【摘要】：隨著科技的迅猛發(fā)展,網(wǎng)絡(luò)越來越深入人們的日常生活。利用網(wǎng)絡(luò)實(shí)施的各種犯罪也越來越多,利用網(wǎng)絡(luò)中侮辱、誹謗他人,利用網(wǎng)絡(luò)非法獲取、販賣他人信息,利用網(wǎng)絡(luò)散布虛假暴恐信息等等。尤其是網(wǎng)絡(luò)詐騙犯罪,幾乎人人都收到過詐騙短信。因此,從2011年起我國人民代表大會(huì)及其常委會(huì)、最高人民法院、最高人民檢察院相繼頒布一系列關(guān)于網(wǎng)絡(luò)詐騙犯罪的法律、司法解釋和典型案例。通過完善保護(hù)公民私人信息的立法,對現(xiàn)有刑法條文的擴(kuò)充解釋,給予法官指導(dǎo)案例等解決網(wǎng)絡(luò)詐騙犯罪的定罪、量刑問題。由于網(wǎng)絡(luò)詐騙犯罪是新型犯罪,沒有大量的司法實(shí)踐做支撐,所以國家舉措都是嘗試性質(zhì)的。各地審判機(jī)關(guān)審理案件當(dāng)中難免出現(xiàn)自由裁量權(quán)過大、定罪標(biāo)準(zhǔn)不一、罪責(zé)刑不相適應(yīng)等問題。本文擬通過對網(wǎng)絡(luò)詐騙犯罪的研究,以期對網(wǎng)絡(luò)詐騙犯罪的定罪、量刑以及預(yù)防提供有助的參考。全文共分為三個(gè)部分。第一部分為引言。主要講述了論文的研究背景及意義、論文的研究方法,以及論文的創(chuàng)新點(diǎn)及研究框架。第二個(gè)部分為網(wǎng)絡(luò)詐騙犯罪的概念。根據(jù)學(xué)術(shù)界和官方對網(wǎng)絡(luò)詐騙犯罪概念的認(rèn)定,對網(wǎng)絡(luò)詐騙犯罪的行為進(jìn)行分類,并對其與詐騙罪進(jìn)行對比分析,找出其中的問題。歸納網(wǎng)絡(luò)詐騙犯罪的特點(diǎn),得出網(wǎng)絡(luò)詐騙犯罪的新概念。第三部分為網(wǎng)絡(luò)詐騙犯罪的幾個(gè)基本問題研究。從網(wǎng)絡(luò)詐騙犯罪的社會(huì)危害性、社會(huì)影響力、理論研究方面論證確立網(wǎng)路詐騙罪的必要性和可行性。并且,對網(wǎng)絡(luò)詐騙罪的構(gòu)成要件、認(rèn)定進(jìn)行研究。
[Abstract]:With the rapid development of science and technology, network becomes more and more deeply in people's daily life. Using a variety of network crime implementation is also more and more, the use of network insult, slander others, use the network illegal access, selling other information, using the Internet to spread false information and so on. Especially the fear of violent crime, almost everyone received SMS fraud therefore, the National People's Congress and its Standing Committee from 2011 onwards, the Supreme People's court, the Supreme People's Procuratorate have promulgated a series of Internet fraud crime law, judicial interpretation and typical cases. By improving the protection of citizens' personal information legislation, the extension of existing provisions of the criminal law interpretation, giving judges guidance to solve the case of conviction. Internet fraud crime sentencing problem. Because of Internet fraud crime is a new crime, no judicial practice to do a lot of support, so the national initiatives are Try to nature. Judicial organs throughout the trial of cases will inevitably lead to excessive discretion, not a standard of conviction, punishment does not adapt to such problems. This paper on the Internet fraud crime, in order to conviction of Internet fraud crime, provide reference for sentencing and prevention. The full text is divided into three parts. The first part is the introduction. Mainly describes the research background and significance, the research methods and the innovation of the paper and the research framework. The second part is the concept of Internet fraud crime. According to the academic and official recognition of the concept of Internet fraud crime, the classification of Internet fraud crime and the crime of fraud, and carries on the contrast analysis, find out the problems. Summarized the characteristics of Internet fraud crime, the new concept of the Internet fraud crime. The third part is the basic Internet fraud crime From the perspective of social harmfulness, social influence and theoretical research, the necessity and feasibility of establishing internet fraud crime are discussed.
