環(huán)境沖突治理中的制度缺陷及優(yōu)化策略研究

【摘要】:在我國環(huán)境沖突治理中,存在一系列的制度缺陷。在制度設(shè)計(jì)之初,認(rèn)知偏差導(dǎo)致環(huán)境治理的制度設(shè)計(jì)的指向不明,制度設(shè)計(jì)的初衷和實(shí)際結(jié)果出現(xiàn)錯位和反差。在制度執(zhí)行過程中的一些缺陷,使得環(huán)境沖突治理的效果難以顯現(xiàn)出來。本文從制度層面上對環(huán)境沖突治理中的缺陷進(jìn)行研究。全文共分為五個部分。第一部分通過對環(huán)境沖突問題的文獻(xiàn)收集和研究,發(fā)現(xiàn)現(xiàn)有的研究大多從宏觀的角度來分析環(huán)境沖突,少有學(xué)者從微觀角度來分析環(huán)境沖突問題。第二部分界定環(huán)境沖突的含義和特性,提出本文研究的理論基礎(chǔ)。第三部分論述環(huán)境沖突治理中存在的制度缺陷。研究表明,由于公務(wù)員任期短期化,政企合謀和環(huán)境考評設(shè)計(jì)缺陷等問題,造成制度選擇原則偏失;由于排污總量核定受到經(jīng)濟(jì)發(fā)展干擾,排污總量不斷被突破,初始分配方案不合理,全國統(tǒng)一的排污權(quán)交易制度框架難以形成;環(huán)境治理中公眾參與機(jī)制不健全,公眾參與環(huán)境立法、執(zhí)法和訴訟的基礎(chǔ)不牢,參與環(huán)境治理的范圍過窄;環(huán)境信息公開機(jī)制不完善,環(huán)境信息公開法律法規(guī)不完善,政府政策保障不足,信息公開不準(zhǔn)確、不及時,信息公開企業(yè)數(shù)量少、內(nèi)容單一、模式凌亂,缺乏公眾參與輿論監(jiān)督。第四部分闡述環(huán)境沖突治理中制度缺陷產(chǎn)生的原因,即,由于政府在環(huán)境事件中扮演著多重角色和環(huán)境審計(jì)主體與內(nèi)容認(rèn)知錯位,地方政府的角色認(rèn)知偏差;排放標(biāo)準(zhǔn)設(shè)定的存在邏輯困境,環(huán)境標(biāo)準(zhǔn)設(shè)定思路不清晰;企業(yè)和政府對排污費(fèi)的認(rèn)知和定位各不相同,排污費(fèi)交易制度的初衷與實(shí)際存在反差。第五部分,針對上文提到制度缺陷問題,提出規(guī)范政府行為,厘清錯誤認(rèn)知現(xiàn)狀,多主體共同參與的協(xié)同治理,完善環(huán)境法制化進(jìn)程等措施。
[Abstract]:There are a series of institutional defects in the management of environmental conflicts in China. At the beginning of the system design, cognitive deviation leads to the uncertainty of the system design of environmental governance. The original intention and actual result of the system design are misplaced and contrasting. Some defects in the implementation of the system make it difficult to show the effect of environmental conflict management. This paper studies the defects in the governance of environmental conflict from the system level. The full text is divided into five parts. In the first part, through the literature collection and research on the environmental conflict, it is found that most of the existing studies analyze the environmental conflict from the macro perspective, and few scholars analyze the environmental conflict from the microscopic point of view. The second part defines the meaning and characteristics of environmental conflict and puts forward the theoretical basis of this study. The third part discusses the institutional defects in the governance of environmental conflict. The study shows that due to the short-term tenure of civil servants, the problems of government and enterprise collusion and the defects of environmental evaluation and design, the principle of system selection is biased, and the total amount of sewage discharge is constantly broken through because of the interference of economic development in the total amount of sewage discharged. The initial distribution scheme is unreasonable, the unified national emission trading system framework is difficult to form, the mechanism of public participation in environmental governance is not perfect, the basis of public participation in environmental legislation, law enforcement and litigation is not strong, and the scope of participation in environmental governance is too narrow. The environmental information disclosure mechanism is not perfect, the environmental information disclosure laws and regulations are not perfect, the government policy protection is insufficient, the information disclosure is not accurate and timely, the number of information disclosure enterprises is small, the content is single, the mode is messy, Lack of public participation in public opinion supervision. The fourth part expounds the causes of institutional defects in the governance of environmental conflict, that is, because the government plays many roles in environmental events and the cognition of the subject and content of environmental audit is wrong, the local government's role cognition deviation; There is a logical dilemma in the setting of emission standards, and the idea of setting environmental standards is not clear; the cognition and orientation of sewage charges are different between enterprises and governments, and the original intention of sewage charges trading system is different from the actual ones. The fifth part, in view of the system defect mentioned above, puts forward some measures, such as standardizing the government behavior, clarifying the current situation of wrong cognition, the cooperative governance of multi-subjects participating together, perfecting the process of environmental legalization and so on.
