(luò)交易這種新興的電子商務(wù)模式,以其交易成本的降低,交易效率的提高深受廣大經(jīng)營(yíng)者與消費(fèi)者的喜愛(ài),在網(wǎng)絡(luò)交易中,經(jīng)營(yíng)者不必花費(fèi)巨額的租金,不必雇傭一些服務(wù)人員,大大降低了經(jīng)營(yíng)成本;對(duì)于消費(fèi)者而言,在網(wǎng)絡(luò)消費(fèi)的過(guò)程中不必花費(fèi)大量的時(shí)間去滿足自己的消費(fèi)需求,也不必去千里迢迢的去某地選購(gòu)當(dāng)?shù)靥厣灰愦蜷_(kāi)計(jì)算機(jī)點(diǎn)擊瀏覽網(wǎng)頁(yè)就可以隨心縱欲地進(jìn)行網(wǎng)絡(luò)消費(fèi)了,既節(jié)省了時(shí)間、精力,而且由于在線交易省去了很多中間環(huán)節(jié),商品或服務(wù)的價(jià)格相對(duì)于傳統(tǒng)實(shí)體店的會(huì)便宜很多,所以這樣在價(jià)格上網(wǎng)絡(luò)交易也會(huì)占有很大優(yōu)勢(shì)。網(wǎng)絡(luò)交易隨著這些優(yōu)勢(shì)的體現(xiàn)在以后的生活中會(huì)越來(lái)越普及,而且范圍也會(huì)逐漸的擴(kuò)大,同時(shí)也給社會(huì)帶來(lái)了巨大的經(jīng)濟(jì)利益。 在分析與承認(rèn)了網(wǎng)絡(luò)交易的巨大優(yōu)勢(shì)之后,不可忽視的是,由于網(wǎng)絡(luò)交易與傳統(tǒng)交易在方式上有著根本性的區(qū)別,所以在很多方面也暴露出了網(wǎng)絡(luò)交易相對(duì)于傳統(tǒng)交易的缺陷,尤其是在消費(fèi)者權(quán)益保護(hù)方面,在網(wǎng)絡(luò)交易中,經(jīng)營(yíng)者與消費(fèi)者存在嚴(yán)重的信息不對(duì)稱(chēng),就導(dǎo)致了本來(lái)處于相對(duì)弱勢(shì)地位的消費(fèi)者在權(quán)益保護(hù)方面就會(huì)面臨更大的缺失,在傳統(tǒng)消費(fèi)領(lǐng)域?qū)οM(fèi)者權(quán)益保護(hù)的法律規(guī)范主要是《民法通則》、《合同法》、《消費(fèi)者權(quán)益保護(hù)法》等,,在網(wǎng)絡(luò)消費(fèi)領(lǐng)域,在這方面的法律依然主要是依靠這些法律規(guī)范,很少有針對(duì)網(wǎng)絡(luò)消費(fèi)者權(quán)益保護(hù)的專(zhuān)門(mén)性立法,顯然由于網(wǎng)絡(luò)消費(fèi)與傳統(tǒng)消費(fèi)在方式上的巨大反差,這些傳統(tǒng)立法已不足以滿足網(wǎng)絡(luò)消費(fèi)者權(quán)益保護(hù)的需求了,所以在網(wǎng)絡(luò)消費(fèi)飛速發(fā)展的今天,完善網(wǎng)絡(luò)消費(fèi)者權(quán)益保護(hù)的立法顯得十分重要。本文擬就在法律層面對(duì)網(wǎng)絡(luò)消費(fèi)者權(quán)益的保護(hù)進(jìn)行研究,提出了在網(wǎng)絡(luò)消費(fèi)過(guò)程中消費(fèi)者權(quán)益保護(hù)面臨的法律方面的問(wèn)題,包括知情權(quán)、隱私權(quán)、經(jīng)營(yíng)者濫用格式合同、公平交易權(quán)、獲得賠償權(quán)等一些權(quán)益的缺失對(duì)消費(fèi)者在網(wǎng)絡(luò)購(gòu)物時(shí)造成的損害,然后針對(duì)這些問(wèn)題的發(fā)現(xiàn)分析,提出了保護(hù)網(wǎng)絡(luò)消費(fèi)者權(quán)益的對(duì)策,這些對(duì)策涵蓋了很多方面,不僅包括立法層面,還包括司法、行政執(zhí)法、社會(huì)公眾的參與以及消費(fèi)者自身的維權(quán)和自我保護(hù)意識(shí)的提高這幾個(gè)方面來(lái)全面的對(duì)網(wǎng)絡(luò)消費(fèi)者權(quán)益的保護(hù)進(jìn)行立體式的制度構(gòu)建,以期達(dá)到在網(wǎng)絡(luò)消費(fèi)領(lǐng)域?qū)οM(fèi)者權(quán)益的保護(hù)能夠與傳統(tǒng)消費(fèi)者權(quán)益保護(hù)不相上下甚至超過(guò)傳統(tǒng)消費(fèi)者權(quán)益保護(hù)的制度構(gòu)建。
[Abstract]:With the rapid development of Internet technology, it is undeniable that the development of the information industry has brought a lot of convenience to our life, and the network has provided many online services for our life, breaking through the limitations of time and region.Especially, with the decrease of transaction cost and the improvement of transaction efficiency, the network transaction, a new electronic commerce mode, is popular among the general operators and consumers. In the network transaction, the operators do not have to spend a huge amount of rent.There is no need to hire some service personnel, which greatly reduces the operating costs; for consumers, there is no need to spend a lot of time in the process of spending on the Internet to meet their own consumption needs, nor to go all the way to a place to choose and purchase local characteristics.As long as you turn on your computer and click on the Web, you can spend it on the web, saving time, energy, and a lot of intermediate links because of online transactions.The price of goods or services will be much cheaper than that of traditional physical stores, so it will also have a great advantage in the price of online transactions.With these advantages, the network transaction will be more and more popular in the future life, and the scope will gradually expand, but also bring huge economic benefits to the society.After analyzing and acknowledging the huge advantage of network transaction, it can not be ignored that because of the fundamental difference between network transaction and traditional transaction, it also exposes the defects of network transaction relative to traditional transaction in many aspects.Especially in the protection of consumers' rights and interests, in online transactions, there is a serious information asymmetry between operators and consumers, which leads consumers who are in a relatively weak position to face greater deficiencies in the protection of their rights and interests.In the traditional consumer field, the main legal norms for the protection of consumers' rights and interests are "General principles of Civil Law", "contract Law", "Consumer Rights and interests Protection Law", and so on. In the field of online consumption, laws in this area still rely mainly on these legal norms.There is very few specific legislation for the protection of the rights and interests of Internet consumers. Obviously, because of the huge contrast between online consumption and traditional consumption, these traditional legislations are no longer sufficient to meet the needs of protecting the rights and interests of Internet consumers.Therefore, with the rapid development of internet consumption, it is very important to perfect the legislation of protecting the rights and interests of internet consumers.This paper studies the protection of network consumers' rights and interests at the legal level, and puts forward the legal problems in the process of network consumption, including the right to know, the right to privacy, the operators abusing the format contract.The loss of some rights and interests, such as the right to fair trade and the right to compensation, caused damage to consumers when shopping on the Internet. Then, based on the analysis of the findings of these problems, the countermeasures to protect the rights and interests of online consumers are put forward, which cover many aspects.Not only at the legislative level, but also at the judicial and administrative levels,The participation of the public and the improvement of consumers' awareness of protecting their rights and interests in order to build a three-dimensional system for the protection of the rights and interests of consumers on the Internet.In order to achieve the protection of consumers' rights and interests in the field of network consumption can equal or even exceed the protection of traditional consumer rights and interests of the construction of the system.
