【摘要】：環(huán)境公益訴訟的主要目的在于對(duì)受到損害的生態(tài)環(huán)境予以修復(fù)。生態(tài)環(huán)境損害不包括私人的財(cái)產(chǎn)與人身?yè)p害。由于傳統(tǒng)民法上的恢復(fù)原狀制度無(wú)法對(duì)生態(tài)環(huán)境損害提供充分的救濟(jì),生態(tài)環(huán)境修復(fù)責(zé)任明顯區(qū)別于恢復(fù)原狀責(zé)任。生態(tài)環(huán)境修復(fù)責(zé)任具有技術(shù)性、公益性和靈活性的特點(diǎn)。為解決在司法實(shí)踐中的一些難點(diǎn)問(wèn)題,急需通過(guò)立法建立完善生態(tài)環(huán)境修復(fù)責(zé)任相關(guān)制度,以保障環(huán)境公益訴訟的順利推進(jìn)。
[Abstract]:The main purpose of environmental public interest litigation is to repair the damaged ecological environment. Ecological environmental damage does not include private property and personal damage. Because of the traditional civil law restitution system can not damage the ecological environment. The disaster provides adequate relief. The responsibility of restoration of ecological environment is obviously different from the responsibility of restoring the original state. The responsibility of restoration of ecological environment has the characteristics of technology, public welfare and flexibility, in order to solve some difficult problems in judicial practice. It is urgent to establish and perfect the system of responsibility for ecological environment restoration through legislation to ensure the smooth progress of environmental public interest litigation.
