【摘要】：隨著城市化進(jìn)程不斷深入,我國城市生活垃圾問題日益凸顯。面對(duì)此困境,在現(xiàn)代法治社會(huì)的語境下,反思既往法律治理之失,并為完善今后法律治理提出相應(yīng)對(duì)策。具體而言,在既往實(shí)踐中,立法缺失致法律治理資源不足,執(zhí)法乏力致法律治理績效不彰。是故,應(yīng)兼顧自上而下與自下而上兩種路徑,從完善立法、改進(jìn)執(zhí)法、強(qiáng)化守法三個(gè)維度采取如下對(duì)策:增強(qiáng)立法的體系性、周密性、可操作性,從而為法律治理提供必要制度資源;結(jié)合立法與執(zhí)法,推動(dòng)循環(huán)經(jīng)濟(jì)法制化,從而加強(qiáng)源頭治理;多種措施并舉,確保城市生活垃圾治理所需財(cái)物資源與人力資源;改革環(huán)境行政監(jiān)管體制,落實(shí)責(zé)任機(jī)制,加強(qiáng)違法制裁力度;積極開展環(huán)境保護(hù)法治教育,鼓勵(lì)環(huán)境公益活動(dòng),從而有效提高全民法律意識(shí)與環(huán)保意識(shí)。
[Abstract]:With the development of urbanization, the problem of municipal solid waste (MSW) in China is becoming more and more prominent. Faced with this dilemma, in the context of modern society ruled by law, reflect on the loss of legal governance in the past, and put forward corresponding countermeasures for the improvement of legal governance in the future. Specifically, in the past practice, the lack of legislation leads to the lack of legal governance resources, the lack of law enforcement results in inadequate performance of legal governance. Therefore, we should take into account the top-down and bottom-up approaches, and take the following countermeasures from the three dimensions of perfecting legislation, improving law enforcement and strengthening law-abiding: enhancing the systemativeness, thoroughness and maneuverability of legislation. So as to provide the necessary system resources for the legal management, combine the legislation and law enforcement, promote the legalization of circular economy, thus strengthen the source management, and carry out various measures simultaneously to ensure the property resources and human resources needed for the treatment of municipal solid waste. We should reform the environmental administrative supervision system, implement the responsibility mechanism, strengthen the illegal sanction, actively carry out the education of environmental protection by law, and encourage the environmental public welfare activities, so as to effectively raise the legal consciousness and the environmental protection consciousness of the whole people.
