【摘要】：自2001年我國首例二氧化硫排污權(quán)交易至今已十五年,我國所展開的排污權(quán)交易試點(diǎn)工作日趨成熟。政府作為同時參與排污權(quán)一級市場和二級市場的重要參與主體,在排污權(quán)的運(yùn)行過程中占據(jù)舉足輕重的作用。排污權(quán)交易的公益性質(zhì)決定了政府是它最好的監(jiān)管者;行政手段是最便捷高效的監(jiān)管路徑;在排污權(quán)交易真正運(yùn)行的二級市場,政府監(jiān)管是為了規(guī)避市場失靈風(fēng)險的手段。因此,排污權(quán)的價格應(yīng)該由市場決定,但排污權(quán)市場的交易秩序要由政府來制定和管理。但是我國經(jīng)過十五年的試點(diǎn)工作,取得成績的同時,也涌現(xiàn)出諸如配套政策制定不足、交易規(guī)則不完善、監(jiān)管不到位等等問題,從而產(chǎn)生政府在可以放手市場的地方費(fèi)盡心力做“保姆”,而在政府應(yīng)當(dāng)實(shí)行有力監(jiān)管的方面心有余力不足的現(xiàn)象。與此對照,上個世紀(jì)就推出排污權(quán)交易制度的美國,立法相對完善,科學(xué)監(jiān)測網(wǎng)絡(luò)覆蓋面廣泛,設(shè)立了一些敏感點(diǎn)來觸發(fā)政府主動作為。此外,美國的社會化機(jī)制較為發(fā)達(dá),一系列的環(huán)保組織甚至個人都能成為監(jiān)管的輔助力量。可以看出,美國政府的監(jiān)管相對我國而言更為張弛有度。國外經(jīng)驗(yàn)不能照搬,但亦有可取之處。為了增進(jìn)我國排污權(quán)交易政府監(jiān)管的效率和作用,應(yīng)當(dāng)更新我國治理方式,以政府監(jiān)管為中心,建立多元治理的模式。增加法律法規(guī)形式的規(guī)范,加強(qiáng)政府各部門的協(xié)同合作,建立監(jiān)測信息共享機(jī)制,增強(qiáng)社會化監(jiān)督機(jī)制,都是在我國排污權(quán)交易的政府監(jiān)管中可取的改善路徑。
[Abstract]:It has been 15 years since the first sulfur dioxide emission trading in China in 2001. As an important participant in both the primary market and the secondary market, the government plays an important role in the operation of emission rights. The commonweal nature of emission trading determines that the government is its best regulator; the administrative means is the most convenient and efficient way of supervision; in the secondary market where emission trading really runs, government regulation is to avoid the risk of market failure. Therefore, the price of emission rights should be determined by the market, but the trading order of emission rights market should be formulated and managed by the government. However, after 15 years of pilot work in our country, while we have made achievements, problems such as inadequate supporting policies, imperfect trading rules, inadequate supervision, and so on have emerged. The result is that the government takes pains to be "nanny" where it can let go of the market, and there is insufficient Yu Li in the area where the government should carry out strong supervision. By contrast, the United States, which introduced the emission trading system in the last century, has relatively perfect legislation, extensive coverage of scientific monitoring network, and has set up some sensitive points to trigger the government's initiative. In addition, social mechanisms are more developed in the United States, a range of environmental groups and even individuals can become a subsidiary force of regulation. As can be seen, the United States government regulation is more Zhang Chi than China. Foreign experience cannot be copied, but there is merit. In order to improve the efficiency and function of the government supervision of emission trading in China, we should renew the governance mode of our country, take the government supervision as the center, and establish the mode of pluralistic governance. Increasing the standard of laws and regulations, strengthening the cooperation of various government departments, establishing the mechanism of monitoring information sharing and strengthening the socialized supervision mechanism are all desirable ways to improve the government supervision of emission trading in our country.
