【摘要】：當前,第三者介入婚姻關(guān)系的事件頻頻發(fā)生,婚姻關(guān)系不斷被破壞�？v觀世界各國,大多數(shù)國家有相關(guān)法律規(guī)定制裁第三者,而我國缺乏相應法律規(guī)定,受害方的利益往往得不到維護,不利于家庭和諧以及社會穩(wěn)定。因此,我國立法追究第三者的民事責任具有重要的現(xiàn)實意義。本文共分為四個部分。第一部分,首先論述第三者的概念問題,其次分析第三者介入婚姻關(guān)系的表現(xiàn),最后分析第三者介入婚姻關(guān)系的性質(zhì),得出第三者介入婚姻關(guān)系是侵犯配偶權(quán)的結(jié)論。第二部分,論述我國當前關(guān)于追究第三者民事責任的立法現(xiàn)狀,同時提出存在的問題。第三部分,研究英美法系國家關(guān)于配偶權(quán)和追究第三者民事責任的相關(guān)立法規(guī)定。第四部分,結(jié)合英美法系國家配偶權(quán)的規(guī)定,以及我國立法實踐,提出我國追究第三者介入婚姻關(guān)系的民事責任的立法建議,希望在實踐過程中最大限度的彌補無過錯配偶的損失。
[Abstract]:At present, the incidents of the third party intervening in the marriage relationship occur frequently, and the marriage relationship is constantly destroyed. Throughout the world, most countries have the relevant laws and regulations to punish the third party, but our country lacks the corresponding legal provisions. The interests of the aggrieved parties are often not protected, which is not conducive to family harmony and social stability. Therefore, our legislation to investigate the civil liability of third parties has important practical significance. This paper is divided into four parts. The first part. Firstly, it discusses the concept of the third party, then analyzes the performance of the third party's intervention in the marriage relationship, and finally analyzes the nature of the third party's intervention in the marriage relationship. The second part discusses the current legislative situation of investigating the third party's civil liability in China, and puts forward the existing problems. The third part is the conclusion that the third party's intervention in marriage is an infringement of the spouse's right. The third part discusses the current situation of the legislation on investigating the third party's civil liability. Research on the Anglo-American legal system countries on the spouse right and the third party civil liability related legislative provisions. 4th, combined with the Anglo-American law system countries spouse right provisions, as well as our legislative practice. This paper puts forward the legislative suggestion of investigating the civil liability of the third party to intervene in the marriage relationship, hoping to make up for the loss of the no-fault spouse to the maximum extent in the process of practice.
