【摘要】：本文正文部分一共分為五章,運用文獻閱讀法和比較分析法,從法治角度解析疫苗監(jiān)管,關(guān)注在疫苗研發(fā)、審批上市、生產(chǎn)、流通、使用、售后全過程中的疫苗監(jiān)管行為和應遵守的法理根據(jù)。前言部分:簡述本文選題作為研究對象的原因,介紹疫苗監(jiān)管的研究現(xiàn)狀及選題的理論與實踐意義。理論意義如風險預防理論,實踐意義指通過在法治方面完善疫苗監(jiān)管,保障疫苗從研發(fā)到使用的安全、有效、科學、可及、推進我國疫苗接種工作有序開展保障公共健康,同時也有助于引導我國疫苗生產(chǎn)企業(yè)對疫苗的研發(fā),增強我國疫苗生產(chǎn)企業(yè)在國際疫苗市場的競爭力,帶動我國經(jīng)濟的發(fā)展。第一章疫苗監(jiān)管的一般理論,對疫苗以及疫苗監(jiān)管等概念進行解釋,區(qū)分疫苗監(jiān)管與其他監(jiān)管的不同,簡述疫苗監(jiān)管歷史變遷并分析其內(nèi)在原因,主要是公共利益與個人利益之間的法益衡量,指出疫苗監(jiān)管的重要意義。第二章從實踐中的問題疫苗事件引入疫苗監(jiān)管必要性的理論根據(jù),主要是風險預防理論,進而論述從法治角度完善疫苗監(jiān)管的必要性。同時分析疫苗監(jiān)管法治對我國法治建設(shè)的利弊兩方面的影響。結(jié)合理論與實踐,剖析疫苗監(jiān)管法律制度的基本內(nèi)容,主要是疫苗監(jiān)管法律關(guān)系中各法律主體從疫苗研發(fā)到售后全過程中的權(quán)利義務,明確監(jiān)管主體的法律責任。第三章從我國疫苗監(jiān)管的范圍、方式中指出我國疫苗監(jiān)管法治存在的問題,并探究問題背后的法理原因,主要是公權(quán)力濫用和個人權(quán)利未得到保障。第四章概述國外疫苗監(jiān)管法治現(xiàn)狀,在運用比較分析研究方法的基礎(chǔ)上找出對我國疫苗監(jiān)管法治的啟示。第五章提出完善我國疫苗監(jiān)管法治的原則和具體路徑。指出強制接種疫苗的法律標準,明確國家救濟責任。在互聯(lián)網(wǎng)時代下方便公民及時獲知疫苗相關(guān)信息,在救濟資金來源上引入保險和風險分散承擔的方式。結(jié)語部分:總結(jié)本文全文行文思路并強調(diào)疫苗監(jiān)管法治的重要性,對我國疫苗監(jiān)管法治的發(fā)展寄予厚望。
[Abstract]:The text of this paper is divided into five chapters, using literature reading method and comparative analysis method, analyzing vaccine supervision from the perspective of rule of law, focusing on vaccine research and development, approval, listing, production, circulation and use. Introduction: brief introduction to the reasons why this topic was chosen as the object of study. This paper introduces the current research situation of vaccine supervision and the theoretical and practical significance of choosing the topic. The theoretical meaning, such as risk prevention theory, and the practical significance, means that the vaccine can be safely, effectively, scientifically and accessible from the research and development to the use of the vaccine by perfecting the regulation of vaccine in accordance with the rule of law. To promote the orderly development of vaccination in China to safeguard public health, and at the same time to help guide Chinese vaccine manufacturers to develop vaccines, and to enhance the competitiveness of Chinese vaccine manufacturers in the international vaccine market. The first chapter is the general theory of vaccine supervision, which explains the concept of vaccine and vaccine supervision, distinguishes vaccine supervision from other supervision, briefly describes the historical changes of vaccine supervision and analyzes its internal reasons. The second chapter points out the significance of vaccine supervision. The second chapter introduces the theoretical basis of the necessity of vaccine supervision from practical problems, mainly the theory of risk prevention. Then it discusses the necessity of perfecting vaccine supervision from the angle of rule of law, analyzes the influence of the rule of law of vaccine supervision on the construction of rule of law in our country, and analyzes the basic contents of the legal system of vaccine supervision in combination with theory and practice. It is mainly about the rights and obligations of the legal subjects in the legal relationship of vaccine supervision from vaccine research and development to the whole process of after-sale. The third chapter focuses on the scope of vaccine supervision in China. In this way, the author points out the problems existing in the rule of law of vaccine supervision in China, and probes into the legal reasons behind the problems, mainly the abuse of public power and the lack of protection of individual rights. Chapter 4th outlines the current situation of the rule of law in foreign vaccine supervision. On the basis of comparative analysis and research methods, the author finds out the enlightenment to the rule of law of vaccine supervision in China. Chapter 5th puts forward the principles and specific ways to perfect the rule of law of vaccine supervision in China, and points out the legal standard of compulsory vaccination. Make clear the responsibility of national relief. In the Internet era, it is convenient for citizens to get timely information about vaccines, The conclusion part summarizes the ideas of this paper and emphasizes the importance of the rule of law of vaccine supervision, and places great hope on the development of the rule of law of vaccine supervision in our country.
