【摘要】：國際投資始于資本主義發(fā)展時期,至1980年以后發(fā)展成為國際經(jīng)濟(jì)交往中最為重要的形式之一。在此階段,為吸引和保護(hù)國際投資,國際投資協(xié)定應(yīng)運(yùn)而生。隨著國際投資活動的廣泛深入發(fā)展、全球環(huán)境惡化,國際投資與環(huán)境保護(hù)間的關(guān)系日益受到國際社會的關(guān)注,環(huán)境保護(hù)條款被不同程度地納入了國際投資協(xié)定,并不斷發(fā)展完善。如何平衡投資利益和東道國環(huán)境公益、妥善處理投資與環(huán)境間的關(guān)系,成為外國學(xué)者們研究的熱點(diǎn)。反觀國內(nèi),中國在國際投資活動的身份已經(jīng)發(fā)生了變化:從單純的外資輸入國轉(zhuǎn)變?yōu)榫哂型赓Y輸入和資本輸出雙重身份的發(fā)展中大國,以往的投資政策已難以應(yīng)對新局勢。建立于這一認(rèn)識基礎(chǔ)之上,本文對現(xiàn)有國際投資協(xié)定中的環(huán)境保護(hù)條款及相關(guān)案例進(jìn)行研究分析,發(fā)現(xiàn)存在的問題,并結(jié)合我國的現(xiàn)狀,對國際投資及環(huán)境保護(hù)提出自己的觀點(diǎn)。除導(dǎo)語和結(jié)語外,本文共分四章:第一章介紹環(huán)境保護(hù)條款納入國際投資協(xié)定的背景,闡述環(huán)境保護(hù)條款納入國際投資協(xié)定的緣由和正當(dāng)性。第二章為國際投資協(xié)定中環(huán)境保護(hù)條款的內(nèi)容。本章通過橫向、縱向?qū)Ρ?并著重對具有代表性的投資協(xié)定文本進(jìn)行分析,梳理國際投資協(xié)定中環(huán)境保護(hù)條款的發(fā)展脈絡(luò)。第三章為國際投資與環(huán)境保護(hù)的沖突與協(xié)調(diào)。本章對國際投資仲裁案件進(jìn)行剖析,闡述產(chǎn)生沖突的根源,并提出協(xié)調(diào)的辦法。第四章為我國的實(shí)踐、不足和對策。本章對我國的實(shí)踐做法進(jìn)行研究,發(fā)現(xiàn)存在的不足,并提出符合國情的對策。
[Abstract]:International investment began during the period of capitalist development and became one of the most important forms of international economic interaction after 1980. In order to attract and protect international investment, With the extensive development of international investment activities and the deterioration of the global environment, the relationship between international investment and environmental protection has become increasingly concerned by the international community. Environmental protection provisions have been incorporated into international investment agreements to varying degrees, and have been continuously developed and improved. How to balance investment interests with the environmental public good of the host country, and how to properly handle the relationship between investment and the environment, China's status in international investment activities has changed: from a purely foreign investment importing country to a developing country with a dual status of foreign capital import and capital export. The previous investment policy has been difficult to cope with the new situation. Based on this understanding, this paper studies and analyzes the environmental protection clauses and related cases in the existing international investment agreements, finds out the existing problems, and combines the current situation of our country. In addition to the introduction and conclusion, this paper is divided into four chapters: the first chapter introduces the background of the inclusion of environmental protection clauses into international investment agreements. Chapter two is the content of environmental protection clauses in IIAS. And focusing on the analysis of representative texts of investment agreements, Chapter three is the conflict and coordination between international investment and environmental protection. The fourth chapter is the practice, deficiency and countermeasure of our country. This chapter studies the practice practice of our country, finds out the deficiency, and puts forward the countermeasure that accords with the situation of our country.
