【摘要】：土地關(guān)系到我國社會穩(wěn)定與經(jīng)濟(jì)可持續(xù)的發(fā)展。在對土地進(jìn)行管理和土地市場秩序進(jìn)行維護(hù)整治的過程中,土地執(zhí)法監(jiān)察是非常重要的手段和工具。隨著城市化進(jìn)程的不斷推進(jìn),經(jīng)濟(jì)發(fā)展與土地使用的矛盾日益突出,違法用地現(xiàn)象頻發(fā),土地執(zhí)法監(jiān)察也陷入了“發(fā)現(xiàn)難、查處難、執(zhí)法難”的困境,如何破解這種情況變得十分重要。本文在前人研究的基礎(chǔ)上,結(jié)合工作實(shí)際,運(yùn)用公共管理知識從多個角度分析當(dāng)前德化縣土地執(zhí)法監(jiān)察現(xiàn)狀,指出其中存在的問題及其原因。通過分析,并吸取國內(nèi)土地執(zhí)法監(jiān)察先進(jìn)經(jīng)驗(yàn),本文提出德化縣土地執(zhí)法監(jiān)察存在問題的一些對策建議,一是加強(qiáng)土地執(zhí)法監(jiān)察法律制度的建設(shè),包括加大土地管理法律法規(guī)宣傳力度和完善相關(guān)土地執(zhí)法監(jiān)察法律法規(guī);二是改革現(xiàn)有國土資源管理體制,包括實(shí)行國土資源部門完全垂直管理,保持土地執(zhí)法監(jiān)察獨(dú)立性,建立省內(nèi)土地督察制度;三是加強(qiáng)土地執(zhí)法監(jiān)察聯(lián)動機(jī)制、動態(tài)巡查責(zé)任機(jī)制、全民參與監(jiān)督機(jī)制、違法用地通報公示機(jī)制、隊(duì)伍考核機(jī)制、執(zhí)法監(jiān)察表彰激勵機(jī)制等相關(guān)機(jī)制的建設(shè);四是疏堵結(jié)合,改革違法用地處理方式�；鶎油恋貓�(zhí)法監(jiān)察工作是國土資源管理的基礎(chǔ)和前提,本文探討研究德化縣土地執(zhí)法監(jiān)察之困與解決之道,希望對整個國土資源執(zhí)法監(jiān)察體系具有一定的啟示作用。
[Abstract]:Land is related to the social stability and sustainable economic development of our country. In the process of land management and land market order maintenance and renovation, Land law enforcement and supervision is a very important means and tool. With the development of urbanization, the contradiction between economic development and land use is increasingly prominent, the phenomenon of illegal land use occurs frequently, and the supervision of land law enforcement also falls into "difficult to find, investigate and deal with." How to solve this situation has become very important. On the basis of previous studies and combined with the work practice, this paper analyzes the present situation of land law enforcement and supervision in Dehua County from many angles by using public management knowledge. This paper points out the existing problems and their causes. By analyzing and drawing on the advanced experience of land law enforcement and supervision in China, this paper puts forward some countermeasures and suggestions for the existing problems of land law enforcement supervision in Dehua County. First, to strengthen the construction of the legal system of land law enforcement and supervision, including increasing the publicity of land management laws and regulations and to improve the relevant laws and regulations on land law enforcement and supervision; and second, to reform the existing land and resources management system. Including the implementation of complete vertical management of land and resources departments, the maintenance of the independence of land law enforcement and supervision, and the establishment of a land supervision system in the province; third, strengthening the linkage mechanism of land law enforcement and supervision, the mechanism of dynamic inspection responsibility, and the participation of the whole people in the supervision mechanism. The construction of related mechanisms, such as the mechanism of public notification of illegal land use, the mechanism of team assessment, the mechanism of law enforcement, supervision and recognition, and the incentive mechanism; fourth, the combination of dispersing and blocking, It is the foundation and premise of land resources management to reform the illegal land disposal mode. This paper discusses the difficulties and solutions of land law enforcement and supervision in Dehua County. Hope to the entire land and resources law enforcement supervision system has certain enlightenment function.
