【摘要】：1992年10月14日,國(guó)務(wù)院頒布《中藥品種保護(hù)條例》,并于1993年1月1日起正式實(shí)施。該制度已經(jīng)歷時(shí)24年之久,作為特有的行政保護(hù)方式,補(bǔ)充了私法保護(hù)尚未涉及到的領(lǐng)域。中藥品種保護(hù)制度為保護(hù)中藥生產(chǎn)企業(yè)的市場(chǎng)準(zhǔn)入而設(shè)置,設(shè)置之初主要針對(duì)當(dāng)時(shí)中藥生產(chǎn)市場(chǎng)混亂而制定,將鼓勵(lì)中藥品種的研究、開(kāi)發(fā),保護(hù)中藥知識(shí)產(chǎn)權(quán),保護(hù)中藥文化遺產(chǎn),加速中藥國(guó)際化進(jìn)程,促進(jìn)中醫(yī)藥產(chǎn)業(yè)健康穩(wěn)定發(fā)展作為出發(fā)點(diǎn)。但自93年頒布以來(lái),并在2009年國(guó)家食品藥品監(jiān)督管理局頒布《中藥品種保護(hù)指導(dǎo)原則》對(duì)品保制度的具體操作進(jìn)行了細(xì)化,并未觸及到制度的定位問(wèn)題及與中藥知識(shí)產(chǎn)權(quán)保護(hù)的關(guān)系。中藥保護(hù)仍然未形成一個(gè)穩(wěn)定且成熟的保護(hù)體系,諸多由中藥市場(chǎng)變化所帶來(lái)的新問(wèn)題仍需面對(duì)。本文在國(guó)內(nèi)外文獻(xiàn)研究的基礎(chǔ)上,以中藥品種保護(hù)制度為研究對(duì)象,從保護(hù)制度的理論及實(shí)踐中分析其貢獻(xiàn)與價(jià)值。根據(jù)中藥專利保護(hù)、品種保護(hù)數(shù)據(jù)分析,中藥專利保護(hù)與品種保護(hù)的對(duì)比分析,以期汲取知識(shí)產(chǎn)權(quán)保護(hù)模式,尋求更全面的中藥保護(hù)體系。同時(shí),依據(jù)中藥品種保護(hù)制度自實(shí)施以來(lái)中藥企業(yè)申請(qǐng)并獲批保護(hù)證書(shū)數(shù)量分析,尋求中藥品種保護(hù)制度的尚未成熟之處,并提出在接下來(lái)制度完善的過(guò)程中,作為一項(xiàng)行政條例,應(yīng)首先尋求中藥企業(yè)及相關(guān)個(gè)人的私權(quán)利與公共利益的平衡,充實(shí)中藥品種保護(hù)的權(quán)利內(nèi)容;其次,對(duì)于保護(hù)制度的保護(hù)客體應(yīng)明確定位于中成藥保護(hù),并且弱化一、二級(jí)保護(hù)分類(lèi);同時(shí),中藥品種保護(hù)制度在新時(shí)期的任務(wù)應(yīng)向鼓勵(lì)中藥品種的創(chuàng)新傾斜;最后,中藥品種保護(hù)制度應(yīng)與其他中藥保護(hù)方式相互協(xié)調(diào)、互為補(bǔ)充,形成完備、成熟的中藥保護(hù)體系。
[Abstract]:In October 14th 1992, the State Council promulgated the regulations on the Protection of traditional Chinese Medicine varieties, and it was formally implemented in January 1st 1993. The system has lasted for 24 years, as a special administrative protection method. The protection system of traditional Chinese medicine varieties is set up to protect the market access of Chinese medicine production enterprises. At the beginning of the establishment, mainly aimed at the confusion of the production market of traditional Chinese medicine at that time. It will encourage the research and development of Chinese medicine varieties, protect intellectual property rights of traditional Chinese medicine, protect the cultural heritage of traditional Chinese medicine, and accelerate the process of internationalization of traditional Chinese medicine. To promote the healthy and stable development of traditional Chinese medicine industry as the starting point. In 2009, the State Food and Drug Administration promulgated the "guidelines for the Protection of traditional Chinese Medicine varieties" to refine the specific operation of the product insurance system. It does not touch on the positioning of the system and the relationship with the protection of intellectual property rights of traditional Chinese medicine. The protection of traditional Chinese medicine has not yet formed a stable and mature protection system. Many new problems caused by the changes in the Chinese medicine market still need to be faced. Based on the domestic and foreign literature, this paper takes the Chinese medicine variety protection system as the research object. From the theory and practice of the protection system to analyze its contribution and value. According to the patent protection of traditional Chinese medicine, variety protection data analysis, traditional Chinese medicine patent protection and variety protection comparative analysis, in order to learn from the intellectual property protection model. At the same time, according to the Chinese medicine variety protection system since the implementation of the traditional Chinese medicine enterprise application and approval of the number of certificates of protection analysis, looking for the protection system of traditional Chinese medicine varieties has not yet matured. And put forward that in the process of perfecting the system, as an administrative regulation, we should first seek the balance between the private rights and public interests of the Chinese medicine enterprises and related individuals, and enrich the content of the right to protect the varieties of traditional Chinese medicine. Secondly, the protection object of the protection system should be clearly positioned in the protection of Chinese patent medicine, and weaken the classification of the first and second level protection; At the same time, the task of the protection system of traditional Chinese medicine varieties in the new period should be inclined to encourage the innovation of traditional Chinese medicine varieties. Finally, the protection system of Chinese medicine varieties should be coordinated with other ways of protection of traditional Chinese medicine and complement each other to form a complete and mature Chinese medicine protection system.
