【摘要】:黨的十八大以來(lái),全面推進(jìn)依法治國(guó),社會(huì)主義法治的理念深入人心,各級(jí)政府對(duì)依法治國(guó)、依法行政高度重視。作為依法行政的重要環(huán)節(jié),公務(wù)員的績(jī)效考核的重要性可見(jiàn)一斑。為此,迫切需要開(kāi)展公務(wù)員績(jī)效考核活動(dòng),從而完善我國(guó)的公務(wù)員績(jī)效考核法治化制度,全面推進(jìn)政務(wù)公開(kāi)、依法行政。但是,目前我國(guó)公務(wù)員績(jī)效考核法治化還沒(méi)有一套完整的指標(biāo)體系,同時(shí)在科學(xué)化、法治化、系統(tǒng)化層面又不夠全面。公務(wù)員績(jī)效考核是依法行政、建設(shè)法治政府的重要不可或缺的一部分。目前,我國(guó)公務(wù)員績(jī)效考核法治化的辦法都已經(jīng)或正在被制定,但是這些辦法、措施要達(dá)到公務(wù)員績(jī)效考核法治化的水平還為時(shí)尚早。表現(xiàn)為考核辦法單一、指標(biāo)不科學(xué)、考核綜合體系尚未建立。借鑒世界各國(guó)具體的做法和已經(jīng)取得的成果,再對(duì)照我國(guó)公務(wù)員績(jī)效考核法治化的現(xiàn)狀,要實(shí)現(xiàn)我國(guó)公務(wù)員績(jī)效考核的規(guī)范化、合理化發(fā)展就必須完善相關(guān)公務(wù)員績(jī)效考核法律法規(guī)進(jìn)而形成完善的公務(wù)員績(jī)效考核法律制度,更好的實(shí)現(xiàn)政府切實(shí)履行職能、實(shí)現(xiàn)依法行政。文章從以下幾個(gè)方面展開(kāi)論述:第一部分主要講述公務(wù)員績(jī)效考核法治化的意義。上世紀(jì)70~80年代西方發(fā)達(dá)國(guó)家普遍實(shí)行行政改革運(yùn)動(dòng),在此次改革中公務(wù)員公務(wù)員績(jī)效考核是改革的重點(diǎn),得到了政府和民眾的重點(diǎn)關(guān)注。而我國(guó)從上世紀(jì)90年代才開(kāi)始引入公務(wù)員績(jī)效考核制度,該制度在我國(guó)的起步較晚,各方面都不太成熟。我國(guó)歷史上沒(méi)有公務(wù)員績(jī)效考核這一傳統(tǒng),又由于歷史原因、人為因素、法治尚未完善都對(duì)我國(guó)公務(wù)員績(jī)效考核提出了挑戰(zhàn)。在公務(wù)員績(jī)效考核法治化中,首先要弄清楚績(jī)效的定義,才能更進(jìn)一步的采取考核措施,總體來(lái)看我國(guó)的公務(wù)員績(jī)效的定義具有多樣化,包含人們生產(chǎn)和行為導(dǎo)致的各種結(jié)果,在很大程度上更加傾向于行為結(jié)果?己说囊馑急容^通俗易懂,他表達(dá)的是估量、評(píng)價(jià)和考察的意思?(jī)效考核其實(shí)可以簡(jiǎn)單的看作運(yùn)用各種方法和手段對(duì)公務(wù)員在工作中綜合表現(xiàn)進(jìn)行的客觀評(píng)價(jià)。文章介紹了西方發(fā)達(dá)國(guó)家美國(guó)、英國(guó)、日本主要績(jī)效考核法律制度,其中著重闡述了美國(guó)公務(wù)員績(jī)效考核法律制度和英國(guó)公務(wù)員績(jī)效考核的指標(biāo)體系。之后要重點(diǎn)分析了我國(guó)公務(wù)員績(jī)效考核法治化建設(shè)的意義:有助于統(tǒng)一我國(guó)公務(wù)員績(jī)效考核方式、有助于確定績(jī)效考核權(quán)、有助于績(jī)效考核活動(dòng)開(kāi)展和落實(shí)結(jié)果。完善的公務(wù)員管理系統(tǒng)需要一個(gè)高度法治化的公務(wù)員績(jī)效考核體系,政府部門(mén)具有自己本身的公共屬性,因此,公務(wù)員績(jī)效考核不同于企業(yè)的績(jī)效考核原則。第二部分主要講述我國(guó)當(dāng)前公務(wù)員績(jī)效考核法治化建設(shè)所存在的主要問(wèn)題。我國(guó)從上世紀(jì)90年代開(kāi)始實(shí)行公務(wù)員績(jī)效考核制度,從中央到地方都開(kāi)始實(shí)行公務(wù)員績(jī)效考核法治化制度,并頒布一些法規(guī)、政策等,取得了一定的成果,對(duì)改進(jìn)公務(wù)員工作,提升政府行政效能具有重要意義。但是我們也應(yīng)當(dāng)看到我國(guó)推行績(jī)效考核時(shí)間并不長(zhǎng),相關(guān)法律法規(guī)并不完善,很多地方公務(wù)員績(jī)效考核存在的問(wèn)題開(kāi)始凸顯。第三部分講述推進(jìn)公務(wù)員績(jī)效考核法治化建設(shè)的具體對(duì)策。從完善公務(wù)員績(jī)效考核法治化的內(nèi)容、完善公務(wù)員績(jī)效考核法治化的方式、科學(xué)設(shè)置公務(wù)員績(jī)效考核的指標(biāo)體系、完善公務(wù)員績(jī)效考核法治化的救濟(jì)制度四個(gè)層面展開(kāi),相信我國(guó)的公務(wù)員績(jī)效考核法治化將會(huì)越走遠(yuǎn)。
[Abstract]:Of the party since eighteen, comprehensively promote the rule of law, people's governments at all levels of socialist rule of law concept, rule of law, administrative law attaches great importance. As an important part of the administration according to law, the performance appraisal of civil servants remarkable importance. Therefore, it is urgent to carry out the civil service performance appraisal activities, so as to improve the civil service performance appraisal law system in China and comprehensively promote open government, administration according to law. However, the civil service performance appraisal of China's rule of law is not a set of complete index system, at the same time, the rule of law in a scientific, systematic and comprehensive enough. The level of civil servant performance appraisal is an important part of the administration according to law, an integral part of the construction of the government by law. At present, civil servant the performance evaluation of China's rule of law means have been or are being developed, but these measures, measures to achieve the rule of performance appraisal of civil servants It is too early. The level of performance for the single index assessment method, is not scientific, comprehensive evaluation system has not been established. The model various countries specific practices and achievements, and then control the status quo of China's civil servants performance appraisal of the rule of law, in order to realize the performance appraisal of civil servants in China standardization, rationalization development must improve the relevant laws and regulations of civil servants performance appraisal and performance appraisal of civil servants formed the perfect legal system, realize the government to better perform its functions effectively, realize the administrative law. This article discusses the following aspects: the first part is mainly about the performance appraisal of civil servants under the rule of law. The western developed countries last century 70~80's widespread implementation of administrative reform in sports. The reform of civil servants performance appraisal is the key point of the reform, the focus of the government and people of China from the world. In 90s it began to introduce the civil service performance appraisal system, the system started late in China, all aspects are not mature. There is no performance appraisal of civil servants this tradition in the history of our country, but due to historical reasons, human factors, the rule of law has not been perfect for our country civil servants performance appraisal in civil servant performance challenges. The assessment of rule of law, first to clarify the definition of performance, in order to further take measures, China's overall performance has defined diversification, various results include production and people's behavior leads to a great extent, more inclined to behavior results. Assessment means more user-friendly, his expression is measure, evaluation and examination of the meaning of performance appraisal. It might be as simple as using various methods and means of objective evaluation of comprehensive performance of civil servants in the work of the article. The western developed countries, the United States, Britain, Japan's main performance appraisal legal system, which focuses on the performance appraisal of civil servants and the legal system of the British civil service performance evaluation index system. Then to focus on the analysis of the performance appraisal of Civil Servants Law in our country the construction of meaning: help to unify the evaluation performance of civil servant of our country, there are to help determine the performance appraisal rights, contribute to the performance appraisal activities and results. The implementation of civil service management system to improve the civil service performance appraisal system to a height of the rule of law, government departments have their own public property, therefore, the civil service performance appraisal is different from the enterprise performance appraisal principles. The second part is mainly about the main problems China's current performance appraisal of civil servants law construction exists. China began to implement the civil servants performance appraisal system from the last century in 90s Degree, from the central to local governments have started to implement the performance appraisal of civil servants law system, and promulgated some regulations, policies, and achieved certain results, to improve the work of civil servants, has important significance to enhance the administrative efficiency. But we should also see China's implementation of the performance appraisal is not a long time, relevant laws and regulations is not perfect. There are many places in the performance appraisal of civil servants began to highlight the problem. The third part is about the specific measures to promote the construction of rule of law, the civil service performance appraisal. From the consummation of the civil service performance appraisal of the rule of law, improve the civil service performance appraisal of the rule of law, set up a scientific civil servant performance appraisal index system, improve the performance appraisal of civil servants law relief four aspects system, believe that the civil service performance appraisal of rule of law in China will farther away.
