【摘要】：信息技術(shù)高速發(fā)展的當(dāng)下,巨量的、類(lèi)型繁多的數(shù)據(jù)每天以驚人的速度從微博、微信等社交媒體、門(mén)戶(hù)網(wǎng)站和物聯(lián)網(wǎng)中產(chǎn)生著,并且數(shù)據(jù)的增長(zhǎng)速度還會(huì)越來(lái)越迅速,大數(shù)據(jù)時(shí)代已經(jīng)無(wú)可爭(zhēng)辯地來(lái)了。大數(shù)據(jù)開(kāi)啟了一次重大的時(shí)代轉(zhuǎn)型,它變革公共衛(wèi)生、引發(fā)商業(yè)革命、促使思維變革。大數(shù)據(jù)在給我們生活帶來(lái)便利的同時(shí),也使在互聯(lián)網(wǎng)時(shí)期就已經(jīng)很?chē)?yán)重的隱私權(quán)問(wèn)題變得更加突出。由于大數(shù)據(jù)體量龐大,種類(lèi)繁多,個(gè)人隱私處于前所未有的威脅之中,互聯(lián)網(wǎng)時(shí)代的隱私權(quán)保護(hù)政策已經(jīng)失效。本文采取文獻(xiàn)檢索法、案例分析法、比較分析法等研究方法,對(duì)大數(shù)據(jù)、隱私權(quán)進(jìn)行了全面的理論分析,厘清大數(shù)據(jù)的概念、特點(diǎn)和隱私權(quán)的歷史緣起、概念發(fā)展以及隨著技術(shù)的不斷進(jìn)步隱私權(quán)內(nèi)容的變化;在此基礎(chǔ)上分析大數(shù)據(jù)對(duì)隱私權(quán)的沖擊,并分析大數(shù)據(jù)沖擊隱私權(quán)的原因、大數(shù)據(jù)沖擊隱私權(quán)的方式以及大數(shù)據(jù)沖擊隱私權(quán)的特殊性;最后討論大數(shù)據(jù)發(fā)展與當(dāng)前隱私權(quán)保護(hù)之間的困局;最終具體問(wèn)題具體分析,從法律法規(guī)的制定、行業(yè)自律、媒體社會(huì)責(zé)任的履行、媒介素養(yǎng)的提高以及隱私文化的培育五方面,提出隱私權(quán)保護(hù)的可能辦法。
[Abstract]:With the rapid development of information technology, huge amounts of data of various types are produced at an amazing rate every day from social media such as Weibo, WeChat, portals and the Internet of things, and the data will grow more and more rapidly. Big data's time has come indisputably. Big data has opened a major transformation of the times, which has transformed public health, triggered a business revolution, and promoted a change in thinking. Big data has brought convenience to our lives at the same time. It also makes the privacy issue, which has already been serious in the Internet period, even more prominent. Because big data has a large body size and a wide variety of types, his personal privacy is under unprecedented threat. The policy of privacy protection in the Internet age has failed. This paper adopts the methods of literature retrieval, case analysis, comparative analysis and other research methods, carries out a comprehensive theoretical analysis of big data and privacy, and clarifies the concept of big data. On the basis of analyzing the impact of big data on the right of privacy, and analyzing the reasons for the impact on the right of privacy, the author also analyzes the reasons for the impact of big data on the right of privacy. Big data's way of attacking the right of privacy and the particularity of big data's impact on the right of privacy; finally, it discusses the dilemma between the development of big data and the protection of the right to privacy; finally, the specific problems are concretely analyzed, from the formulation of laws and regulations, the self-discipline of the industry, The possible ways to protect the right of privacy are put forward in five aspects: the fulfillment of media social responsibility, the improvement of media literacy and the cultivation of privacy culture.
