【摘要】：勞動關(guān)系是生產(chǎn)關(guān)系的重要組成部分,是最基本、最重要的社會關(guān)系之一。勞動關(guān)系和諧穩(wěn)定,關(guān)系到廣大職工的切身利益,是社會和諧穩(wěn)定的前提。環(huán)衛(wèi)工人一直以來都是一個備受關(guān)注的特殊群體。一年四季不管風(fēng)吹日曬,下雨下雪,車流不息的馬路上總是有他們的身影。他們?yōu)槌鞘械沫h(huán)境衛(wèi)生事業(yè)發(fā)展做出了巨大的貢獻(xiàn)。然而,辛苦的背后卻是他們切身利益嚴(yán)重受損的事實：工資低,住房差,沒有節(jié)假日,危險系數(shù)高,沒有養(yǎng)老保障等等。由于環(huán)衛(wèi)工人群體本身素質(zhì)低,自我維權(quán)能力弱,因此為他們做好權(quán)益保障就顯得更為急迫和重要。保障環(huán)衛(wèi)工人的權(quán)益不受侵害,使得他們作為普通勞動者能夠被平等的對待,是維護(hù)社會公平正義的要求,是改善民生的要求,也是全面建設(shè)小康社會的要求。本文試圖通過對環(huán)衛(wèi)工人權(quán)益問題的分析,探究保障環(huán)衛(wèi)工人權(quán)益的對策。引言部分分析了研究背景及意義,描述了國內(nèi)外研究現(xiàn)狀。正文部分分別從環(huán)衛(wèi)工人政治權(quán)益、經(jīng)濟(jì)權(quán)益、安全權(quán)益以及精神文化權(quán)益四方面分析了享有現(xiàn)狀及存在的問題。政治權(quán)益方面,主要分析了環(huán)衛(wèi)工人參與國家公共事務(wù)的權(quán)利以及被尊重的權(quán)利,并從工會、媒體和環(huán)衛(wèi)工人自身方面分析了其影響因素。經(jīng)濟(jì)權(quán)益方面,主要從勞動報酬權(quán)、休息休假的權(quán)利、簽訂勞動合同及繳納社會保險的情況進(jìn)行分析,影響因素主要有政府監(jiān)管、資金投入及環(huán)衛(wèi)部門責(zé)任落實。安全權(quán)益方面,環(huán)衛(wèi)工人安全事故頻發(fā),主要原因從法律法規(guī)、環(huán)衛(wèi)部門職責(zé)、社會公眾素質(zhì)及環(huán)衛(wèi)工人自身素質(zhì)四方面進(jìn)行分析。最后,環(huán)衛(wèi)工人低程度享有精神文化權(quán)益,主要影響因素有環(huán)衛(wèi)部門及環(huán)衛(wèi)工人自身情況。在此基礎(chǔ)上,本文最后一章提出了完善環(huán)衛(wèi)工人權(quán)益保障的對策建議,主要有盡快完善相關(guān)法律法規(guī)；強(qiáng)化政府職能,政府應(yīng)保障其政治權(quán)益,加強(qiáng)對環(huán)衛(wèi)部門監(jiān)督,加大資金投入,做好宣傳教育；環(huán)衛(wèi)部門規(guī)范用工行為,做好安全保障,豐富職工精神文化生活；發(fā)揮工會和媒體的作用；提高環(huán)衛(wèi)工人自身素質(zhì)等。
[Abstract]:Labor relations is an important part of production relations, is the most basic, one of the most important social relations. Labor relations are harmonious and stable, related to the vital interests of workers. It is the premise of social harmony and stability. Sanitation workers have always been a special group of people. No matter the wind and sun, rain and snow all the year round. They are always seen on the busy roads. They have made great contributions to the development of environmental sanitation in the city. However, behind the hard work is the fact that their immediate interests are seriously damaged: low wages. Poor housing, no holidays, high risk coefficient, no old-age security and so on. Therefore, it is more urgent and important to protect the rights and interests of environmental sanitation workers, so that they can be treated equally as ordinary workers, which is the requirement of safeguarding social fairness and justice. It is the requirement of improving people's livelihood and the requirement of building a well-off society in an all-round way. This paper attempts to analyze the rights and interests of environmental sanitation workers. The introduction analyzes the background and significance of the research, describes the current research situation at home and abroad. The main part of the text respectively from the political rights and interests of environmental sanitation workers, economic rights and interests. Security rights and spiritual and cultural rights and interests of the four aspects of the status quo and existing problems, political rights, mainly analyzed the rights of environmental sanitation workers to participate in national public affairs and the right to be respected, and from the trade union. The media and sanitation workers themselves analyzed its impact factors. Economic rights and interests, mainly from the right to work remuneration, the right to rest and leave, the signing of labor contracts and social insurance to analyze the situation. The main influencing factors are government supervision, capital investment and the implementation of the responsibility of the sanitation sector. Safety rights and interests, environmental workers safety accidents occur frequently, the main reasons from the laws and regulations, the responsibility of the sanitation department. Finally, the environmental sanitation workers enjoy spiritual and cultural rights to a low degree, the main factors affecting the sanitation sector and sanitation workers themselves. On this basis. The last chapter of this paper puts forward the countermeasures and suggestions to improve the protection of environmental sanitation workers' rights and interests, mainly as soon as possible to improve the relevant laws and regulations; Strengthen the government function, the government should protect its political rights and interests, strengthen the supervision of the sanitation sector, increase the investment of funds, do a good job of publicity and education; The sanitation department standardizes the employment behavior, completes the safety guarantee, enriches the worker's spiritual and cultural life; The role of trade unions and the media; Improve the quality of sanitation workers themselves.
