【摘要】：社區(qū)矯正的歷史可以追溯到一百多年前,從世界范圍來看,美國是最早實行社區(qū)矯正的國家之一,在社區(qū)矯正制度的發(fā)展已經(jīng)十分完善,有許多可供世界其他國家借鑒之處。第二次世界大戰(zhàn)以后,社區(qū)矯正制度開始得到較快發(fā)展。作為一種新型的刑罰執(zhí)行方式,與以往監(jiān)禁刑不同的是,社區(qū)矯正是一種開放的行刑,它將罪犯放在開放的社區(qū)環(huán)境中進行矯治。由于社區(qū)矯正制度在保護人權(quán)方面有著更多優(yōu)勢,也有利于罪犯更好地接收改造,融入社會,因此得到了世界各國的普遍認(rèn)同。尤其是在教育刑觀念和恢復(fù)性司法觀念提出后,社區(qū)矯正制度更以高效、文明和人道得到了更快發(fā)展。目前,在許多國家中適用監(jiān)禁刑的罪犯人數(shù)都已低于適用社區(qū)矯正的人數(shù)。本研究以美國的現(xiàn)代社區(qū)矯正制度為例,試圖解釋美國現(xiàn)代社區(qū)矯正制度內(nèi)在的發(fā)展規(guī)律和合理性,為我國社區(qū)矯正的發(fā)展提供借鑒。文章從研究背景和意義入手,介紹了當(dāng)前國內(nèi)外有關(guān)美國社區(qū)矯正的研究現(xiàn)狀,提出了自己的研究方法和研究思路。在界定社區(qū)、社區(qū)矯正等基本概念的基礎(chǔ)上,從"刑罰經(jīng)濟"原則、教育刑思想和恢復(fù)性司法等幾個方面分析了美國社區(qū)矯正思想的理論淵源;從美國社區(qū)矯正制度的萌芽階段到發(fā)展階段再到全面發(fā)展介紹了美國現(xiàn)代社區(qū)矯正制度的歷史淵源,在此基礎(chǔ)上總結(jié)了美國現(xiàn)代社區(qū)矯正制度具有的特點;從社區(qū)矯正對象、矯正方式以及矯正期限等三個方面介紹了美國社區(qū)矯正的內(nèi)容,結(jié)合我國社區(qū)矯正制度的發(fā)展歷史,從刑事責(zé)任和刑事政策兩個方面對中美兩國的社區(qū)矯正制度進行比較分析,提出了調(diào)整刑罰適用模式,建立符合我國國情的社區(qū)矯正體系以及完善社區(qū)矯正的配套設(shè)施三方面建議,以期對我國的社區(qū)矯正制度的完善能夠有所借鑒。
[Abstract]:Community corrections history can be traced back to more than 100 years ago, from the view of the world, the United States is one of the earliest implementation of community correction in the country, the development of community correction system is imperfect, there are many other countries in the world for reference. After the Second World War, the community correction system has been rapid development. As a kind of a new way of penalty execution, unlike previous imprisonment, the community correction is a kind of open execution, it put the criminal in the open environment of community correction. The community correction system has more advantages in the protection of human rights, but also conducive to the transformation of criminals better reception, social integration, so it has been generally recognized all over the world. Especially in the education punishment concept and restorative justice concept, community correction system more efficient, civilized and humane develop quickly at present, In many countries the number of criminals for punishment of imprisonment have been lower than the application of community correction number. Based on the modern American community correction system as an example, trying to explain the modern American community correction system internal development law and rationality, and provides reference for the development of community correction in China. This article starts from the research background and significance. Introduce the current domestic and foreign research status of American community correction, puts forward the research methods and ideas. In defining the basic concepts of community, community correction and so on, from the "economic penalty" principle, the education thought of punishment and recovery of judicial and other aspects of the ideological and theoretical origin of American community correction; from the community correction system of the embryonic stage to the stage of development to comprehensive development introduces the history of the modern American community correction system, summarized on the basis of modern America The community correction system has the characteristics of community correction object; from three aspects, the methods of correction, correction term introduces the community corrections, combining with the development history of China's community correction system, from two aspects of criminal responsibility and criminal policy of the two countries in the community correction system for comparative analysis, put forward the adjustment mode application of punishment, establish our country's community correction system and the perfection of community correction facilities in three aspects that, in order to improve the system of community correction in China can learn from.
