【摘要】：信息化科技迅速發(fā)展,使得個人信息的交流更加迅速,科技在帶給人們便利的同時,也導致個人信息被非法的收集、利用、泄露甚至篡改。個人信息除了被公權力利用外,也包含了具有經(jīng)濟價值的社會資源。當前社會通過制定法律給予個人信息保護已成為大陸法系國家的首要選擇,但是我國由于歷史原因和現(xiàn)實原因,并未形成一個專有法律對其進行有效的保護。本文首先對個人信息的概念進行界定,對其范圍進行一個初步的了解。在此基礎上分析域外國家在個人信息保護上采取的立法理念、價值取向以及立法模式的選擇,之后分析我國個人信息法律保護現(xiàn)狀、存在的問題以及產(chǎn)生的原因,最后,針對我國個人信息法律保護的現(xiàn)實并在借鑒域外國家個人信息立法保護經(jīng)驗的基礎上,提出了我國在構建個人信息法律保護時應當秉持的價值取向、立法理念、基本原則以及模式選擇。本文共分為五個部分,第一部分是引言,主要闡述研究的背景、研究的方法和研究的現(xiàn)狀。第二部分是闡述個人信息的基本理論問題,在具體界定“個人信息”的概念及范圍的基礎上,著重分析個人信息與個人隱私的區(qū)別和聯(lián)系。第三部分是介紹當前個人信息立法保護的兩種模式,吸取其優(yōu)點,剔除其糟粕,為我國保護個人信息提供借鑒。第四部分是指出我國個人信息法律保護的現(xiàn)狀、存在問題以及產(chǎn)生的原因。第五部分是具體分析如何完善我國個人信息法律保護制度,主要從個人自我保護、立法、司法三個方面進行詳細闡述,以期能夠更好維護個人信息安全和信息自由流通,促進社會和諧發(fā)展。
[Abstract]:The rapid development of information technology, the personal information exchange more rapidly, science and technology gives people the convenience, also lead to personal information by illegal collection, use and disclosure of personal information has been tampered with. Even in addition to the use of public power, but also contains the economic value of social resources. Through the development of the current social law to give personal information protection has become the first choice in continental law countries, but in China, due to historical and realistic reasons, did not form a proper law to protect the personal information. This paper firstly defines the concept, a preliminary understanding of its scope. Analysis on the legislative idea of foreign countries take in the personal information protection on this basis, value orientation and legislative mode, after the analysis of China's legal protection of personal information in the status quo, problems and causes Because, finally, according to the legal protection of personal information in the reality of our country and on the basis of personal information protection legislation in foreign countries experience, put forward our country should adhere to the value orientation in the construction of the legal protection of personal information when the legislative idea, basic principle and mode choice. This paper is divided into five parts, the first part is the introduction mainly expounds the research background, research status and research methods. The second part demonstrates the basic theory of personal information, based on the specific definition of the concept and scope of personal information ", focuses on the analysis of the difference and connection between personal information and privacy. The third part introduces the two patterns of personal information the legislative protection, absorb its advantage, discard the dross and provide reference for the protection of personal information in our country. The fourth part is the current situation that the legal protection of personal information in our country, problems And the causes. The fifth part is a detailed analysis of how to improve the legal protection of our personal information system, mainly from the personal protection legislation, elaborates three aspects of justice, in order to better safeguard the security of personal information and the free flow of information, promote the harmonious development of society.
