【摘要】：能源作為國(guó)家最為重要的戰(zhàn)略性公共產(chǎn)品,是經(jīng)濟(jì)發(fā)展、社會(huì)進(jìn)步的源動(dòng)力,在環(huán)境污染、氣候變化和化石能源日益枯竭的多重挑戰(zhàn)下,以太陽(yáng)能為代表的可再生能源在能源戰(zhàn)略中居于越來(lái)越重要的位置,正在商業(yè)化的光伏發(fā)電產(chǎn)業(yè)必然成為我國(guó)可再生能源開發(fā)利用的重點(diǎn)。但由于產(chǎn)業(yè)本身的特殊屬性和對(duì)政策的依賴性在發(fā)展進(jìn)程中也凸顯出諸多問題,面臨著產(chǎn)能過剩、市場(chǎng)不穩(wěn)定、行業(yè)標(biāo)準(zhǔn)及監(jiān)管力度不到位等不利因素。當(dāng)前我國(guó)光伏發(fā)電產(chǎn)業(yè)正處于轉(zhuǎn)型階段,承載著諸多利益分配問題,現(xiàn)實(shí)中的亂象表明產(chǎn)業(yè)結(jié)構(gòu)調(diào)整不能僅依賴于政策投入,這就不可避免的需要求助于法律的邏輯,透過法律制度加以規(guī)范。然而我國(guó)以《可再生能源法》為主導(dǎo)的可再生能源立法在內(nèi)容上還不盡健全,相關(guān)法律保障制度、經(jīng)濟(jì)激勵(lì)制度以及監(jiān)管制度的不成熟,無(wú)法支撐和保障光伏發(fā)電產(chǎn)業(yè)的有序發(fā)展。只有將制度的經(jīng)驗(yàn)予以具體化,并通過法律本身所賦予的公平理性理念,將制度貫穿于生產(chǎn)、供應(yīng)、流通、消費(fèi)等各環(huán)節(jié),強(qiáng)調(diào)以立法形式加以支撐,才能深化推動(dòng)光伏產(chǎn)業(yè)健康持續(xù)發(fā)展。產(chǎn)業(yè)發(fā)展問題向來(lái)是牽一發(fā)而動(dòng)全身,本文首先直面我國(guó)光伏發(fā)電產(chǎn)業(yè)在發(fā)展進(jìn)程中暴露出的問題,通過對(duì)當(dāng)前領(lǐng)域普遍存在的、急需回答的問題進(jìn)行分析,引出產(chǎn)業(yè)的良性發(fā)展必然需要法律的支撐和保證。接下來(lái)對(duì)我國(guó)光伏發(fā)電產(chǎn)業(yè)相關(guān)法律法規(guī)的概況進(jìn)行梳理,并對(duì)具體法律制度加以闡述,透過立法與實(shí)踐的分析,發(fā)現(xiàn)在實(shí)施中還存在總量目標(biāo)制度缺乏制定依據(jù)、強(qiáng)制上網(wǎng)制度推進(jìn)困難、經(jīng)濟(jì)激勵(lì)落實(shí)不到位等問題,有待于進(jìn)一步完善。最后,有針對(duì)性的提出適合產(chǎn)業(yè)發(fā)展的相關(guān)法律制度完善建議,構(gòu)建政府引導(dǎo)、市場(chǎng)調(diào)節(jié)與法律保障有機(jī)結(jié)合的制度結(jié)構(gòu)。對(duì)于符合產(chǎn)業(yè)發(fā)展方向并發(fā)揮作用的法律法規(guī)應(yīng)當(dāng)繼續(xù)落實(shí),注重結(jié)合產(chǎn)業(yè)現(xiàn)狀及時(shí)對(duì)具體制度進(jìn)行調(diào)整和完善,確保相關(guān)激勵(lì)制度落實(shí)到位,加快技術(shù)創(chuàng)新的同時(shí)推進(jìn)標(biāo)準(zhǔn)的認(rèn)證,構(gòu)建有利于產(chǎn)業(yè)發(fā)展的法律保障體系。希望借由政策與法制的觀察,為今后光伏發(fā)電產(chǎn)業(yè)健康有序的發(fā)展提供更多的借鑒。
[Abstract]:Energy, as the most important strategic public product of the country, is the source of economic development and social progress. Under the multiple challenges of environmental pollution, climate change and the increasing depletion of fossil energy, Renewable energy, represented by solar energy, plays an increasingly important role in energy strategies. The commercial photovoltaic power generation industry is bound to become the focus of renewable energy development and utilization in China. However, due to the special attributes of the industry itself and the dependence on policies, there are also many problems in the development process, and the industry is faced with overcapacity. The market is unstable, the industry standards and supervision are not in place, and so on. At present, the photovoltaic power generation industry in our country is in the transition stage, carrying many problems of benefit distribution. The chaos in reality shows that the adjustment of industrial structure cannot depend solely on policy input, which inevitably needs to resort to the logic of law. However, the legislation on renewable energy, which is dominated by the Renewable Energy Law, is not perfect in content, and the relevant legal protection system, economic incentive system and supervision system are immature. It is impossible to support and guarantee the orderly development of photovoltaic power generation industry. Only by concretizing the experience of the system, and through the fair and rational concept given by the law itself, will the system run through all aspects of production, supply, circulation, consumption, etc. It is emphasized that only by means of legislation can we deepen and promote the healthy and sustainable development of the photovoltaic industry. The problem of industry development has always been a drag on the whole body. This paper first faces the problems exposed in the development process of the photovoltaic power generation industry in our country. Through the analysis of the existing and urgent problems in the current field, we can draw the conclusion that the benign development of the industry must be supported and guaranteed by the law. Then, the general situation of the laws and regulations related to the photovoltaic power generation industry in China is sorted out. Through the analysis of legislation and practice, it is found that there are still some problems in the implementation of the system, such as the lack of basis for the establishment of the gross target system, the difficulty of pushing forward the compulsory Internet access system, and the lack of implementation of economic incentives, etc. Finally, the relevant legal system suitable for the development of industry should be put forward, and the guidance of the government should be established. The institutional structure of the organic combination of market regulation and legal protection. Laws and regulations that conform to the direction of industrial development and play a role should continue to be implemented, focusing on timely adjustment and improvement of specific systems in the light of the current situation of the industry. To ensure that relevant incentive systems are put in place, to speed up technological innovation and to promote the certification of standards, and to build a legal protection system conducive to industrial development. For the future photovoltaic power generation industry healthy and orderly development to provide more reference.
