【摘要】：按撤訴處理,是指法院根據(jù)法律規(guī)定,基于提出訴的原告當(dāng)事人特定的不作為,而終結(jié)訴訟程序并撤銷該案件的行為。作為撤訴制度的重要組成部分,自1982年《民事訴訟法(試行)》開始,按撤訴處理制度便一直存在于我國民事訴訟體系中。在司法實(shí)踐中,由于按撤訴處理制度本身立法上的不足,給予了法官異化適用按撤訴處理的機(jī)會,導(dǎo)致了按撤訴處理制度的立法價值難以實(shí)現(xiàn)。因此,要根治按撤訴處理制度的異化適用現(xiàn)象、彌補(bǔ)制度本身的不足,就需要結(jié)合按撤訴處理制度的理論基礎(chǔ)和汲取域外相關(guān)制度中的優(yōu)秀立法,對立法進(jìn)行完善,以實(shí)現(xiàn)該制度本來的價值。本論文除前言、結(jié)語外,共有四章,分別圍繞按撤訴處理的理論研究、適用現(xiàn)狀、立法分析、域外借鑒與完善來展開論述,各部分主要內(nèi)容如下:前言:概述按撤訴處理制度,簡要交代本文的寫作背景與寫作要點(diǎn)。第一章:對按撤訴處理的基本理論做出較為全面的分析。包括概念辨析、理論依據(jù)、制度功能。第二章:對按撤訴處理制度異化適用的現(xiàn)狀審視。包括對適用現(xiàn)狀的描述、異化適用的原因、異化適用的后果。第三章:對按撤訴處理制度立法上的分析。第四章:對域外相關(guān)立法的比較與借鑒以及論述具體的完善路徑。對于域外相關(guān)立法的比較與借鑒部分,本文主要選取了美國、日本、法國、俄羅斯以及德國的相關(guān)制度作為比較的對象,在經(jīng)過與域外相關(guān)立法比較后,獲得完善我國按撤訴處理制度的啟示。最后結(jié)合前述的分析,論述了完善我國按撤訴處理制度的具體方法。結(jié)語:總結(jié)本論文的大概內(nèi)容,并指出論文中存在的不足之處。
[Abstract]:According to the case, is refers to the court according to the law, not as the plaintiff party specific lawsuit based on the end procedure and the revocation of the case. As an important part of withdrawal system, since 1982 "Civil Procedure Law (Trial)", as a case handling system has been existed in China's civil litigation system. In judicial practice, due to lack of legislation on the processing system itself as a case, the judge gave the opportunity for treatment by withdrawal of alienation, led to the legislative value of treatment system as a case is difficult to achieve. Therefore, to eliminate the alienation phenomenon for treatment system as a case, make up for the deficiency of the system itself, you need to on the basis of the theory system as a case and draw in the outstanding legislation extraterritorial related system, to perfect the legislation, in order to realize the value of the original system. In addition to the preface and epilogue, A total of four chapters, respectively around according to theoretical research, case application status, legislative analysis, extraterritorial reference and perfection to discuss, the main content of each part is as follows: Introduction: an overview of treatment by withdrawal system, writing background and writing points a brief explanation in this paper. The first chapter: make a comprehensive analysis on the basic theory of press withdrawal of treatment. Including the concepts, theoretical basis, system function. The second chapter: the survey of treatment status system alienation applicable by withdrawal. Including application of the description of the status quo, reasons for the alienation, alienation results applicable. The third chapter: Analysis on the legislation system as a case. The fourth chapter: the comparison extraterritorial legislation and reference and discusses the specific improvement path. For the comparison and reference of extraterritorial legislation, this paper selected the United States, Japan, France, Russia and Germany to the relevant system As the object of comparison, after comparison and foreign related legislation, to obtain perfect treatment system as a case in our country. Finally, combined with the foregoing analysis, discusses the specific methods to improve the processing system as a case in China. Conclusion: summarize the general content, and pointed out the inadequacies.
